2018 AN ACT CONCERNING TH E CONTINUATION OF RETIREMENT
2119 ALLOWANCES FOR CERTA IN RETIREES UPON SUBSEQUENT
2220 EMPLOYMENT BY A BOAR D OF EDUCATION.
2321 Be it enacted by the Senate and House of Representatives in General
2422 Assembly convened:

2624 Section 1. Section 7-438 of the general statutes is repealed and the 1
2725 following is substituted in lieu thereof (Effective October 1, 2019): 2
2826 (a) Any member retired under this part who again accepts 3
2927 employment from [this] the state or from any municipality of [this] the 4
3028 state, other than a participating municipality, shall continue to receive 5
3129 his or her retirement allowance while so employed, and shall be 6
3230 eligible to participate, and shall be entitled to credit, in the state 7
3331 retirement system for the period of such state employment, but any 8
3432 such member shall not be eligible to participate or be entitled to credit 9
3533 in any municipal retirement system for the period of such municipal 10
3634 employment. 11
3735 (b) If a member is retired under this part and again accepts 12
3836 employment from the same municipality from which he or she was 13

46-eligible to participate, and shall be entitled to credit, in the municipal 15
47-employees' retirement system for the period of such municipal 16
4845 employment. Such member shall receive no retirement allowance 17
4946 while so employed except if (1) such employment is for less than 18
5047 twenty hours per week, or (2) his or her services are rendered for not 19
5148 more than ninety working days in any one calendar year, provided 20
5249 that any member reemployed for a period of more than ninety 21
5350 working days in one calendar year shall reimburse the Municipal 22
5451 Employees' Retirement Fund for retirement income payments received 23
5552 during such ninety working days. 24
5653 (c) Notwithstanding the provisions of subsection (b) of this section, 25
5754 if a uniformed member of a paid municipal fire department or a 26
5855 regular member of a paid municipal police department is retired under 27
5956 this part and again accepts employment from any school district or 28
6057 regional school district, which district is a participating municipality, 29
6158 he or she shall continue to receive his or her retirement allowance 30
6259 while so employed, provided such employment is of a public safety 31
6360 nature. 32
6461 This act shall take effect as follows and shall amend the following
