Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 7-438 of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective October 1, 2019): 2 (a) Any member retired under this part who again accepts 3 employment from [this] the state or from any municipality of [this] the 4 state, other than a participating municipality, shall continue to receive 5 his or her retirement allowance while so employed, and shall be 6 eligible to participate, and shall be entitled to credit, in the state 7 retirement system for the period of such state employment, but any 8 such member shall not be eligible to participate or be entitled to credit 9 in any municipal retirement system for the period of such municipal 10 employment. 11 (b) If a member is retired under this part and again accepts 12 employment from the same municipality from which he or she was 13 retired or any other participating municipality, he or she shall be 14 Committee Bill No. 5538 LCO 4589 {\\PRDFS1\HCOUSERS\BARRYJN\WS\2019HB-05538- R02-HB.docx } 2 of 2 eligible to participate, and shall be entitled to credit, in the municipal 15 employees' retirement system for the period of such municipal 16 employment. Such member shall receive no retirement allowance 17 while so employed except if (1) such employment is for less than 18 twenty hours per week, or (2) his or her services are rendered for not 19 more than ninety working days in any one calendar year, provided 20 that any member reemployed for a period of more than ninety 21 working days in one calendar year shall reimburse the Municipal 22 Employees' Retirement Fund for retirement income payments received 23 during such ninety working days. 24 (c) Notwithstanding the provisions of subsection (b) of this section, 25 if a uniformed member of a paid municipal fire department or a 26 regular member of a paid municipal police department is retired under 27 this part and again accepts employment from any school district or 28 regional school district, which district is a participating municipality, 29 he or she shall continue to receive his or her retirement allowance 30 while so employed, provided such employment is of a public safety 31 nature. 32 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2019 7-438 PD Joint Favorable
