2121 AN ACT REQUIRING ADD ITIONAL NOTIFICATION REGARDING

2323 Be it enacted by the Senate and House of Representatives in General

2626 Section 1. (NEW) (Effective October 1, 2019) Notwithstanding any 1
2727 other provision of part III of chapter 32 of the general statutes, upon 2
2828 the payment or delivery of money or other property to the Treasurer 3
2929 under sections 3-62b to 3-62g, inclusive, of the general statutes for 4
3030 deposit in the Special Abandoned Property Fund, where the apparent 5
3131 owner is a municipality, including a department, agency or division of 6
3232 a municipality, the Treasurer shall notify such municipality by first 7
3333 class mail that such money or other property is subject to escheat to the 8
3434 state, and of the municipality's ability to make a claim to such money 9
3535 or property by contacting the Office of the Treasurer. As used in this 10
3636 section, "municipality" means any town, city, borough, consolidated 11
3737 town and city, consolidated town and borough, any metropolitan 12
3838 district, any regional school district, any district as defined in section 7-13
3939 324 of the general statutes, and any other municipal corporation or 14
4040 authority authorized to issue bonds, notes or other obligations under 15 Committee Bill No. 5709

4747 the provisions of the general statutes or any special act. 16
4848 Sec. 2. Section 3-66a of the general statutes is repealed and the 17
4949 following is substituted in lieu thereof (Effective October 1, 2019): 18
5050 (a) During the [2016] 2020 calendar year and every second year 19
5151 thereafter, the Treasurer shall cause notice to be posted electronically 20
5252 on the Treasurer's Internet web site of all property [having a value of 21
5353 fifty dollars or more] reported and transferred to the Treasurer which 22
5454 was presumed abandoned during preceding calendar years and notice 23
5555 of which was not previously published or posted. In addition to such 24
5656 posted notice, the Treasurer [may] shall make such notice accessible to 25
5757 the public [electronically] through additional telecommunications 26
5858 methods as the Treasurer deems cost effective and appropriate, 27
5959 including, but not limited to, at least one of the following methods: A 28
6060 broadcast by radio, television or satellite communication, a notice in a 29
6161 newspaper, magazine, on a billboard or by mail. 30
6262 (b) The posted notice required under subsection (a) of this section 31
6363 shall contain: (1) The names, in alphabetical order, and the last-known 32
6464 addresses, if any, of all persons reported as the apparent owners of 33
6565 unclaimed property, and (2) a statement that any person possessing an 34
6666 interest in such property may obtain from the Treasurer information 35
6767 concerning the amount and description of such property and the name 36
6868 and address of the holder thereof free of charge. Such notice shall be in 37
6969 a form that is easily accessible to and searchable by the public. The 38
7070 Treasurer may cause to be posted at any time, in the manner 39
7171 prescribed in subsection (a) of this section, an additional notice stating 40
7272 that such list may be obtained from other specified sources. 41
7373 (c) The Treasurer may insert in any such notice such additional 42
7474 information as the Treasurer deems necessary for the proper 43
7575 administration of this part. 44
7676 (d) The provisions of this section shall not apply to items reported in 45
7777 the aggregate pursuant to subsection (h) of section 3-65a. 46 Committee Bill No. 5709

8484 Sec. 3. Subsection (b) of section 3-65a of the general statutes is 47
8585 repealed and the following is substituted in lieu thereof (Effective 48
8686 October 1, 2019): 49
8787 (b) Within ninety days after the close of the calendar year in which 50
8888 property is presumed abandoned, the holder shall pay or deliver such 51
8989 property to the Treasurer and file, on forms which the Treasurer shall 52
9090 provide, a report of unclaimed property. Each report shall be verified 53
9191 and shall include: (1) The name, if known, and last-known address, if 54
9292 any, of each person appearing to be the owner of such property; (2) in 55
9393 case of unclaimed funds of an insurance company, the full name of the 56
9494 insured or annuitant and beneficiary and his or her last-known 57
9595 address appearing on the insurance company's records; (3) the nature 58
9696 and identifying number, if any, or description of the property and the 59
9797 amount appearing from the records to be due; [except that the holder 60
9898 shall report in the aggregate items having a value of less than fifty 61
9999 dollars;] (4) the date when the property became payable, demandable 62
100100 or returnable and the date of the last transaction with the owner with 63
101101 respect to the property; (5) if the holder is a successor to other holders, 64
102102 or if the holder has changed the holder's name, all prior known names 65
103103 and addresses of each holder of the property; and (6) such other 66
104104 information as the Treasurer may require. 67
105105 This act shall take effect as follows and shall amend the following
