AN ACT CONCERNING MUNICIPAL LIABILITY WHEN PROVIDING PUBLIC ACCESS TO RECREATIONAL AREAS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That chapter 925 of general statutes be amended to provide that: (1) 1 A municipality that operates a dog park shall be immune from liability 2 for any action that resulted from injury to property or person unless 3 the injury was proximately caused by the negligence of the 4 municipality for failure to guard or warn against a dangerous 5 condition, use, structure or activity, and (2) any person engaged in a 6 recreational activity at a bike park shall assume the risk and legal 7 responsibility for any injury to person or property arising out of the 8 hazards inherent with the activity, unless the injury was proximately 9 caused by the negligence of the municipality for failure to guard or 10 warn against a dangerous condition, use or structure. 11 Statement of Purpose: To reduce municipal liability for certain activities that are inherently dangerous.
