914 AN ACT REQUIRING AN INVASIVE SPECIES STAMP FOR THE
10-OPERATION OF A MOTOR BOAT ON THE WATERS O F THE
11-STATE AND ENFORCEMEN T OF NOISE ORDINANCES ON
12-CANDLEWOOD LAKE.

1316 Be it enacted by the Senate and House of Representatives in General

16-Section 1. (NEW) (Effective January 1, 2020) (a) Any person who
17-registers a vessel or renews a vessel registration pursuant to section 15-
18-144 of the general statutes and who intends to operate or allow such
19-vessel to be operated on the waters of the state shall concomitantly, in
20-addition to the remittance of any fee required pursuant to section 15-
21-144 of the general statutes, pay an Aquatic Invasive Species fee of five
22-dollars. The Commissioner of Motor Vehicles shall cause all revenues
23-collected pursuant to this section to be deposited in the Connecticut
24-Lakes, Rivers and Ponds Preservation account established in section
25-14-21aa of the general statutes, as amended by this act.
26-(b) Any person who intends to operate or allow a vessel to be
27-operated on the inland waters of the state that is registered in another
28-state shall, prior to such operation, pay an Aquatic Invasive Species fee
29-of twenty dollars to the Commissioner of Energy and Environmental
30-Protection. Such fees shall be paid annually and such payment shall be
31-valid until the last day of December of such year. The Commissioner of Substitute House Bill No. 6637
19+Section 1. (NEW) (Effective October 1, 2019) (a) Any person who 1
20+registers a vessel or renews a vessel registration pursuant to section 15-2
21+144 of the general statutes and who intends to operate or allow such 3
22+vessel to be operated on the waters of the state shall concomitantly, in 4
23+addition to the remittance of any fee required pursuant to section 15-5
24+144 of the general statutes, purchase an Invasive Species Stamp. Such 6
25+stamp shall expire with the applicable registration for such vessel. The 7
26+fee for such stamp shall be five dollars. The Commissioner of Motor 8
27+Vehicles shall cause all revenues collected pursuant to this section to 9
28+be deposited in the Connecticut Lakes, Rivers and Ponds Preservation 10
29+account established in section 14-21aa of the general statutes, as 11
30+amended by this act. 12
31+(b) Any person who intends to operate or allow a vessel to be 13
32+operated on the waters of the state that is registered in another state 14
33+shall, prior to such operation, purchase an Invasive Species Stamp 15
34+from the Commissioner of Energy and Environmental Protection. The 16
35+fee for such stamp shall be twenty dollars. Such stamp shall expire on 17
36+the last day of April of the year following its issuance. The 18

35-Energy and Environmental Protection shall cause all revenues
36-collected pursuant to this subsection to be deposited in the Connecticut
37-Lakes, Rivers and Ponds Preservation account established in section
38-14-21aa of the general statutes, as amended by this act. Any person
39-who operates a vessel on the inland waters of the state in violation of
40-the provisions of this subsection shall have committed an infraction
41-and shall be fined not more than eighty-five dollars.
42-Sec. 2. Section 14-21aa of the general statutes is repealed and the
43-following is substituted in lieu thereof (Effective January 1, 2020):
44-(a) There is established an account to be known as the "Connecticut
45-Lakes, Rivers and Ponds Preservation account". The Connecticut
46-Lakes, Rivers and Ponds Preservation account shall be a separate,
47-nonlapsing account of the General Fund. Any moneys required by law
48-to be deposited in the account shall be deposited in and credited to the
49-Connecticut Lakes, Rivers and Ponds Preservation account. The
50-account shall be available to the Commissioner of Energy and
51-Environmental Protection for (1) restoration and rehabilitation of lakes,
52-rivers and ponds in the state; (2) programs of the Department of
53-Energy and Environmental Protection for the eradication of aquatic
54-invasive species and cyanobacteria blooms; (3) education and public
55-outreach programs to enhance the public's understanding of the need
56-to protect and preserve the state's lakes, rivers and ponds; (4)
57-allocation of grants to state and municipal agencies and not-for-profit
58-organizations to conduct research and to provide public education and
59-public awareness to enhance understanding and management of the
60-natural resources of the state's lakes, rivers and ponds; (5) provision of
61-funds for all services that support the protection and conservation of
62-the state's lakes, rivers and ponds; and (6) reimbursement of the
63-Department of Motor Vehicles for the cost of producing, issuing,
64-renewing and replacing Save Our Lakes commemorative number
65-plates, including administrative expenses, pursuant to section 14-21z. Substitute House Bill No. 6637

69-(b) The commissioner may receive private donations to the
70-Connecticut Lakes, Rivers and Ponds Preservation account and any
71-such receipts shall be deposited in the account.
72-(c) The commissioner may provide for the reproduction and
73-marketing of the Save Our Lakes commemorative number plate image
74-for use on clothing, recreational equipment, posters, mementoes, or
75-other products or programs deemed by the commissioner to be
76-suitable as a means of supporting the Connecticut Lakes, Rivers and
77-Ponds Preservation account. Any funds received by the commissioner
78-from such marketing shall be deposited in the Connecticut Lakes,
79-Rivers and Ponds Preservation account.
80-(d) Notwithstanding any provision of this section, not less than
81-eighty per cent of any funds deposited into the Connecticut Lakes,
82-Rivers and Ponds Preservation account pursuant to section 1 of this act
83-shall be utilized for the purposes described in subdivisions (2) to (4),
84-inclusive, of subsection (a) of this section.
85-Sec. 3. (NEW) (Effective from passage) Notwithstanding any provision
86-of the general statutes, any environmental conservation police officer
87-of the Department of Energy and Environmental Protection has the
88-authority to enforce the noise ordinance of any municipality that abuts
89-Candlewood Lake on the waters of such lake. In the event that
90-multiple towns that abut such lake have a noise ordinance, any such
91-officer is authorized to enforce the noise ordinance of the municipality
92-that establishes the most restrictive standard for noise upon the waters
93-of such lake.

89+any funds deposited into the Connecticut Lakes, Rivers and Ponds 59
90+Preservation account pursuant to section 1 of this act shall be utilized 60
91+for the purposes described in subdivisions (2) to (4), inclusive, of 61
92+subsection (a) of this section. 62
