2119 AN ACT CONCERNING ACCESS TO STATE AGENCY DATA HELD BY
2220 STATE CONTRACTORS.
2321 Be it enacted by the Senate and House of Representatives in General

26-Section 1. Subsection (c) of section 2-90 of the general statutes is 1
27-repealed and the following is substituted in lieu thereof (Effective 2
28-October 1, 2019): 3
29-(c) Said auditors shall audit, on a biennial basis if deemed most 4
30-economical and efficient, or as frequently as they deem necessary, the 5
31-books and accounts of each officer, department, commission, board 6
32-and court of the state government, all institutions supported by the 7
33-state and all public and quasi-public bodies, politic and corporate, 8
34-created by public or special act of the General Assembly and not 9
35-required to be audited or subject to reporting requirements, under the 10
36-provisions of chapter 111. Each such audit may include an examination 11
37-of any relevant information concerning the department, commission, 12
38-board or court of state government being audited that is in the 13
39-possession or control of a private entity that has a contract with such 14
40-department, commission, board or court. Each such audit may include 15

46-an examination of performance in order to determine effectiveness in 16
47-achieving expressed legislative purposes. The auditors shall report 17
48-their findings and recommendations to the Governor, the State 18
49-Comptroller and the joint standing committee of the General Assembly 19
50-having cognizance of matters relating to appropriations and the 20
51-budgets of state agencies. 21
52-Sec. 2. (NEW) (Effective October 1, 2019) As used in this section, 22
53-"contract", "state agency", "data" and "contractor" have the same 23
54-meanings as provided in section 4e-1 of the general statutes. Any 24
55-contract between a state contracting agency and a contractor that is 25
56-entered into, renewed or amended on or after October 1, 2019, shall 26
57-contain a provision authorizing the state contracting agency to access 27
58-any data concerning such agency that is in the possession or control of 28
59-the contractor. 29
60-This act shall take effect as follows and shall amend the following
61-sections:
