AN ACT CONCERNING AC CESS TO STATE AGENCY DATA HELD BY 
STATE CONTRACTORS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. Subsection (c) of section 2-90 of the general statutes is 1 
repealed and the following is substituted in lieu thereof (Effective 2 
October 1, 2019): 3 
(c) Said auditors shall audit, on a biennial basis if deemed most 4 
economical and efficient, or as frequently as they deem necessary, the 5 
books and accounts of each officer, department, commission, board 6 
and court of the state government, all institutions supported by the 7 
state and all public and quasi-public bodies, politic and corporate, 8 
created by public or special act of the General Assembly and not 9 
required to be audited or subject to reporting requirements, under the 10 
provisions of chapter 111. Each such audit may include an examination 11 
of any relevant information concerning the department, commission, 12 
board or court of state government being audited that is in the 13 
possession or control of a private entity that has a contract with such 14 
department, commission, board or court. Each such audit may include 15

an examination of performance in order to determine effectiveness in 16 
achieving expressed legislative purposes. The auditors shall report 17 
their findings and recommendations to the Governor, the State 18 
Comptroller and the joint standing committee of the General Assembly 19 
having cognizance of matters relating to appropriations and the 20 
budgets of state agencies.  21 
Sec. 2. (NEW) (Effective October 1, 2019) As used in this section, 22 
"contract", "state agency", "data" and "contractor" have the same 23 
meanings as provided in section 4e-1 of the general statutes. Any 24 
contract between a state contracting agency and a contractor that is 25 
entered into, renewed or amended on or after October 1, 2019, shall 26 
contain a provision authorizing the state contracting agency to access 27 
any data concerning such agency that is in the possession or control of 28 
the contractor. 29 
This act shall take effect as follows and shall amend the following 
sections:

Statement of Purpose:   
To permit the Auditors of Public Accounts to access any information 
concerning a state agency that is held by a state contractor and to 
require state contracts to contain a provision authorizing state agencies 
to access any of their data held by a contractor.
