2121 AN ACT CONCERNING FINANCIAL ASSISTANCE FOR CRUMBLING
2222 CONCRETE FOUNDATIONS.
2323 Be it enacted by the Senate and House of Representatives in General
2424 Assembly convened:

2626 That chapter 698 of the general statutes be amended to provide that 1
2727 (1) the captive insurance company established pursuant to section 38a-2
2828 91vv of the general statutes shall not refuse to provide financial 3
2929 assistance to, or designate as inactive any application for financial 4
3030 assistance filed by, any homeowner because such homeowner has filed 5
3131 a civil action seeking damages for the deterioration of such 6
3232 homeowner's concrete foundation, and (2) each homeowner who 7
3333 receives financial assistance from such company and recovers damages 8
3434 from such an action shall, if the amount of such damages exceeds the 9
3535 amount of such assistance, (A) reimburse such company for such 10
3636 assistance, and (B) pay to such company any portion of such damages 11
3737 that exceeds the sum of the amount of such assistance and the amount 12
3838 of all costs incurred by such homeowner to repair such deterioration. 13 Proposed Bill No. 6688

4343 Statement of Purpose:
4444 To expand the number of homeowners who are eligible for financial
4545 assistance for crumbling concrete foundations and recover civil
4646 damages awarded to homeowners in certain circumstances.
