| 26 | 26 | That chapter 698 of the general statutes be amended to provide that 1 | |
| 27 | 27 | (1) the captive insurance company established pursuant to section 38a-2 | |
| 28 | 28 | 91vv of the general statutes shall not refuse to provide financial 3 | |
| 29 | 29 | assistance to, or designate as inactive any application for financial 4 | |
| 30 | 30 | assistance filed by, any homeowner because such homeowner has filed 5 | |
| 31 | 31 | a civil action seeking damages for the deterioration of such 6 | |
| 32 | 32 | homeowner's concrete foundation, and (2) each homeowner who 7 | |
| 33 | 33 | receives financial assistance from such company and recovers damages 8 | |
| 34 | 34 | from such an action shall, if the amount of such damages exceeds the 9 | |
| 35 | 35 | amount of such assistance, (A) reimburse such company for such 10 | |
| 36 | 36 | assistance, and (B) pay to such company any portion of such damages 11 | |
| 37 | 37 | that exceeds the sum of the amount of such assistance and the amount 12 | |
