AN ACT CONCERNING FINANCIAL ASSISTANCE FOR CRUMBLING CONCRETE FOUNDATIONS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That chapter 698 of the general statutes be amended to provide that 1 (1) the captive insurance company established pursuant to section 38a-2 91vv of the general statutes shall not refuse to provide financial 3 assistance to, or designate as inactive any application for financial 4 assistance filed by, any homeowner because such homeowner has filed 5 a civil action seeking damages for the deterioration of such 6 homeowner's concrete foundation, and (2) each homeowner who 7 receives financial assistance from such company and recovers damages 8 from such an action shall, if the amount of such damages exceeds the 9 amount of such assistance, (A) reimburse such company for such 10 assistance, and (B) pay to such company any portion of such damages 11 that exceeds the sum of the amount of such assistance and the amount 12 of all costs incurred by such homeowner to repair such deterioration. 13 Proposed Bill No. 6688 LCO No. 3100 2 of 2 Statement of Purpose: To expand the number of homeowners who are eligible for financial assistance for crumbling concrete foundations and recover civil damages awarded to homeowners in certain circumstances.
