AN ACT CONCERNING THE CONSIDERATION OF THE PUBLIC INTEREST WHEN THE COURT DETERMINES WHETHER TO TRANSFER A JUVENILE TO THE REGULAR CRIMINAL DOCKET. Be it enacted by the Senate and House of Representatives in General Assembly convened: That subparagraph (C) of subdivision (1) of subsection (b) of section 1 46b-127 of the general statutes be amended to provide the court greater 2 discretion when determining whether to transfer a juvenile from the 3 docket for juvenile matters to the regular criminal docket of the 4 Superior Court in the case of a class C, D or E felony or an unclassified 5 felony by considering whether the best interests of the child or the 6 public will not be served by not maintaining the case in the superior 7 court for juvenile matters, rather than requiring the court to consider 8 the best interests of the child and the public as part of that 9 determination. 10 Statement of Purpose: To consider the public interest in deciding whether to transfer children committing certain felonies from the juvenile docket to the regular criminal docket.
