2020 AN ACT PROHIBITING THE INCLUSION OF CERTAIN BEVERAGES
2121 ON CHILDREN'S MENUS.
2222 Be it enacted by the Senate and House of Representatives in General

2525 Section 1. (NEW) (Effective July 1, 2019) (a) As used in this section: 1
2626 (1) "Authorized agent" means any individual certified by the 2
2727 Commissioner of Public Health to inspect food service establishments 3
2828 and enforce the provisions of section 19-13-B42 of the regulations of 4
2929 Connecticut state agencies under the supervision or authority of the 5
3030 director of health; 6
3131 (2) "Children's meal" means a single food item or combination of 7
3232 food items and a beverage sold together at a single price and intended 8
3333 primarily for consumption by a child; 9
3434 (3) "Children's menu" means a restaurant menu intended primarily 10
3535 for children, a section of a restaurant menu intended primarily for 11
3636 children or an advertisement for a children's meal; 12

4343 department or district health department confirmed or appointed 14
4444 pursuant to sections 19a-200 and 19a-242 of the general statutes; 15
4545 (5) "Nondairy milk alternative" means a fluid milk substitute that 16
4646 meets the standards established pursuant to the National School Lunch 17
4747 Program meal requirements for lunches and requirements for 18
4848 afterschool snacks, 7 CFR 210.10; and 19
4949 (6) "Restaurant" means any entity, other than a grocery store, that is 20
5050 licensed, permitted, registered or inspected as a food service 21
5151 establishment by a local health department or district health 22
5252 department pursuant to section 19-13-B42 of the regulations of 23
5353 Connecticut state agencies. 24
5454 (b) On and after January 1, 2020, no beverage listed or displayed on 25
5555 a children's menu shall be a beverage other than water, sparkling 26
5656 water, flavored water with no added sweeteners, unflavored milk or a 27
5757 nondairy milk alternative. 28
5858 (c) Nothing in this section shall be construed to prohibit a restaurant 29
5959 from selling or a customer from purchasing a beverage that does not 30
6060 appear on a children's menu if such beverage is requested by the 31
6161 customer. 32
6262 (d) For the purpose of enforcing the provisions of this section, each 33
6363 authorized agent shall, as part of the regularly scheduled food service 34
6464 establishment inspections, evaluate the restaurant's compliance with 35
6565 such provisions. 36
6666 Sec. 2. Section 19a-36a of the general statutes is repealed and the 37
6767 following is substituted in lieu thereof (Effective July 1, 2019): 38
6868 (a) The Commissioner of Public Health shall adopt regulations, in 39
6969 accordance with the provisions of chapter 54, to assure that food 40
7070 service establishments employ as food operators persons who have a 41
7171 knowledge of safe food handling techniques and to set requirements 42

7878 regulations shall include, but not be limited to, responsibilities of food 44
7979 service establishments and their employees, exemptions for certain 45
8080 classes of food establishments and responsibilities of local health 46
8181 departments in monitoring compliance of food establishments. 47
8282 (b) On or before January 1, 2020, the Commissioner of Public Health 48
8383 shall adopt regulations, in accordance with the provisions of chapter 49
8484 54, incorporating inspection and enforcement procedures for the 50
8585 requirements established in section 1 of this act into regularly 51
8686 scheduled food service establishment inspections. 52
8787 This act shall take effect as follows and shall amend the following
