LCO No. 3493 1 of 3 General Assembly Raised Bill No. 7006 January Session, 2019 LCO No. 3493 Referred to Committee on COMMITTEE ON CHILDREN Introduced by: (KID) AN ACT PROHIBITING THE INCLUSION OF CERTAIN BEVERAGES ON CHILDREN'S MENUS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective July 1, 2019) (a) As used in this section: 1 (1) "Authorized agent" means any individual certified by the 2 Commissioner of Public Health to inspect food service establishments 3 and enforce the provisions of section 19-13-B42 of the regulations of 4 Connecticut state agencies under the supervision or authority of the 5 director of health; 6 (2) "Children's meal" means a single food item or combination of 7 food items and a beverage sold together at a single price and intended 8 primarily for consumption by a child; 9 (3) "Children's menu" means a restaurant menu intended primarily 10 for children, a section of a restaurant menu intended primarily for 11 children or an advertisement for a children's meal; 12 (4) "Director of health" means the director of a local health 13 Raised Bill No. 7006 LCO No. 3493 2 of 3 department or district health department confirmed or appointed 14 pursuant to sections 19a-200 and 19a-242 of the general statutes; 15 (5) "Nondairy milk alternative" means a fluid milk substitute that 16 meets the standards established pursuant to the National School Lunch 17 Program meal requirements for lunches and requirements for 18 afterschool snacks, 7 CFR 210.10; and 19 (6) "Restaurant" means any entity, other than a grocery store, that is 20 licensed, permitted, registered or inspected as a food service 21 establishment by a local health department or district health 22 department pursuant to section 19-13-B42 of the regulations of 23 Connecticut state agencies. 24 (b) On and after January 1, 2020, no beverage listed or displayed on 25 a children's menu shall be a beverage other than water, sparkling 26 water, flavored water with no added sweeteners, unflavored milk or a 27 nondairy milk alternative. 28 (c) Nothing in this section shall be construed to prohibit a restaurant 29 from selling or a customer from purchasing a beverage that does not 30 appear on a children's menu if such beverage is requested by the 31 customer. 32 (d) For the purpose of enforcing the provisions of this section, each 33 authorized agent shall, as part of the regularly scheduled food service 34 establishment inspections, evaluate the restaurant's compliance with 35 such provisions. 36 Sec. 2. Section 19a-36a of the general statutes is repealed and the 37 following is substituted in lieu thereof (Effective July 1, 2019): 38 (a) The Commissioner of Public Health shall adopt regulations, in 39 accordance with the provisions of chapter 54, to assure that food 40 service establishments employ as food operators persons who have a 41 knowledge of safe food handling techniques and to set requirements 42 for the employment of food operators by such establishments. Such 43 Raised Bill No. 7006 LCO No. 3493 3 of 3 regulations shall include, but not be limited to, responsibilities of food 44 service establishments and their employees, exemptions for certain 45 classes of food establishments and responsibilities of local health 46 departments in monitoring compliance of food establishments. 47 (b) On or before January 1, 2020, the Commissioner of Public Health 48 shall adopt regulations, in accordance with the provisions of chapter 49 54, incorporating inspection and enforcement procedures for the 50 requirements established in section 1 of this act into regularly 51 scheduled food service establishment inspections. 52 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 New section Sec. 2 July 1, 2019 19a-36a Statement of Purpose: To prohibit restaurants from including soft drink beverages on children's menus and in children's meals.
