2019 AN ACT CONCERNING FL U SHOTS FOR SENIOR CITIZENS PRIOR

2221 Be it enacted by the Senate and House of Representatives in General

2524 Section 1. Section 19a-490k of the general statutes is repealed and 1
2625 the following is substituted in lieu thereof (Effective October 1, 2019): 2
2726 (a) A hospital may administer care to patients, after an assessment 3
2827 of contraindications, without a physician's order, in accordance with a 4
2928 physician-approved hospital policy, if such care is emergent, timely 5
3029 and necessary, or for the purpose of advancing patient care, to the 6
3130 extent such care is permitted by 42 CFR Part 482. 7
3231 (b) A hospital may administer any prophylactic care or treatment to 8
3332 healthy newborns who are born at the hospital, or who are admitted to 9
3433 the hospital nursery, after an assessment of contraindications, without 10
3534 a physician's order, in accordance with a physician-approved hospital 11
3635 policy, to the extent such care or treatment is permitted by 42 CFR Part 12

4745 policy. [The Commissioner of Public Health shall adopt regulations, in 17
4846 accordance with the provisions of chapter 54, to carry out the 18
4947 provisions of this subsection.] 19
50-(d) On and after October 1, 2019, to March 1, 2020, inclusive, and 20

5149 annually thereafter, a hospital shall offer immunizations against 21
5250 influenza, contingent upon availability of the vaccine and in 22
5351 accordance with the recommendations of the Advisory Committee on 23

5553 Prevention, to each inpatient sixty-five years of age and older, prior to 25
5654 discharge, unless medically contraindicated. 26
5755 (e) The Commissioner of Public Health shall adopt regulations, in 27
5856 accordance with the provisions of chapter 54, to carry out the 28
5957 provisions of subsections (c) and (d) of this section. 29
