20	19		AN ACT CONCERNING FL U SHOTS FOR SENIOR CITIZENS PRIOR

22	21		Be it enacted by the Senate and House of Representatives in General
23	22		Assembly convened:

25	24		Section 1. Section 19a-490k of the general statutes is repealed and 1
26	25		the following is substituted in lieu thereof (Effective October 1, 2019): 2
27	26		(a) A hospital may administer care to patients, after an assessment 3
28	27		of contraindications, without a physician's order, in accordance with a 4
29	28		physician-approved hospital policy, if such care is emergent, timely 5
30	29		and necessary, or for the purpose of advancing patient care, to the 6
31	30		extent such care is permitted by 42 CFR Part 482. 7
32	31		(b) A hospital may administer any prophylactic care or treatment to 8
33	32		healthy newborns who are born at the hospital, or who are admitted to 9
34	33		the hospital nursery, after an assessment of contraindications, without 10
35	34		a physician's order, in accordance with a physician-approved hospital 11
36	35		policy, to the extent such care or treatment is permitted by 42 CFR Part 12
37	36		482. 13

46	44		physician's order, in accordance with a physician-approved hospital 16
47	45		policy. [The Commissioner of Public Health shall adopt regulations, in 17
48	46		accordance with the provisions of chapter 54, to carry out the 18
49	47		provisions of this subsection.] 19
50		-	(d) On and after October 1, 2019, to March 1, 2020, inclusive, and 20

51	49		annually thereafter, a hospital shall offer immunizations against 21
52	50		influenza, contingent upon availability of the vaccine and in 22
53	51		accordance with the recommendations of the Advisory Committee on 23
54	52		Immunization Practices of the Centers for Disease Control and 24
55	53		Prevention, to each inpatient sixty-five years of age and older, prior to 25
56	54		discharge, unless medically contraindicated. 26
57	55		(e) The Commissioner of Public Health shall adopt regulations, in 27
58	56		accordance with the provisions of chapter 54, to carry out the 28
59	57		provisions of subsections (c) and (d) of this section. 29
