Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 19a-490k of the general statutes is repealed and 1 the following is substituted in lieu thereof (Effective October 1, 2019): 2 (a) A hospital may administer care to patients, after an assessment 3 of contraindications, without a physician's order, in accordance with a 4 physician-approved hospital policy, if such care is emergent, timely 5 and necessary, or for the purpose of advancing patient care, to the 6 extent such care is permitted by 42 CFR Part 482. 7 (b) A hospital may administer any prophylactic care or treatment to 8 healthy newborns who are born at the hospital, or who are admitted to 9 the hospital nursery, after an assessment of contraindications, without 10 a physician's order, in accordance with a physician-approved hospital 11 policy, to the extent such care or treatment is permitted by 42 CFR Part 12 482. 13 (c) A hospital may administer influenza and pneumococcal vaccines 14 Raised Bill No. 7101 LCO 3382 {\\PRDFS1\HCOUSERS\BARRYJN\WS\2019HB-07101- R01-HB.docx } 2 of 2 to patients, after an assessment for contraindications, without a 15 physician's order, in accordance with a physician-approved hospital 16 policy. [The Commissioner of Public Health shall adopt regulations, in 17 accordance with the provisions of chapter 54, to carry out the 18 provisions of this subsection.] 19 (d) On and after October 1, 2019, to March 1, 2020, inclusive, and 20 annually thereafter, a hospital shall offer immunizations against 21 influenza, contingent upon availability of the vaccine and in 22 accordance with the recommendations of the Advisory Committee on 23 Immunization Practices of the Centers for Disease Control and 24 Prevention, to each inpatient sixty-five years of age and older, prior to 25 discharge, unless medically contraindicated. 26 (e) The Commissioner of Public Health shall adopt regulations, in 27 accordance with the provisions of chapter 54, to carry out the 28 provisions of subsections (c) and (d) of this section. 29 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2019 19a-490k AGE Joint Favorable
