914 AN ACT REGULATING EL ECTRIC FOOT SCOOTERS .
1015 Be it enacted by the Senate and House of Representatives in General
1116 Assembly convened:

13-Section 1. Section 14-1 of the general statutes is repealed and the
14-following is substituted in lieu thereof (Effective October 1, 2019):
15-Terms used in this chapter [, sections 14-289k and 14-289l and this
16-section] shall be construed as follows, unless another construction is
17-clearly apparent from the language or context in which the term is
18-used or unless the construction is inconsistent with the manifest
19-intention of the General Assembly:
20-(1) "Activity vehicle" means a student transportation vehicle that is
21-used to transport students in connection with school-sponsored events
22-and activities, but is not used to transport students to and from school;
23-(2) "Agricultural tractor" means a tractor or other form of
24-nonmuscular motive power used for transporting, hauling, plowing,
25-cultivating, planting, harvesting, reaping or other agricultural
26-purposes on any farm or other private property, or used for the
27-purpose of transporting, from one farm to another, agricultural
28-implements and farm products, provided the agricultural tractor is not

34-(3) "Antique, rare or special interest motor vehicle" means a motor
35-vehicle twenty years old or older which is being preserved because of
36-historic interest and which is not altered or modified from the original
37-manufacturer's specifications;
38-(4) "Apparent candle power" means an illumination equal to the
39-normal illumination in foot candles produced by any lamp or lamps,
40-divided by the square of the distance in feet between the lamp or
41-lamps and the point at which the measurement is made;
42-(5) "Authorized emergency vehicle" means (A) a fire department
43-vehicle, (B) a police vehicle, or (C) a public service company or
44-municipal department ambulance or emergency vehicle designated or
45-authorized for use as an authorized emergency vehicle by the
46-commissioner;
47-(6) "Autocycle" means a motor vehicle that meets the requirements
48-of a motorcycle under 49 CFR Part 571, and (A) does not have more
49-than three wheels in contact with the ground, (B) is designed to be
50-controlled with a steering wheel and foot pedals for acceleration,
51-braking or shifting, (C) has a seat or seats that are fully or partially
52-enclosed and in which the occupants sit with their legs forward, and
53-(D) is equipped with safety belts, in accordance with section 14-100a,
54-for all occupants;
55-(7) "Auxiliary driving lamp" means an additional lighting device on
56-a motor vehicle used primarily to supplement the general illumination
57-in front of a motor vehicle provided by the motor vehicle's head lamps;
58-(8) "Bulb" means a light source consisting of a glass bulb containing
59-a filament or substance capable of being electrically maintained at

64-(9) "Camp trailer" includes any trailer designed for living or
65-sleeping purposes and used exclusively for camping or recreational
66-purposes;
67-(10) "Camp trailer registration" means the type of registration issued
68-to any trailer that is for nonbusiness use and is limited to camp trailers
69-and utility trailers;
70-(11) "Camp vehicle" means any motor vehicle that is regularly used
71-to transport persons under eighteen years of age in connection with the
72-activities of any youth camp, as defined in section 19a-420;
73-(12) "Camper" means any motor vehicle designed or permanently
74-altered in such a way as to provide temporary living quarters for
75-travel, camping or recreational purposes;
76-(13) "Class 1 electric bicycle" means an electric bicycle equipped
77-with a motor that engages only when the rider operates the electric
78-bicycle's foot pedals, and disengages when the rider stops pedaling or
79-such electric bicycle reaches the speed of twenty miles per hour;
80-(14) "Class 2 electric bicycle" means an electric bicycle equipped
81-with a motor that may be used exclusively to propel the electric
82-bicycle, and disengages when the brakes are applied or such electric
83-bicycle reaches the speed of twenty miles per hour;
84-(15) "Class 3 electric bicycle" means an electric bicycle equipped
85-with a motor that engages only when the rider operates the electric
86-bicycle's foot pedals, and disengages when the rider stops pedaling or
87-such electric bicycle reaches the speed of twenty-eight miles per hour;
88-(16) "Combination registration" means the type of registration
89-issued to a motor vehicle used for both private passenger and
90-commercial purposes if such vehicle does not have a gross vehicle
91-weight rating in excess of twelve thousand five hundred pounds; Substitute House Bill No. 7141

95-(17) "Commercial driver's license" or "CDL" means a license issued
96-to an individual in accordance with the provisions of sections 14-44a to
97-14-44m, inclusive, which authorizes such individual to drive a
98-commercial motor vehicle;
99-(18) "Commercial driver's license information system" or "CDLIS"
100-means the national database of holders of commercial driver's licenses
101-established by the Federal Motor Carrier Safety Administration
102-pursuant to Section 12007 of the Commercial Motor Vehicle Safety Act
103-of 1986;
104-(19) "Commercial motor vehicle" means a vehicle designed or used
105-to transport passengers or property, except a vehicle used for farming
106-purposes in accordance with 49 CFR 383.3(d), fire fighting apparatus
107-or an emergency vehicle, as defined in section 14-283, or a recreational
108-vehicle in private use, which (A) has a gross vehicle weight rating of
109-twenty-six thousand and one pounds or more, or a gross combination
110-weight rating of twenty-six thousand and one pounds or more,
111-inclusive of a towed unit or units with a gross vehicle weight rating of
112-more than ten thousand pounds; (B) is designed to transport sixteen or
113-more passengers, including the driver, or is designed to transport more
114-than ten passengers, including the driver, and is used to transport
115-students under the age of twenty-one years to and from school; or (C)
116-is transporting hazardous materials and is required to be placarded in
117-accordance with 49 CFR 172, Subpart F, as amended, or any quantity of
118-a material listed as a select agent or toxin in 42 CFR Part 73;
119-(20) "Commercial registration" means the type of registration
120-required for any motor vehicle designed or used to transport
121-merchandise, freight or persons in connection with any business
122-enterprise, unless a more specific type of registration is authorized and
123-issued by the commissioner for such class of vehicle;
124-(21) "Commercial trailer" means a trailer used in the conduct of a Substitute House Bill No. 7141
78+(10) "Camp trailer registration" means the type of registration issued 49
79+to any trailer that is for nonbusiness use and is limited to camp trailers 50
80+and utility trailers; 51
81+(11) "Camp vehicle" means any motor vehicle that is regularly used 52
82+to transport persons under eighteen years of age in connection with the 53
83+activities of any youth camp, as defined in section 19a-420; 54
84+(12) "Camper" means any motor vehicle designed or permanently 55

95+(15) "Class 3 electric bicycle" means an electric bicycle equipped 66
96+with a motor that engages only when the rider operates the electric 67
97+bicycle's foot pedals, and disengages when the rider stops pedaling or 68
98+such electric bicycle reaches the speed of twenty-eight miles per hour; 69
99+(16) "Combination registration" means the type of registration 70
100+issued to a motor vehicle used for both private passenger and 71
101+commercial purposes if such vehicle does not have a gross vehicle 72
102+weight rating in excess of twelve thousand five hundred pounds; 73
103+(17) "Commercial driver's license" or "CDL" means a license issued 74
104+to an individual in accordance with the provisions of sections 14-44a to 75
105+14-44m, inclusive, which authorizes such individual to drive a 76

128-business to transport freight, materials or equipment whether or not
129-permanently affixed to the bed of the trailer;
130-(22) "Commercial trailer registration" means the type of registration
131-issued to any commercial trailer;
132-(23) "Commissioner" includes the Commissioner of Motor Vehicles
133-and any assistant to the Commissioner of Motor Vehicles who is
134-designated and authorized by, and who is acting for, the
135-Commissioner of Motor Vehicles under a designation; except that the
136-deputy commissioners of motor vehicles and the Attorney General are
137-deemed, unless the Commissioner of Motor Vehicles otherwise
138-provides, to be designated and authorized by, and acting for, the
139-Commissioner of Motor Vehicles under a designation;
140-(24) "Controlled substance" has the same meaning as provided in
141-section 21a-240 and the federal laws and regulations incorporated in
142-chapter 420b;
143-(25) "Conviction" means an unvacated adjudication of guilt, or a
144-determination that a person has violated or failed to comply with the
145-law in a court of original jurisdiction or an authorized administrative
146-tribunal, an unvacated forfeiture of bail or collateral deposited to
147-secure the person's appearance in court, the payment of a fine or court
148-cost, or violation of a condition of release without bail, regardless of
149-whether or not the penalty is rebated, suspended or probated;
150-(26) "Dealer" includes any person actively engaged in buying,
151-selling or exchanging motor vehicles or trailers who has an established
152-place of business in this state and who may, incidental to such
153-business, repair motor vehicles or trailers, or cause them to be repaired
154-by persons in his or her employ;
155-(27) "Disqualification" means a withdrawal of the privilege to drive
156-a commercial motor vehicle, which occurs as a result of (A) any Substitute House Bill No. 7141

113+(18) "Commercial driver's license information system" or "CDLIS" 78

132+a material listed as a select agent or toxin in 42 CFR Part 73; 97
133+(20) "Commercial registration" means the type of registration 98
134+required for any motor vehicle designed or used to transport 99
135+merchandise, freight or persons in connection with any business 100
136+enterprise, unless a more specific type of registration is authorized and 101
137+issued by the commissioner for such class of vehicle; 102
138+(21) "Commercial trailer" means a trailer used in the conduct of a 103
139+business to transport freight, materials or equipment whether or not 104
140+permanently affixed to the bed of the trailer; 105
141+(22) "Commercial trailer registration" means the type of registration 106
142+issued to any commercial trailer; 107
143+(23) "Commissioner" includes the Commissioner of Motor Vehicles 108 Substitute Bill No. 7141

160-suspension, revocation, or cancellation by the commissioner of the
161-privilege to operate a motor vehicle; (B) a determination by the Federal
162-Highway Administration, under the rules of practice for motor carrier
163-safety contained in 49 CFR 386, as amended, that a person is no longer
164-qualified to operate a commercial motor vehicle under the standards of
165-49 CFR 391, as amended; or (C) the loss of qualification which follows
166-any of the convictions or administrative actions specified in section 14-
167-44k;
168-(28) "Drive" means to drive, operate or be in physical control of a
169-motor vehicle, including a motor vehicle being towed by another;
170-(29) "Driver" means any person who drives, operates or is in
171-physical control of a commercial motor vehicle, or who is required to
172-hold a commercial driver's license;
173-(30) "Driver's license" or "operator's license" means a valid
174-Connecticut motor vehicle operator's license or a license issued by
175-another state or foreign jurisdiction authorizing the holder thereof to
176-operate a motor vehicle on the highways;
177-(31) "Electric bicycle" means a bicycle equipped with operable foot
178-pedals and an electric motor of fewer than seven hundred fifty watts of
179-power that is either a class 1, class 2 or class 3 bicycle. "Electric bicycle"
180-does not include a dirt bike or an all-terrain vehicle;
181-(32) "Electric foot scooter" means a device (A) that weighs not more
182-than seventy-five pounds, (B) that has two or three wheels, handlebars
183-and a floorboard that can be stood upon while riding, (C) that is
184-powered by an electric motor and human power, and (D) whose
185-maximum speed, with or without human propulsion on a paved level
186-surface, is not more than twenty miles per hour;
187-[(32)] (33) "Employee" means any operator of a commercial motor
188-vehicle, including full-time, regularly employed drivers, casual, Substitute House Bill No. 7141

192-intermittent or occasional drivers, drivers under contract and
193-independent owner-operator contractors, who, while in the course of
194-operating a commercial motor vehicle, are either directly employed by,
195-or are under contract to, an employer;
196-[(33)] (34) "Employer" means any person, including the United
197-States, a state or any political subdivision thereof, who owns or leases
198-a commercial motor vehicle, or assigns a person to drive a commercial
199-motor vehicle;
200-[(34)] (35) "Farm implement" means a vehicle designed and adapted
201-exclusively for agricultural, horticultural or livestock-raising
202-operations and which is not operated on a highway for transporting a
203-pay load or for any other commercial purpose;
204-[(35)] (36) "Felony" means any offense, as defined in section 53a-25
205-and includes any offense designated as a felony under federal law;
206-[(36)] (37) "Fatality" means the death of a person as a result of a
207-motor vehicle accident;
208-[(37)] (38) "Foreign jurisdiction" means any jurisdiction other than a
209-state of the United States;
210-[(38)] (39) "Fuels" means (A) all products commonly or
211-commercially known or sold as gasoline, including casinghead and
212-absorption or natural gasoline, regardless of their classification or uses,
213-(B) any liquid prepared, advertised, offered for sale or sold for use, or
214-commonly and commercially used, as a fuel in internal combustion
215-engines, which, when subjected to distillation in accordance with the
216-standard method of test for distillation of gasoline, naphtha, kerosene
217-and similar petroleum products by "American Society for Testing
218-Materials Method D-86", shows not less than ten per cent distilled
219-(recovered) below 347° Fahrenheit (175° Centigrade) and not less than
220-ninety-five per cent distilled (recovered) below 464° Fahrenheit (240° Substitute House Bill No. 7141
150+and any assistant to the Commissioner of Motor Vehicles who is 109
151+designated and authorized by, and who is acting for, the 110
152+Commissioner of Motor Vehicles under a designation; except that the 111
153+deputy commissioners of motor vehicles and the Attorney General are 112
154+deemed, unless the Commissioner of Motor Vehicles otherwise 113
155+provides, to be designated and authorized by, and acting for, the 114
156+Commissioner of Motor Vehicles under a designation; 115
157+(24) "Controlled substance" has the same meaning as provided in 116
158+section 21a-240 and the federal laws and regulations incorporated in 117
159+chapter 420b; 118

178+qualified to operate a commercial motor vehicle under the standards of 137
179+49 CFR 391, as amended; or (C) the loss of qualification which follows 138
180+any of the convictions or administrative actions specified in section 14-139

224-Centigrade); provided the term "fuels" [shall] does not include
225-commercial solvents or naphthas which distill, by "American Society
226-for Testing Materials Method D-86", not more than nine per cent at
227-176° Fahrenheit and which have a distillation range of 150° Fahrenheit,
228-or less, or liquefied gases which would not exist as liquids at a
229-temperature of 60° Fahrenheit and a pressure of 14.7 pounds per
230-square inch absolute, and (C) any liquid commonly referred to as
231-"gasohol" which is prepared, advertised, offered for sale or sold for
232-use, or commonly and commercially used, as a fuel in internal
233-combustion engines, consisting of a blend of gasoline and a minimum
234-of ten per cent by volume of ethyl or methyl alcohol;
235-[(39)] (40) "Garage" includes every place of business where motor
236-vehicles are, for compensation, received for housing, storage or repair;
237-[(40)] (41) "Gross vehicle weight rating" or "GVWR" means the value
238-specified by the manufacturer as the maximum loaded weight of a
239-single or a combination (articulated) vehicle. The GVWR of a
240-combination (articulated) vehicle commonly referred to as the "gross
241-combination weight rating" or GCWR is the GVWR of the power unit
242-plus the GVWR of the towed unit or units;
243-[(41)] (42) "Gross weight" means the light weight of a vehicle plus
244-the weight of any load on the vehicle, provided, in the case of a tractor-
245-trailer unit, "gross weight" means the light weight of the tractor plus
246-the light weight of the trailer or semitrailer plus the weight of the load
247-on the vehicle;
248-[(42)] (43) "Hazardous materials" has the same meaning as provided
249-in 49 CFR 383.5;
250-[(43)] (44) "Head lamp" means a lighting device affixed to the front
251-of a motor vehicle projecting a high intensity beam which lights the
252-road in front of the vehicle so that it can proceed safely during the Substitute House Bill No. 7141

188+(28) "Drive" means to drive, operate or be in physical control of a 141

211+operating a commercial motor vehicle, are either directly employed by, 164
212+or are under contract to, an employer; 165
213+[(33)] (34) "Employer" means any person, including the United 166

293-[(52)] (53) "Manufacturer" means (A) a person, whether a resident or
294-nonresident, engaged in the business of constructing or assembling
295-new motor vehicles of a type required to be registered by the
296-commissioner, for operation upon any highway, except a utility trailer,
297-which are offered for sale in this state, or (B) a person who distributes
298-new motor vehicles to new car dealers licensed in this state;
299-[(53)] (54) "Median divider" means an intervening space or physical
300-barrier or clearly indicated dividing section separating traffic lanes
301-provided for vehicles proceeding in opposite directions;
302-[(54)] (55) "Modified antique motor vehicle" means a motor vehicle
303-twenty years old or older which has been modified for safe road use,
304-including, but not limited to, modifications to the drive train,
305-suspension, braking system and safety or comfort apparatus;
306-[(55)] (56) "Motor bus" includes any motor vehicle, except a taxicab,
307-as defined in section 13b-95, operated in whole or in part on any street
308-or highway in a manner affording a means of transportation by
309-indiscriminately receiving or discharging passengers, or running on a
310-regular route or over any portion of a regular route or between fixed
311-termini;
312-[(56)] (57) "Motor home" means a vehicular unit designed to provide
313-living quarters and necessary amenities which are built into an integral

334-which they were designed and operated at speeds not exceeding four
335-miles per hour, whether or not the operator rides on or walks behind
336-such equipment, motor-driven cycles, as defined in section 14-286, as
337-amended by this act, special mobile equipment, as defined in section
338-14-165, mini-motorcycles, as defined in section 14-289j, electric
339-bicycles, electric foot scooters and any other vehicle not suitable for
340-operation on a highway;
341-[(59)] (60) "Motorcycle" means (A) an autocycle, as defined in this
342-section, or (B) a motor vehicle, with or without a side car, that has (i)
343-not more than three wheels in contact with the ground, (ii) a saddle or
344-seat which the rider straddles or a platform on which the rider stands,
345-and (iii) handlebars with which the rider controls the movement of the
346-vehicle. "Motorcycle" does not include a motor-driven cycle, [or] an
347-electric bicycle or an electric foot scooter;

360-[(63)] (64) "Nonresident commercial driver's license" or "nonresident
361-CDL" means a commercial driver's license issued by a state to an
362-individual who resides in a foreign jurisdiction;
363-[(64)] (65) "Nonskid device" means any device applied to the tires,
364-wheels, axles or frame of a motor vehicle for the purpose of increasing
365-the traction of the motor vehicle;
366-[(65)] (66) "Number plate" means any sign or marker furnished by
367-the commissioner on which is displayed the registration number
368-assigned to a motor vehicle by the commissioner;
369-[(66)] (67) "Officer" includes any constable, state marshal, inspector
370-of motor vehicles, state policeman or other official authorized to make
371-arrests or to serve process, provided the officer is in uniform or
372-displays the officer's badge of office in a conspicuous place when
373-making an arrest;
374-[(67)] (68) "Operator" means any person who operates a motor
375-vehicle or who steers or directs the course of a motor vehicle being
376-towed by another motor vehicle and includes a driver; [as defined in
377-subdivision (26) of this section;]

387-section 14-163c from being operated on any highway, or to prohibit a
388-driver from operating any such motor vehicle, or (B) issued by the
389-United States Department of Transportation Federal Motor Carrier

391-prohibit any motor carrier, as defined in Section 386.2 of Title 49 of the

394-[(69)] (70) "Owner" means any person holding title to a motor
395-vehicle, or having the legal right to register the same, including
396-purchasers under conditional bills of sale;
397-[(70)] (71) "Parked vehicle" means a motor vehicle in a stationary
398-position within the limits of a public highway;
399-[(71)] (72) "Passenger and commercial motor vehicle" means a motor
400-vehicle used for private passenger and commercial purposes which is
401-eligible for combination registration;
402-[(72)] (73) "Passenger motor vehicle" means a motor vehicle used for
403-the private transportation of persons and their personal belongings,
404-designed to carry occupants in comfort and safety, with a capacity of
405-carrying not more than ten passengers including the operator thereof;
406-[(73)] (74) "Passenger registration" means the type of registration
407-issued to a passenger motor vehicle unless a more specific type of
408-registration is authorized and issued by the commissioner for such
409-class of vehicle;

425-or structural members, which loads are capable of sustaining
426-themselves as beams between supporting connections, and (B)
427-designed to be drawn by a motor vehicle and attached or secured
428-directly to the motor vehicle by any means including a reach, pole or
429-boom;
430-[(78)] (79) "Public passenger endorsement" means an endorsement
431-issued to an individual, which authorizes such individual to transport
432-passengers, including, but not limited to, passengers who are students
433-in accordance with subsection (b) or (c) of section 14-36a;
434-[(79)] (80) "Recreational vehicle" includes the camper, camp trailer
435-and motor home classes of vehicles;
436-[(80)] (81) "Registration" includes the certificate of motor vehicle
437-registration and the number plate or plates used in connection with
438-such registration;
439-[(81)] (82) "Registration number" means the identifying number or

456-[(84)] (85) "Second" violation or "subsequent" violation means an
457-offense committed not more than three years after the date of an arrest
458-which resulted in a previous conviction for a violation of the same
459-statutory provision, except in the case of a violation of section 14-215,
460-14-224, 14-227a or 14-227m, "second" violation or "subsequent"
461-violation means an offense committed not more than ten years after
462-the date of an arrest which resulted in a previous conviction for a
463-violation of the same statutory provision;
464-[(85)] (86) "Semitrailer" means any trailer type vehicle designed and
465-used in conjunction with a motor vehicle so that some part of its own
466-weight and load rests on or is carried by another vehicle;
467-[(86)] (87) "Serious traffic violation" means a conviction of any of the
468-following offenses: (A) Excessive speeding, involving a single offense
469-in which the speed is fifteen miles per hour or more above the posted
470-speed limit, in violation of section 14-218a or 14-219; (B) reckless
471-driving in violation of section 14-222; (C) following too closely in
472-violation of section 14-240 or 14-240a; (D) improper or erratic lane
473-changes, in violation of section 14-236; (E) using a hand-held mobile Substitute House Bill No. 7141

486-an operator who holds a commercial driver's license or instruction
487-permit that results in the death of another person;
488-[(87)] (88) "Service bus" includes any vehicle except a vanpool
489-vehicle or a school bus designed and regularly used to carry ten or
490-more passengers when used in private service for the transportation of
491-persons without charge to the individual;
492-[(88)] (89) "Service car" means any motor vehicle used by a
493-manufacturer, dealer or repairer for emergency motor vehicle repairs
494-on the highways of this state, for towing or for the transportation of
495-necessary persons, tools and materials to and from the scene of such
496-emergency repairs or towing;
497-[(89)] (90) "Shoulder" means that portion of a highway immediately
498-adjacent and contiguous to the travel lanes or main traveled portion of
499-the roadway;
500-[(90)] (91) "Solid tires" means tires of rubber, or other elastic material
501-approved by the Commissioner of Transportation, which do not
502-depend on confined air for the support of the load;
503-[(91)] (92) "Spot lamp" or "spot light" means a lighting device
504-projecting a high intensity beam, the direction of which can be readily
505-controlled for special or emergency lighting as distinguished from Substitute House Bill No. 7141

515-years who is attending a preprimary, primary or secondary school
516-program of education;
517-[(95)] (96) "Tail lamp" means a lighting device affixed to the rear of a
518-motor vehicle showing a red light to the rear and indicating the
519-presence of the motor vehicle when viewed from behind;
520-[(96)] (97) "Tank vehicle" means any commercial motor vehicle
521-designed to transport any liquid or gaseous material within a tank that
522-is either permanently or temporarily attached to the vehicle or its
523-chassis, which [shall include] includes, but is not [be] limited to, a
524-cargo tank and portable tank, as defined in 49 CFR 383.5, as amended,
525-provided it [shall] does not include a portable tank with a rated
526-capacity not to exceed one thousand gallons;
527-[(97)] (98) "Tractor" or "truck tractor" means a motor vehicle
528-designed and used for drawing a semitrailer;
529-[(98)] (99) "Tractor-trailer unit" means a combination of a tractor and
530-a trailer or a combination of a tractor and a semitrailer;
531-[(99)] (100) "Trailer" means any rubber-tired vehicle without motive
532-power drawn or propelled by a motor vehicle;
533-[(100)] (101) "Truck" means a motor vehicle designed, used or

550-nonprofit basis, of individuals between home and work, and which:
551-(A) If owned by or leased to a person, or to an employee of the person,
552-or to an employee of a local, state or federal government unit or agency
553-located in Connecticut, are manufactured and equipped in such
554-manner as to provide a seating capacity of at least seven but not more
555-than fifteen individuals, or (B) if owned by or leased to a regional ride-
556-sharing organization in the state recognized by the Commissioner of
557-Transportation, are manufactured and equipped in such manner as to
558-provide a seating capacity of at least six but not more than nineteen
559-individuals;
560-[(106)] (107) "Vehicle" includes any device suitable for the
561-conveyance, drawing or other transportation of persons or property,
562-whether operated on wheels, runners, a cushion of air or by any other
563-means. The term does not include devices propelled or drawn by
564-human power or devices used exclusively on tracks;
565-[(107)] (108) "Vehicle identification number" or "VIN" means a series
566-of Arabic numbers and Roman letters that is assigned to each new Substitute House Bill No. 7141

571-States, in accordance with the provisions of 49 CFR 565, unless another
572-sequence of numbers and letters has been assigned to a motor vehicle
573-by the commissioner, in accordance with the provisions of section 14-
574-149;
575-[(108)] (109) "Wrecker" means a vehicle which is registered,
576-designed, equipped and used for the purposes of towing or
577-transporting wrecked or disabled motor vehicles for compensation or
578-for related purposes by a person, firm or corporation licensed in
579-accordance with the provisions of subpart (D) of part III of this chapter
580-or a vehicle contracted for the consensual towing or transporting of
581-one or more motor vehicles to or from a place of sale, purchase,
582-salvage or repair.
583-Sec. 2. Subsection (c) of section 14-164c of the general statutes is
584-repealed and the following is substituted in lieu thereof (Effective
585-October 1, 2019):
586-(c) The commissioner shall adopt regulations, in accordance with
587-chapter 54, to implement the provisions of this section. Such
588-regulations shall include provision for a periodic inspection of air
589-pollution control equipment and compliance with or waiver of exhaust
590-emission standards or compliance with or waiver of on -board
591-diagnostic standards or other standards defined by the Commissioner
592-of Energy and Environmental Protection and approved by the
593-Administrator of the United States Environmental Protection Agency,
594-compliance with or waiver of, air pollution control system integrity
595-standards defined by the Commissioner of Energy and Environmental
596-Protection and compliance with or waiver of purge system standards
597-defined by the Commissioner of Energy and Environmental
598-Protection. Such regulations may provide for an inspection procedure
599-using an on-board diagnostic information system for all 1996 model
600-year and newer motor vehicles. Such regulations shall apply to all Substitute House Bill No. 7141
443+[(72)] (73) "Passenger motor vehicle" means a motor vehicle used for 354
444+the private transportation of persons and their personal belongings, 355
445+designed to carry occupants in comfort and safety, with a capacity of 356
446+carrying not more than ten passengers including the operator thereof; 357
447+[(73)] (74) "Passenger registration" means the type of registration 358
448+issued to a passenger motor vehicle unless a more specific type of 359
449+registration is authorized and issued by the commissioner for such 360
450+class of vehicle; 361
451+[(74)] (75) "Person" includes any individual, corporation, limited 362
452+liability company, association, copartnership, company, firm, business 363
453+trust or other aggregation of individuals but does not include the state 364
454+or any political subdivision thereof, unless the context clearly states or 365

456+[(75)] (76) "Pick-up truck" means a motor vehicle with an enclosed 367
457+forward passenger compartment and an open rearward compartment 368
458+used for the transportation of property; 369
459+[(76)] (77) "Pneumatic tires" means tires inflated or inflatable with 370

461+[(77)] (78) "Pole trailer" means a trailer which is (A) intended for 372
462+transporting long or irregularly shaped loads such as poles, logs, pipes 373
463+or structural members, which loads are capable of sustaining 374
464+themselves as beams between supporting connections, and (B) 375
465+designed to be drawn by a motor vehicle and attached or secured 376
466+directly to the motor vehicle by any means including a reach, pole or 377

468+[(78)] (79) "Public passenger endorsement" means an endorsement 379
469+issued to an individual, which authorizes such individual to transport 380
470+passengers, including, but not limited to, passengers who are students 381
471+in accordance with subsection (b) or (c) of section 14-36a; 382

605-except: (1) Vehicles having a gross weight of more than ten thousand
606-pounds; (2) vehicles powered by electricity; (3) bicycles with motors
607-attached; (4) motorcycles; (5) vehicles operating with a temporary
608-registration; (6) vehicles manufactured twenty-five or more years ago;
609-(7) new vehicles at the time of initial registration; (8) vehicles
610-registered but not designed primarily for highway use; (9) farm
611-vehicles, as defined in subsection (q) of section 14-49; (10) diesel-
612-powered type II school buses; (11) a vehicle operated by a licensed
613-dealer or repairer either to or from a location of the purchase or sale of
614-such vehicle or for the purpose of obtaining an official emissions or
615-safety inspection; (12) vehicles that have met the inspection
616-requirements of section 14-103a and are registered by t he
617-commissioner as composite vehicles; [or] (13) electric bicycles, as
618-defined in section 14-1, as amended by this act; or (14) electric foot
619-scooters, as defined in section 14-1, as amended by this act. On and
620-after July 1, 2002, such regulations shall exempt from the periodic
621-inspection requirement any vehicle four or less model years of age,
622-beginning with model year 2003 and the previous three model years,
623-provided that such exemption shall lapse upon a finding by the
624-Administrator of the United States Environmental Protection Agency
625-or by the Secretary of the United States Department of Transportation
626-that such exemption causes the state to violate applicable federal
627-environmental or transportation planning requirements.
628-Notwithstanding any provisions of this subsection, the commissioner
629-may require an initial emissions inspection and compliance or waiver
630-prior to registration of a new motor vehicle. If the Commissioner of
631-Energy and Environmental Protection finds that it is necessary to
632-inspect motor vehicles which are exempt under subdivision (1) or (4)
633-of this subsection, or motor vehicles that are four or less model years of
634-age in order to achieve compliance with federal law concerning
635-emission reduction requirements, the Commissioner of Motor Vehicles
636-may adopt regulations, in accordance with the provisions of chapter Substitute House Bill No. 7141

495+to school, from school to home, or to and from school-sponsored 400
496+events, but does not include a bus used as a common carrier; 401
497+[(84)] (85) "Second" violation or "subsequent" violation means an 402
498+offense committed not more than three years after the date of an arrest 403
499+which resulted in a previous conviction for a violation of the same 404
500+statutory provision, except in the case of a violation of section 14-215, 405
501+14-224, 14-227a or 14-227m, "second" violation or "subsequent" 406
502+violation means an offense committed not more than ten years after 407
503+the date of an arrest which resulted in a previous conviction for a 408
504+violation of the same statutory provision; 409
505+[(85)] (86) "Semitrailer" means any trailer type vehicle designed and 410
506+used in conjunction with a motor vehicle so that some part of its own 411
507+weight and load rests on or is carried by another vehicle; 412

656-"registration number", "second offense", "semitrailer", "shoulder",
657-"solid tires", "stop", "subsequent offense", "tail lamp", "tractor", "tractor-
658-trailer unit", "trailer", "truck" and "vanpool vehicle";
659-Sec. 4. Section 14-212c of the general statutes is repealed and the
660-following is substituted in lieu thereof (Effective October 1, 2019):
661-A surcharge shall be imposed equivalent to one hundred per cent of
662-the fine established or imposed for a violation of subsection (e) of
663-section 14-242, section 14-245, 14-246a, 14-247 or 14-247a for such
664-violation when the driver of a vehicle fails to grant or yield the right-
665-of-way to a person riding a bicycle, as defined in section 14-286, as
666-amended by this act, [or a person riding] an electric bicycle or an
667-electric foot scooter.

674-(a) Upon all highways, each vehicle, other than a vehicle described
675-in subsection (c) of this section, shall be driven upon the right, except
676-(1) when overtaking and passing another vehicle proceeding in the
677-same direction, (2) when overtaking and passing pedestrians, parked
678-or standing vehicles, animals, bicycles, electric bicycles, mopeds,
679-scooters, electric foot scooters, vehicles moving at a slow speed, as
680-defined in section 14-220, or obstructions on the right side of the
681-highway, (3) when the right side of a highway is closed to traffic while
682-under construction or repair, (4) on a highway divided into three or
683-more marked lanes for traffic, or (5) on a highway designated and
684-signposted for one-way traffic.
685-Sec. 6. Subsection (a) of section 14-232 of the general statutes is
686-repealed and the following is substituted in lieu thereof (Effective
687-October 1, 2019):
688-(a) Except as provided in sections 14-233 and 14-234, as amended by
689-this act, (1) the driver of a vehicle overtaking another vehicle
690-proceeding in the same direction shall pass to the left thereof at a safe
691-distance and shall not again drive to the right side of the highway until
692-safely clear of the overtaken vehicle; and (2) the driver of an overtaken
693-vehicle shall give way to the right in favor of the overtaking vehicle
694-and shall not increase the speed of his or her vehicle until completely
695-passed by the overtaking vehicle. For the purposes of this subsection,
696-"safe distance" means not less than three feet when the driver of a
697-vehicle overtakes and passes a person riding a bicycle, [or] an electric
698-bicycle or an electric foot scooter.
699-Sec. 7. Subsection (b) of section 14-234 of the general statutes is
700-repealed and the following is substituted in lieu thereof (Effective

515+following offenses: (A) Excessive speeding, involving a single offense 414
516+in which the speed is fifteen miles per hour or more above the posted 415

530+an operator who holds a commercial driver's license or instruction 429

532+[(87)] (88) "Service bus" includes any vehicle except a vanpool 431
533+vehicle or a school bus designed and regularly used to carry ten or 432
534+more passengers when used in private service for the transportation of 433
535+persons without charge to the individual; 434
536+[(88)] (89) "Service car" means any motor vehicle used by a 435
537+manufacturer, dealer or repairer for emergency motor vehicle repairs 436
538+on the highways of this state, for towing or for the transportation of 437
539+necessary persons, tools and materials to and from the scene of such 438
540+emergency repairs or towing; 439
541+[(89)] (90) "Shoulder" means that portion of a highway immediately 440
542+adjacent and contiguous to the travel lanes or main traveled portion of 441
543+the roadway; 442
544+[(90)] (91) "Solid tires" means tires of rubber, or other elastic material 443
545+approved by the Commissioner of Transportation, which do not 444

706-passing zone, pedestrians, parked or standing vehicles, animals,

709-obstructions on the right side of the highway, as listed in subdivision
710-(2) of subsection (a) of section 14-230, as amended by this act, provided
711-such overtaking and passing may be conducted safely, with adequate
712-sight distance and without interfering with oncoming traffic or
713-endangering traffic, as defined in section 14-297, as amended by this
714-act.
715-Sec. 8. Subsection (f) of section 14-242 of the general statutes is
716-repealed and the following is substituted in lieu thereof (Effective
717-October 1, 2019):
718-(f) No person operating a vehicle who overtakes and passes a
719-person riding a bicycle, [or] an electric bicycle or an electric foot
720-scooter and proceeding in the same direction shall make a right turn at
721-any intersection or into any private road or driveway unless the turn
722-can be made with reasonable safety and will not impede the travel of
723-the person riding the bicycle, [or] electric bicycle or electric foot
724-scooter.
725-Sec. 9. Section 14-286 of the general statutes is repealed and the
726-following is substituted in lieu thereof (Effective October 1, 2019):
727-(a) Each person operating a bicycle, an electric bicycle or an electric
728-foot scooter upon and along a sidewalk or across any roadway upon
729-and along a crosswalk shall yield the right-of-way to any pedestrian
730-and shall give an audible signal within a reasonable distance before
731-overtaking and passing a pedestrian. Each person operating a bicycle,
732-an electric bicycle, an electric foot scooter or a motor-driven cycle upon
733-a roadway shall, within a reasonable distance, give an audible signal

740-electric bicycle or an electric foot scooter upon or along a sidewalk or
741-across a roadway upon and along a crosswalk if such operation is
742-prohibited by any ordinance of any city, town or borough or by any
743-regulation of the Office of the State Traffic Administration issued or
744-adopted pursuant to the provisions of section 14-298, as amended by
745-this act.
746-(b) [No] Except as provided in subsection (c) of this section, no
747-person shall ride a motor-driven cycle unless that person holds a valid
748-motor vehicle operator's license. No person shall operate a motor-
749-driven cycle on any sidewalk, limited access highway or turnpike.
750-(c) (1) [Notwithstanding the provisions of subsection (b) of this
751-section, the] The Commissioner of Motor Vehicles may issue to a
752-person who does not hold a valid operator's license a special permit
753-that authorizes such person to ride a motor-driven cycle if (A) such
754-person presents to the commissioner a certificate by a physician
755-licensed to practice medicine in this state or an advanced practice
756-registered nurse licensed pursuant to chapter 378 that such person is
757-physically disabled, as defined in section 1-1f, other than blind, and
758-that, in the physician's or advanced practice registered nurse's opinion,
759-such person is capable of riding a motor-driven cycle, and (B) such
760-person demonstrates to the Commissioner of Motor Vehicles that he is
761-able to ride a bicycle on level terrain, and a motor-driven cycle. (2)
762-Such permit may contain limitations that the commissioner deems
763-advisable for the safety of such person and for the public safety,
764-including, but not limited to, the maximum speed of the motor such
765-person may use. No person who holds a valid special permit under
766-this subsection shall operate a motor-driven cycle in violation of any
767-limitations imposed in the permit. Any person to whom a special
768-permit is issued shall carry the permit at all times while operating the Substitute House Bill No. 7141

775-the contrary] any provision of the general statutes, the Office of the
776-State Traffic Administration shall adopt regulations in accordance with
777-the provisions of chapter 54 determining the conditions and
778-circumstances under which [bicycle traffic] the operation of bicycles,
779-electric bicycles and electric foot scooters may be permitted on those
780-bridges in the state on limited access highways which it designates to
781-be safe for [bicycle traffic. Bicycle traffic] such operation. The operation
782-of bicycles, electric bicycles and electric foot scooters shall not be
783-prohibited on any such bridges under such conditions and
784-circumstances.
785-(e) As used in this section: (1) "Sidewalk" means any sidewalk laid
786-out as such by any town, city or borough, and any walk which is
787-reserved by custom for the use of pedestrians, or which has been
788-specially prepared for their use. "Sidewalk" does not include
789-crosswalks and does not include footpaths on portions of public
790-highways outside thickly settled parts of towns, cities and boroughs,
791-which are worn only by travel and are not improved by such towns,
792-cities or boroughs or by abutters; (2) "bicycle" includes all vehicles
793-propelled by the person riding the same by foot or hand power; and
794-(3) "motor-driven cycle" means any motorcycle other than an
795-autocycle, motor scooter or bicycle with an attached motor with a seat
796-height of not less than twenty-six inches and a motor having a capacity
797-of less than fifty cubic centimeters piston displacement.
798-(f) A person shall operate a motor-driven cycle on any public
799-highway, the speed limit of which is greater than the maximum speed
800-of the motor-driven cycle, only in the right hand lane available for
801-traffic or upon a usable shoulder on the right side of the highway,
802-except when preparing to make a left turn at an intersection or into or Substitute House Bill No. 7141
587+maintained primarily for the transportation of property; 474
588+[(101)] (102) "Ultimate consumer" means, with respect to a motor 475
589+vehicle, the first person, other than a dealer, who in good faith 476
590+purchases the motor vehicle for purposes other than resale; 477
591+[(102)] (103) "United States" means the fifty states and the District of 478
592+Columbia; 479
593+[(103)] (104) "Used motor vehicle" includes any motor vehicle which 480
594+has been previously separately registered by an ultimate consumer; 481
595+[(104)] (105) "Utility trailer" means a trailer designed and used to 482
596+transport personal property, materials or equipment, whether or not 483
597+permanently affixed to the bed of the trailer; 484
598+[(105)] (106) "Vanpool vehicle" includes all motor vehicles, the 485
599+primary purpose of which is the daily transportation, on a prearranged 486
600+nonprofit basis, of individuals between home and work, and which: 487
601+(A) If owned by or leased to a person, or to an employee of the person, 488
602+or to an employee of a local, state or federal government unit or agency 489
603+located in Connecticut, are manufactured and equipped in such 490
604+manner as to provide a seating capacity of at least seven but not more 491
605+than fifteen individuals, or (B) if owned by or leased to a regional ride-492
606+sharing organization in the state recognized by the Commissioner of 493
607+Transportation, are manufactured and equipped in such manner as to 494
608+provide a seating capacity of at least six but not more than nineteen 495
609+individuals; 496
610+[(106)] (107) "Vehicle" includes any device suitable for the 497
611+conveyance, drawing or other transportation of persons or property, 498
612+whether operated on wheels, runners, a cushion of air or by any other 499
613+means. The term does not include devices propelled or drawn by 500
614+human power or devices used exclusively on tracks; 501
615+[(107)] (108) "Vehicle identification number" or "VIN" means a series 502
616+of Arabic numbers and Roman letters that is assigned to each new 503 Substitute Bill No. 7141

807-(g) Any person who pleads not guilty of a violation of any provision
808-of this section shall be prosecuted within fifteen days of such plea.
809-(h) No person may operate a high-mileage vehicle [as defined in
810-section 14-1] on any sidewalk, limited access highway or turnpike.
811-(i) A person may park an electric foot scooter on any sidewalk
812-provided (1) such electric foot scooter is parked in a manner that does
813-not impede the reasonable movement of pedestrians and other traffic
814-on such sidewalk, and (2) such parking is not prohibited by any
815-ordinance of any city, town or borough or by any regulations of the
816-Office of the State Traffic Administration issued or adopted pursuant
817-to the provisions of section 14-298, as amended by this act.
818-[(i)] (j) Violation of any provision of this section shall be an
819-infraction.
820-Sec. 10. Subsection (a) of section 14-286a of the general statutes is
821-repealed and the following is substituted in lieu thereof (Effective
822-October 1, 2019):
823-(a) Every person riding a bicycle, as defined in section 14-286, as
824-amended by this act, [or] an electric bicycle or an electric foot scooter
825-upon the traveled portion of a highway shall be granted all of the
826-rights and shall be subject to all of the duties applicable to the driver of
827-any vehicle subject to the requirements of the general statutes relating
828-to motor vehicles, except (1) as to those provisions which by their
829-nature can have no application, [and except that] (2) each town, city or
830-borough and the Office of the State Traffic Administration within its
831-jurisdiction as provided in section 14-298, as amended by this act, shall
832-have authority to regulate bicycles, [and] electric bicycles and electric
833-foot scooters as provided in [section] sections 14-289, as amended by
834-this act, and [said section] 14-298, as amended by this act, and [except] Substitute House Bill No. 7141

628+[(108)] (109) "Wrecker" means a vehicle which is registered, 509
629+designed, equipped and used for the purposes of towing or 510
630+transporting wrecked or disabled motor vehicles for compensation or 511
631+for related purposes by a person, firm or corporation licensed in 512
632+accordance with the provisions of subpart (D) of part III of this chapter 513
633+or a vehicle contracted for the consensual towing or transporting of 514
634+one or more motor vehicles to or from a place of sale, purchase, 515
635+salvage or repair. 516
636+Sec. 2. Subsection (c) of section 14-164c of the general statutes is 517
637+repealed and the following is substituted in lieu thereof (Effective 518
638+October 1, 2019): 519
639+(c) The commissioner shall adopt regulations, in accordance with 520
640+chapter 54, to implement the provisions of this section. Such 521
641+regulations shall include provision for a periodic inspection of air 522
642+pollution control equipment and compliance with or waiver of exhaust 523
643+emission standards or compliance with or waiver of on -board 524
644+diagnostic standards or other standards defined by the Commissioner 525
645+of Energy and Environmental Protection and approved by the 526
646+Administrator of the United States Environmental Protection Agency, 527
647+compliance with or waiver of, air pollution control system integrity 528
648+standards defined by the Commissioner of Energy and Environmental 529
649+Protection and compliance with or waiver of purge system standards 530
650+defined by the Commissioner of Energy and Environmental 531
651+Protection. Such regulations may provide for an inspection procedure 532
652+using an on-board diagnostic information system for all 1996 model 533
653+year and newer motor vehicles. Such regulations shall apply to all 534
654+motor vehicles registered or which will be registered in this state 535
655+except: (1) Vehicles having a gross weight of more than ten thousand 536 Substitute Bill No. 7141

838-(3) as provided by section 14-286c, as amended by this act. No parent
839-of any child and no guardian of any ward shall authorize or knowingly
840-permit any such child or ward to violate any provision of the general
841-statutes or ordinances enacted under section 14-289, as amended by
842-this act, relating to bicycles, [or] electric bicycles or electric foot
843-scooters.
844-Sec. 11. Section 14-286b of the general statutes is repealed and the
845-following is substituted in lieu thereof (Effective October 1, 2019):
846-(a) Any person operating a bicycle, [or] an electric bicycle or an
847-electric foot scooter upon a roadway at less than the normal speed of
848-traffic shall ride as close to the right side of the roadway as is safe, as
849-judged by [the bicyclist] such person, except when:
850-(1) Overtaking or passing another vehicle proceeding in the same
851-direction;
852-(2) Preparing for a left turn at an intersection or into a private road
853-or driveway;
854-(3) Reasonably necessary to avoid conditions, including, but not
855-limited to, fixed or moving objects, parked or moving vehicles,
856-bicycles, pedestrians, animals, surface hazards or lanes that are too
857-narrow for a bicycle, [or] an electric bicycle or an electric foot scooter
858-and a motor vehicle to travel safely side by side within such lanes;
859-(4) Approaching an intersection where right turns are permitted and
860-there is a dedicated right turn lane, in which case a [bicyclist or electric
861-bicyclist] person operating a bicycle, an electric bicycle or an electric
862-foot scooter may ride on the left-hand side of such dedicated lane, even
863-if [the bicyclist or electric bicyclist] such person does not intend to turn
864-right;
865-(5) Riding on a roadway designated for one-way traffic, when the Substitute House Bill No. 7141

870-bicycle or an electric foot scooter may ride as near to the left-hand curb
871-or edge of such roadway as judged safe by [the bicyclist or electric
872-bicyclist] such person; or
873-(6) Riding on parts of roadways separated for the exclusive use of
874-bicycles, [or] electric bicycles or electric foot scooters, including, but
875-not limited to, contra-flow bicycle lanes, left-handed cycle tracks or
876-bicycle lanes on one-way streets and two-way cycle tracks or bicycle
877-lanes.
878-(b) Persons riding bicycles, [or] electric bicycles or electric foot
879-scooters upon a roadway shall not ride more than two abreast except
880-on paths or parts of roadways set aside for the exclusive use of
881-bicycles, [or] electric bicycles or electric foot scooters. Persons riding
882-two abreast, as provided in this subsection, shall not impede the
883-normal and reasonable movement of traffic, and, on a laned roadway,
884-shall ride within a single lane.
885-(c) No person riding upon any bicycle, electric bicycle, motor-driven
886-cycle, roller skates, skis, sled, skateboard, coaster, toy vehicle, electric
887-foot scooter or any other vehicle not designed or intended to be towed
888-shall attach the same or such person to any vehicle moving or about to
889-move on a public roadway nor shall the operator of such vehicle
890-knowingly permit any person riding a bicycle, electric bicycle, motor-
891-driven cycle, roller skates, skis, skateboard, coaster, sled, toy vehicle,
892-electric foot scooter or any other vehicle not designed or intended to be
893-towed to attach the same or such person to such vehicle so operated or
894-about to be operated, provided any person operating a bicycle solely
895-by foot or hand power may attach a bicycle trailer or semitrailer
896-thereto, provided such trailer or semitrailer is designed for such
897-attachment.
898-(d) No person operating a bicycle, as defined in section 14-286, as Substitute House Bill No. 7141
662+pounds; (2) vehicles powered by electricity; (3) bicycles with motors 537
663+attached; (4) motorcycles; (5) vehicles operating with a temporary 538
664+registration; (6) vehicles manufactured twenty-five or more years ago; 539
665+(7) new vehicles at the time of initial registration; (8) vehicles 540
666+registered but not designed primarily for highway use; (9) farm 541
667+vehicles, as defined in subsection (q) of section 14-49; (10) diesel-542
668+powered type II school buses; (11) a vehicle operated by a licensed 543
669+dealer or repairer either to or from a location of the purchase or sale of 544
670+such vehicle or for the purpose of obtaining an official emissions or 545
671+safety inspection; (12) vehicles that have met the inspection 546
672+requirements of section 14-103a and are registered by the 547
673+commissioner as composite vehicles; [or] (13) electric bicycles, as 548
674+defined in section 14-1, as amended by this act; or (14) electric foot 549
675+scooters, as defined in section 14-1, as amended by this act. On and 550
676+after July 1, 2002, such regulations shall exempt from the periodic 551
677+inspection requirement any vehicle four or less model years of age, 552
678+beginning with model year 2003 and the previous three model years, 553
679+provided that such exemption shall lapse upon a finding by the 554
680+Administrator of the United States Environmental Protection Agency 555
681+or by the Secretary of the United States Department of Transportation 556
682+that such exemption causes the state to violate applicable federal 557
683+environmental or transportation planning requirements. 558
684+Notwithstanding any provisions of this subsection, the commissioner 559
685+may require an initial emissions inspection and compliance or waiver 560
686+prior to registration of a new motor vehicle. If the Commissioner of 561
687+Energy and Environmental Protection finds that it is necessary to 562
688+inspect motor vehicles which are exempt under subdivision (1) or (4) 563
689+of this subsection, or motor vehicles that are four or less model years of 564
690+age in order to achieve compliance with federal law concerning 565
691+emission reduction requirements, the Commissioner of Motor Vehicles 566
692+may adopt regulations, in accordance with the provisions of chapter 567
693+54, to require the inspection of motorcycles, designated motor vehicles 568
694+having a gross weight of more than ten thousand pounds or motor 569

903-upon a roadway, path or part of roadway set aside for exclusive use of
904-bicycles, [or] electric bicycles or electric foot scooters shall carry on
905-such bicycle, [or] electric bicycle or electric foot scooter a passenger
906-unless such bicycle, [or] electric bicycle or electric foot scooter is
907-equipped or designed to carry passengers, provided any person who
908-has attained the age of eighteen years may carry any child while such
909-person is operating a bicycle propelled solely by foot or hand power,
910-provided such child is securely attached to his or her person by means
911-of a back pack, sling or other similar device. The term "child", as used
912-in this subsection, means any person who has not attained the age of
913-four years.
914-(e) No person operating a bicycle, as defined in section 14-286, as
915-amended by this act, [or] an electric bicycle or an electric foot scooter
916-shall carry any package, bundle or other article which prevents such
917-person from using both hands in the operation of such bicycle, [or]
918-electric bicycle or electric foot scooter. Each person operating such
919-bicycle, [or] electric bicycle or electric foot scooter shall keep at least
920-one hand on the handlebars thereof when such bicycle, [or] electric
921-bicycle or electric foot scooter is in motion.
922-(f) Violation of any provision of this section shall be an infraction.
923-Sec. 12. Section 14-286c of the general statutes is repealed and the
924-following is substituted in lieu thereof (Effective October 1, 2019):
925-(a) Each person riding a bicycle, [or] an electric bicycle [, as defined
926-in section 14-1] or an electric foot scooter, upon the traveled portion of
927-a highway and intending to make a left turn after proceeding pursuant
928-to the provisions of section 14-244 or subsection (b) of this section may,
929-in lieu of the procedure prescribed by section 14-241, approach as close
930-as practicable to the right-hand curb or edge of the highway, proceed
931-across the intersecting roadway and make such turn as close as Substitute House Bill No. 7141

940-in section 14-1,] or an electric foot scooter upon the traveled portion of
941-a highway and intending to make a right turn may, in lieu of the
942-procedure prescribed by section 14-244, before turning and while in
943-motion or if stopped while waiting to turn, signal such turn by
944-extending [his] such person's right hand and arm horizontally with
945-forefinger extended.
946-(c) No person operating a bicycle, [or] an electric bicycle [, as
947-defined in section 14-1,] or an electric foot scooter upon the traveled
948-portion of a highway and intending to make a right or left turn shall be
949-required when making a signal of such intention to make such signal
950-continuously.
951-Sec. 13. Section 14-286d of the general statutes is repealed and the
952-following is substituted in lieu thereof (Effective October 1, 2019):
953-(a) For the purposes of this section and section 14-286e, "bicycle"
954-means any vehicle propelled by the person riding the same by foot or
955-hand power.
956-(b) No child fifteen years of age or under shall operate a bicycle,
957-electric bicycle, nonmotorized scooter, [or] skateboard or electric foot
958-scooter or wear roller skates or in-line skates on the traveled portion of
959-any highway, at a skateboarding park or any park unless such child is
960-wearing properly fitted and fastened protective headgear which
961-conforms to the minimum specifications established by the American
962-National Standards Institute, the United States Consumer Product
963-Safety Commission, the American Society for Testing and Materials or Substitute House Bill No. 7141

968-Headgear for Use in Bicycling, as amended from time to time. Failure
969-to comply with this section shall not be a violation or an offense.
970-Failure to wear protective headgear as required by this subsection shall
971-not be considered to be contributory negligence on the part of the
972-parent or the child nor shall such failure be admissible in any civil
973-action.
974-(c) A law enforcement officer may issue a verbal warning to the
975-parent or guardian of a child that such child has failed to comply with
976-the provisions of subsection (b) of this section.
977-(d) A person, firm or corporation engaged in the business of renting
978-bicycles, electric bicycles or electric foot scooters shall provide
979-protective headgear conforming to the minimum specifications
980-established by the American National Standards Institute, the United
981-States Consumer Product Safety Commission, the American Society for
982-Testing and Materials or the Snell Memorial Foundation's Standard for
983-Protective Headgear for Use in Bicycling, as amended from time to
984-time, to any person under sixteen years of age who will operate the
985-bicycle, electric bicycle or electric foot scooter if such person does not
986-have protective headgear in his or her possession. A fee may be
987-charged for the protective headgear rental. Violation of any of the
988-provisions of this subsection shall be an infraction.
989-(e) The Commissioner of Consumer Protection shall post on the
990-Department of Consumer Protection's Internet web site information
991-concerning the dangers of riding bicycles, electric bicycles or electric
992-foot scooters, skateboarding, roller skating and in-line skating without
993-protective headgear and promoting the use of protective headgear
994-while riding bicycles, electric bicycles or electric foot scooters,
995-skateboarding, roller skating and in-line skating.
996-Sec. 14. Section 14-288 of the general statutes is repealed and the Substitute House Bill No. 7141
739+same direction, (2) when overtaking and passing pedestrians, parked 602
740+or standing vehicles, animals, bicycles, electric bicycles, mopeds, 603
741+scooters, electric foot scooters, vehicles moving at a slow speed, as 604

747+Sec. 6. Subsection (a) of section 14-232 of the general statutes is 610
748+repealed and the following is substituted in lieu thereof (Effective 611

750+(a) Except as provided in sections 14-233 and 14-234, as amended by 613
751+this act, (1) the driver of a vehicle overtaking another vehicle 614
752+proceeding in the same direction shall pass to the left thereof at a safe 615
753+distance and shall not again drive to the right side of the highway until 616
754+safely clear of the overtaken vehicle; and (2) the driver of an overtaken 617
755+vehicle shall give way to the right in favor of the overtaking vehicle 618
756+and shall not increase the speed of his or her vehicle until completely 619
757+passed by the overtaking vehicle. For the purposes of this subsection, 620
758+"safe distance" means not less than three feet when the driver of a 621
759+vehicle overtakes and passes a person riding a bicycle, [or] an electric 622
760+bicycle or an electric foot scooter. 623
761+Sec. 7. Subsection (b) of section 14-234 of the general statutes is 624
762+repealed and the following is substituted in lieu thereof (Effective 625
763+October 1, 2019): 626
764+(b) The driver of a vehicle may overtake and pass, in a marked no-627
765+passing zone, pedestrians, parked or standing vehicles, animals, 628
766+bicycles, electric bicycles, mopeds, scooters, electric foot scooters, 629
767+vehicles moving at a slow speed, as defined in section 14-220, or 630
768+obstructions on the right side of the highway, as listed in subdivision 631
769+(2) of subsection (a) of section 14-230, as amended by this act, provided 632

1001-(a) Each bicycle, [or] electric bicycle or electric foot scooter operated
1002-upon the public highway, during the times or under the conditions as
1003-provided in subsection (a) of section 14-96a, shall display a lighted
1004-lamp upon the forward part of such bicycle, [or] electric bicycle or
1005-electric foot scooter. Such lamp shall, when lighted, emit a white light
1006-which in clear weather shall be visible at a distance of not less than five
1007-hundred feet in the direction in which such bicycle, [or] electric bicycle
1008-or electric foot scooter is proceeding. Each bicycle, [or] electric bicycle
1009-or electric foot scooter shall also, at all times, be equipped with a
1010-reflector or reflecting tail light lens, which reflector or lens shall be
1011-attached to the rear of such bicycle, [or] electric bicycle or electric foot
1012-scooter in such manner as to reflect rays of light thrown upon the
1013-same, and such reflector or reflecting tail shall be visible at a distance
1014-of not less than six hundred feet from the rear when illuminated by the
1015-head lamps of a motor vehicle. Such bicycle, [or] electric bicycle or
1016-electric foot scooter shall also be equipped with reflective material so
1017-placed and of sufficient size and reflectivity to be visible from both
1018-sides of such bicycle, [or] electric bicycle or electric foot scooter at a
1019-distance of not less than six hundred feet when illuminated by the
1020-head lamps of a motor vehicle. Each bicycle, [or] electric bicycle or
1021-electric foot scooter shall also, at all times, be equipped with a braking
1022-device sufficient to enable the operator thereof to stop within twenty-
1023-five feet on dry, level and clean pavement when moving at a speed of
1024-ten miles per hour. No person shall equip a bicycle, [or] an electric
1025-bicycle or an electric foot scooter with a siren or device which emits a
1026-whistle or use a siren or device which emits a whistle while operating
1027-a bicycle, [or] an electric bicycle or an electric foot scooter.
1028-(b) Operation of a bicycle, [or] an electric bicycle or an electric foot
1029-scooter in conflict with any provision of this section shall be an

790+Sec. 9. Section 14-286 of the general statutes is repealed and the 647
791+following is substituted in lieu thereof (Effective October 1, 2019): 648
792+(a) Each person operating a bicycle, an electric bicycle or an electric 649
793+foot scooter upon and along a sidewalk or across any roadway upon 650
794+and along a crosswalk shall yield the right-of-way to any pedestrian 651
795+and shall give an audible signal within a reasonable distance before 652
796+overtaking and passing a pedestrian. Each person operating a bicycle, 653
797+an electric bicycle, an electric foot scooter or a motor-driven cycle upon 654
798+a roadway shall, within a reasonable distance, give an audible signal 655
799+before overtaking and passing a pedestrian or another [bicycle 656
800+operator] person operating a bicycle, an electric bicycle, an electric foot 657
801+scooter or a motor-driven cycle. No person shall operate a bicycle, an 658
802+electric bicycle or an electric foot scooter upon or along a sidewalk or 659
803+across a roadway upon and along a crosswalk if such operation is 660
804+prohibited by any ordinance of any city, town or borough or by any 661
805+regulation of the Office of the State Traffic Administration issued or 662
806+adopted pursuant to the provisions of section 14-298, as amended by 663

1034-Sec. 15. Section 14-289 of the general statutes is repealed and the
1035-following is substituted in lieu thereof (Effective October 1, 2019):
1036-Each town, city and borough shall have authority to make any
1037-ordinance not inconsistent with section 14-286, as amended by this act,
1038-or 14-288, as amended by this act, or any regulation of the Office of the
1039-State Traffic Administration issued pursuant to section 14-298, as
1040-amended by this act, respecting governing and controlling the use of
1041-bicycles, [and] electric bicycles and electric foot scooters within such
1042-town, city or borough, with appropriate penalties for violation thereof,
1043-which ordinances may include provisions requiring annual licensing
1044-of bicycles, [or] electric bicycles or electric foot scooters and providing
1045-for registration of any sale of, or change of ownership in, a bicycle, [or]
1046-an electric bicycle or an electric foot scooter.
1047-Sec. 16. Subdivision (1) of section 14-297 of the general statutes is
1048-repealed and the following is substituted in lieu thereof (Effective
1049-October 1, 2019):
1050-(1) The following terms shall be construed as they are defined in
1051-section 14-1, as amended by this act: "Authorized emergency vehicle",
1052-"class 1 electric bicycle", "class 2 electric bicycle", "class 3 electric
1053-bicycle", "driver", "electric bicycle", "electric foot scooter", "head lamp",
1054-"highway", "intersection", "limited access highway", "motor vehicle",
1055-"number plate", "operator", "person", "rotary" or "roundabout",
1056-"shoulder", "stop", "truck" [,] and "vehicle";
1057-Sec. 17. Section 14-298 of the general statutes is repealed and the
1058-following is substituted in lieu thereof (Effective October 1, 2019):
1059-There shall be within the Department of Transportation the Office of
1060-the State Traffic Administration, which shall constitute a successor to
1061-the State Traffic Commission, in accordance with the provisions of

1067-publication regulations establishing a uniform system of traffic control
1068-signals, devices, signs and markings consistent with the provisions of
1069-this chapter for use upon the public highways. The Commissioner of
1070-Transportation shall make known to the General Assembly the
1071-availability of such regulations and any requesting member shall be
1072-sent a written copy or electronic storage media of such regulations by
1073-said commissioner. Taking into consideration the public safety and
1074-convenience with respect to the width and character of the highways
1075-and roads affected, the density of traffic thereon and the character of
1076-such traffic, said office shall also adopt regulations, in cooperation and
1077-agreement with local traffic authorities, governing the use of state
1078-highways and roads on state-owned properties, and the operation of
1079-vehicles, including, but not limited to, motor vehicles, [as defined in
1080-section 14-1,] bicycles, as defined in section 14-286, as amended by this
1081-act, [and] electric bicycles and electric foot scooters thereon. A list of
1082-limited-access highways shall be published with such regulations and
1083-said list shall be revised and published once each year. The
1084-Commissioner of Transportation shall make known to the General
1085-Assembly the availability of such regulations and list and any
1086-requesting member shall be sent a written copy or electronic storage
1087-media of such regulations and list by the commissioner. A list of
1088-limited-access highways opened to traffic by the Commissioner of
1089-Transportation in the interim period between publications shall be
1090-maintained in the Office of the State Traffic Administration and such
1091-regulations shall apply to the use of such listed highways. Said office
1092-shall also make regulations, in cooperation and agreement with local
1093-traffic authorities, respecting the use by through truck traffic of streets
1094-and highways within the limits of, and under the jurisdiction of, any
1095-city, town or borough of this state for the protection and safety of the
1096-public. If said office determines that the prohibition of through truck
1097-traffic on any street or highway is necessary because of an immediate
1098-and imminent threat to the public health and safety and the local Substitute House Bill No. 7141
814+(b) [No] Except as provided in subsection (c) of this section, no 665
815+person shall ride a motor-driven cycle unless that person holds a valid 666
816+motor vehicle operator's license. No person shall operate a motor-667
817+driven cycle on any sidewalk, limited access highway or turnpike. 668
818+(c) (1) [Notwithstanding the provisions of subsection (b) of this 669
819+section, the] The Commissioner of Motor Vehicles may issue to a 670
820+person who does not hold a valid operator's license a special permit 671
821+that authorizes such person to ride a motor-driven cycle if (A) such 672
822+person presents to the commissioner a certificate by a physician 673
823+licensed to practice medicine in this state or an advanced practice 674
824+registered nurse licensed pursuant to chapter 378 that such person is 675
825+physically disabled, as defined in section 1-1f, other than blind, and 676
826+that, in the physician's or advanced practice registered nurse's opinion, 677
827+such person is capable of riding a motor-driven cycle, and (B) such 678
828+person demonstrates to the Commissioner of Motor Vehicles that he is 679
829+able to ride a bicycle on level terrain, and a motor-driven cycle. (2) 680
830+Such permit may contain limitations that the commissioner deems 681
831+advisable for the safety of such person and for the public safety, 682
832+including, but not limited to, the maximum speed of the motor such 683
833+person may use. No person who holds a valid special permit under 684
834+this subsection shall operate a motor-driven cycle in violation of any 685
835+limitations imposed in the permit. Any person to whom a special 686
836+permit is issued shall carry the permit at all times while operating the 687
837+motor-driven cycle. Each permit issued under this subsection shall 688
838+expire one year from the date of issuance. 689
839+(d) Notwithstanding [the provisions of any statute or regulation to 690
840+the contrary] any provision of the general statutes, the Office of the 691
841+State Traffic Administration shall adopt regulations in accordance with 692
842+the provisions of chapter 54 determining the conditions and 693
843+circumstances under which [bicycle traffic] the operation of bicycles, 694
844+electric bicycles and electric foot scooters may be permitted on those 695
845+bridges in the state on limited access highways which it designates to 696

1102-traffic authority is precluded for any reason from acting on such
1103-prohibition, the office, if it is not otherwise precluded from so acting,
1104-may impose such prohibition. Said office may place and maintain
1105-traffic control signals, signs, markings and other safety devices, which
1106-it deems to be in the interests of public safety, upon such highways as
1107-come within the jurisdiction of said office as set forth in section 14-297,
1108-as amended by this act. The traffic authority of any city, town or
1109-borough may place and maintain traffic control signals, signs,
1110-markings and other safety devices upon the highways under its
1111-jurisdiction, and all such signals, devices, signs and markings shall
1112-conform to the regulations established by said office in accordance
1113-with this chapter, and such traffic authority shall, with respect to traffic
1114-control signals, conform to the provisions of section 14-299.
1115-Sec. 18. Section 14-300i of the general statutes is repealed and the
1116-following is substituted in lieu thereof (Effective October 1, 2019):
1117-(a) As used in subsection (b) of this section, (1) "vulnerable user"
1118-means: (A) A pedestrian; (B) a highway worker; (C) a person riding or
1119-driving an animal; (D) a person riding a bicycle, [or] an electric bicycle
1120-or an electric foot scooter; (E) a person using a skateboard, roller skates
1121-or in-line skates; (F) a person operating or riding on an agricultural
1122-tractor; (G) a person using a wheelchair or motorized chair; and (H) a
1123-person who is blind and such person's service animal, [and] (2) "public
1124-way" includes any state or other public highway, road, street, avenue,
1125-alley, driveway, parkway or place, under the control of the state or any
1126-political subdivision of the state, dedicated, appropriated or opened to
1127-public travel or other use, (3) "substantial bodily harm" means bodily
1128-injury that involves a temporary but substantial disfigurement, causes
1129-a temporary but substantial loss or impairment of the function of any
1130-bodily part or organ, or causes a fracture of any bodily part, and (4)
1131-"serious physical injury" has the same meaning as provided in section

854+prohibited on any such bridges under such conditio ns and 699
855+circumstances. 700
856+(e) As used in this section: (1) "Sidewalk" means any sidewalk laid 701
857+out as such by any town, city or borough, and any walk which is 702
858+reserved by custom for the use of pedestrians, or which has been 703
859+specially prepared for their use. "Sidewalk" does not include 704
860+crosswalks and does not include footpaths on portions of public 705
861+highways outside thickly settled parts of towns, cities and boroughs, 706
862+which are worn only by travel and are not improved by such towns, 707
863+cities or boroughs or by abutters; (2) "bicycle" includes all vehicles 708
864+propelled by the person riding the same by foot or hand power; and 709
865+(3) "motor-driven cycle" means any motorcycle other than an 710
866+autocycle, motor scooter or bicycle with an attached motor with a seat 711
867+height of not less than twenty-six inches and a motor having a capacity 712
868+of less than fifty cubic centimeters piston displacement. 713
869+(f) A person shall operate a motor-driven cycle on any public 714
870+highway, the speed limit of which is greater than the maximum speed 715
871+of the motor-driven cycle, only in the right hand lane available for 716
872+traffic or upon a usable shoulder on the right side of the highway, 717
873+except when preparing to make a left turn at an intersection or into or 718
874+from a private road or driveway. 719
875+(g) Any person who pleads not guilty of a violation of any provision 720
876+of this section shall be prosecuted within fifteen days of such plea. 721
877+(h) No person may operate a high-mileage vehicle [as defined in 722
878+section 14-1] on any sidewalk, limited access highway or turnpike. 723
879+(i) A person may park an electric foot scooter on any sidewalk 724
880+provided (1) such electric foot scooter is parked in a manner that does 725
881+not impede the reasonable movement of pedestrians and other traffic 726
882+on such sidewalk, and (2) such parking is not prohibited by any 727
883+ordinance of any city, town or borough or by any regulations of the 728 Substitute Bill No. 7141

1136-(b) Any person operating a motor vehicle on a public way who fails
1137-to exercise reasonable care and causes substantial bodily harm to, or
1138-the serious physical injury or death, of a vulnerable user of a public
1139-way, provided such vulnerable user has shown reasonable care in such
1140-user's use of the public way, shall be fined not more than one thousand
1141-dollars.
1142-Sec. 19. Section 14-289k of the general statutes is repealed and the
1143-following is substituted in lieu thereof (Effective October 1, 2019):
1144-[(a) For the purposes of this section, "electric bicycle", "class 1
1145-electric bicycle", "class 2 electric bicycle" and "class 3 electric bicycle"
1146-have the same meanings as provided in section 14-1.]
1147-[(b)] (a) Except as provided in this section, the rider of an electric
1148-bicycle shall be afforded the same rights and privileges and subject to
1149-the same duties as the rider of a bicycle.
1150-[(c)] (b) Except as provided in this section or where prohibited by
1151-local ordinance, an electric bicycle may be ridden where bicycles are
1152-permitted to travel.
1153-[(d)] (c) A class 3 electric bicycle shall not be ridden on a bicycle trail
1154-or path or multiuse trail or path.
1155-[(e)] (d) Except where permitted by local ordinance, a class 1 or class
1156-2 electric bicycle shall not be ridden on a bicycle trail or path or
1157-multiuse trail or path designated for nonmotorized traffic if such trail
1158-or path has a natural surface tread made by clearing and grading the
1159-soil and no surfacing materials have been added.
1160-[(f)] (e) No person under the age of sixteen shall ride a class 3
1161-electric bicycle. Any person under the age of sixteen may sit as a
1162-passenger on a class 3 electric bicycle provided such bicycle is

1167-[(g)] (f) No person shall ride or sit as a passenger on an electric
1168-bicycle unless such person is wearing protective headgear that
1169-conforms to the minimum specifications established for bicycle
1170-helmets by the American National Standards Institute, the United
1171-States Consumer Product Safety Commission, [or] the American
1172-Society for Testing and Materials or the Snell Memorial Foundation's
1173-Standard for Protective Headgear for Use in Bicycling, as amended
1174-from time to time.
1175-[(h)] (g) The provisions of subsections (b), (c) [,] and (d) [and (e)] of
1176-this section shall not apply to any police officer, firefighter or
1177-emergency medical technician engaged in the performance of the
1178-duties of such officer, firefighter or technician.
1179-Sec. 20. Subdivision (102) of section 12-412 of the general statutes is
1180-repealed and the following is substituted in lieu thereof (Effective
1181-October 1, 2019):
1182-(102) Sales of and the storage, use or other consumption of bicycle
1183-helmets. For the purposes of this subdivision, "bicycle" means any
1184-vehicle propelled by the person riding the same by foot or hand power
1185-and "helmet" means protective headgear which conforms to the
1186-minimum specifications established by the American National
1187-Standards Institute, the United States Consumer Product Safety
1188-Commission, the American Society for Testing and Materials or the
1189-Snell Memorial Foundation's Standard for Protective Headgear for Use
1190-in Bicycling, as amended from time to time.

892+[(i)] (j) Violation of any provision of this section shall be an 731

894+Sec. 10. Subsection (a) of section 14-286a of the general statutes is 733

897+(a) Every person riding a bicycle, as defined in section 14-286, as 736
898+amended by this act, [or] an electric bicycle or an electric foot scooter 737
899+upon the traveled portion of a highway shall be granted all of the 738
900+rights and shall be subject to all of the duties applicable to the driver of 739
901+any vehicle subject to the requirements of the general statutes relating 740
902+to motor vehicles, except (1) as to those provisions which by their 741
903+nature can have no application, [and except that] (2) each town, city or 742
904+borough and the Office of the State Traffic Administration within its 743
905+jurisdiction as provided in section 14-298, as amended by this act, shall 744
906+have authority to regulate bicycles, [and] electric bicycles and electric 745
907+foot scooters as provided in [section] sections 14-289, as amended by 746
908+this act, and [said section] 14-298, as amended by this act, and [except] 747
909+(3) as provided by section 14-286c, as amended by this act. No parent 748
910+of any child and no guardian of any ward shall authorize or knowingly 749
911+permit any such child or ward to violate any provision of the general 750
912+statutes or ordinances enacted under section 14-289, as amended by 751
913+this act, relating to bicycles, [or] electric bicycles or electric foot 752
914+scooters. 753
915+Sec. 11. Section 14-286b of the general statutes is repealed and the 754
916+following is substituted in lieu thereof (Effective October 1, 2019): 755
917+(a) Any person operating a bicycle, [or] an electric bicycle or an 756
918+electric foot scooter upon a roadway at less than the normal speed of 757
919+traffic shall ride as close to the right side of the roadway as is safe, as 758

935+and a motor vehicle to travel safely side by side within such lanes; 768
936+(4) Approaching an intersection where right turns are permitted and 769
937+there is a dedicated right turn lane, in which case a [bicyclist or electric 770
938+bicyclist] person operating a bicycle, an electric bicycle or an electric 771
939+foot scooter may ride on the left-hand side of such dedicated lane, even 772
940+if [the bicyclist or electric bicyclist] such person does not intend to turn 773
941+right; 774
942+(5) Riding on a roadway designated for one-way traffic, when the 775
943+[bicyclist or electric bicyclist] person operating a bicycle, an electric 776
944+bicycle or an electric foot scooter may ride as near to the left-hand curb 777
945+or edge of such roadway as judged safe by [the bicyclist or electric 778
946+bicyclist] such person; or 779
947+(6) Riding on parts of roadways separated for the exclusive use of 780
948+bicycles, [or] electric bicycles or electric foot scooters, including, but 781
949+not limited to, contra-flow bicycle lanes, left-handed cycle tracks or 782
950+bicycle lanes on one-way streets and two-way cycle tracks or bicycle 783
951+lanes. 784
952+(b) Persons riding bicycles, [or] electric bicycles or electric foot 785
953+scooters upon a roadway shall not ride more than two abreast except 786
954+on paths or parts of roadways set aside for the exclusive use of 787
955+bicycles, [or] electric bicycles or electric foot scooters. Persons riding 788
956+two abreast, as provided in this subsection, shall not impede the 789
957+normal and reasonable movement of traffic, and, on a laned roadway, 790 Substitute Bill No. 7141

967+foot scooter or any other vehicle not designed or intended to be towed 794
968+shall attach the same or such person to any vehicle moving or about to 795
969+move on a public roadway nor shall the operator of such vehicle 796
970+knowingly permit any person riding a bicycle, electric bicycle, motor-797
971+driven cycle, roller skates, skis, skateboard, coaster, sled, toy vehicle, 798
972+electric foot scooter or any other vehicle not designed or intended to be 799
973+towed to attach the same or such person to such vehicle so operated or 800
974+about to be operated, provided any person operating a bicycle solely 801
975+by foot or hand power may attach a bicycle trailer or semitrailer 802
976+thereto, provided such trailer or semitrailer is designed for such 803
977+attachment. 804
978+(d) No person operating a bicycle, as defined in section 14-286, as 805
979+amended by this act, [or] an electric bicycle or an electric foot scooter 806
980+upon a roadway, path or part of roadway set aside for exclusive use of 807
981+bicycles, [or] electric bicycles or electric foot scooters shall carry on 808
982+such bicycle, [or] electric bicycle or electric foot scooter a passenger 809
983+unless such bicycle, [or] electric bicycle or electric foot scooter is 810
984+equipped or designed to carry passengers, provided any person who 811
985+has attained the age of eighteen years may carry any child while such 812
986+person is operating a bicycle propelled solely by foot or hand power, 813
987+provided such child is securely attached to his or her person by means 814
988+of a back pack, sling or other similar device. The term "child", as used 815
989+in this subsection, means any person who has not attained the age of 816
990+four years. 817
991+(e) No person operating a bicycle, as defined in section 14-286, as 818
992+amended by this act, [or] an electric bicycle or an electric foot scooter 819
993+shall carry any package, bundle or other article which prevents such 820
994+person from using both hands in the operation of such bicycle, [or] 821
995+electric bicycle or electric foot scooter. Each person operating such 822
996+bicycle, [or] electric bicycle or electric foot scooter shall keep at least 823 Substitute Bill No. 7141

1005+(f) Violation of any provision of this section shall be an infraction. 826
1006+Sec. 12. Section 14-286c of the general statutes is repealed and the 827
1007+following is substituted in lieu thereof (Effective October 1, 2019): 828
1008+(a) Each person riding a bicycle, [or] an electric bicycle [, as defined 829
1009+in section 14-1] or an electric foot scooter, upon the traveled portion of 830
1010+a highway and intending to make a left turn after proceeding pursuant 831
1011+to the provisions of section 14-244 or subsection (b) of this section may, 832
1012+in lieu of the procedure prescribed by section 14-241, approach as close 833
1013+as practicable to the right-hand curb or edge of the highway, proceed 834
1014+across the intersecting roadway and make such turn as close as 835
1015+practicable to the curb or edge of the highway on the far side of the 836
1016+intersection, provided such procedure is not prohibited by any 837
1017+regulation issued by any town, city, borough or the Office of the State 838
1018+Traffic Administration. 839
1019+(b) Each person riding a bicycle, [or] an electric bicycle [, as defined 840
1020+in section 14-1,] or an electric foot scooter upon the traveled portion of 841
1021+a highway and intending to make a right turn may, in lieu of the 842
1022+procedure prescribed by section 14-244, before turning and while in 843
1023+motion or if stopped while waiting to turn, signal such turn by 844
1024+extending [his] such person's right hand and arm horizontally with 845
1025+forefinger extended. 846
1026+(c) No person operating a bicycle, [or] an electric bicycle [, as 847
1027+defined in section 14-1,] or an electric foot scooter upon the traveled 848
1028+portion of a highway and intending to make a right or left turn shall be 849
1029+required when making a signal of such intention to make such signal 850
1030+continuously. 851

1039+(a) For the purposes of this section and section 14-286e, "bicycle" 854
1040+means any vehicle propelled by the person riding the same by foot or 855
1041+hand power. 856
1042+(b) No child fifteen years of age or under shall operate a bicycle, 857
1043+electric bicycle, nonmotorized scooter, [or] skateboard or electric foot 858
1044+scooter or wear roller skates or in-line skates on the traveled portion of 859
1045+any highway, at a skateboarding park or any park unless such child is 860
1046+wearing properly fitted and fastened protective headgear which 861
1047+conforms to the minimum specifications established by the American 862
1048+National Standards Institute or the Snell Memorial Foundation, as 863
1049+amended from time to time. Failure to comply with this section shall 864
1050+not be a violation or an offense. Failure to wear protective headgear as 865
1051+required by this subsection shall not be considered to be contributory 866
1052+negligence on the part of the parent or the child nor shall such failure 867
1053+be admissible in any civil action. 868
1054+(c) A law enforcement officer may issue a verbal warning to the 869
1055+parent or guardian of a child that such child has failed to comply with 870
1056+the provisions of subsection (b) of this section. 871
1057+(d) A person, firm or corporation engaged in the business of renting 872
1058+bicycles, electric bicycles or electric foot scooters shall provide 873
1059+protective headgear conforming to the minimum specifications 874
1060+established by the American National Standards Institute or the Snell 875
1061+Memorial Foundation's Standard for Protective Headgear for Use in 876
1062+Bicycling, as amended from time to time, to any person under sixteen 877
1063+years of age who will operate the bicycle, electric bicycle or electric 878
1064+foot scooter if such person does not have protective headgear in his or 879
1065+her possession. A fee may be charged for the protective headgear 880
1066+rental. Violation of any of the provisions of this subsection shall be an 881
1067+infraction. 882
1068+(e) The Commissioner of Consumer Protection shall post on the 883
1069+Department of Consumer Protection's Internet web site information 884
1070+concerning the dangers of riding bicycles, electric bicycles or electric 885 Substitute Bill No. 7141

1078+protective headgear and promoting the use of protective headgear 887
1079+while riding bicycles, electric bicycles or electric foot scooters, 888
1080+skateboarding, roller skating and in-line skating. 889
1081+Sec. 14. Section 14-288 of the general statutes is repealed and the 890
1082+following is substituted in lieu thereof (Effective October 1, 2019): 891
1083+(a) Each bicycle, [or] electric bicycle or electric foot scooter operated 892
1084+upon the public highway, during the times or under the conditions as 893
1085+provided in subsection (a) of section 14-96a, shall display a lighted 894
1086+lamp upon the forward part of such bicycle, [or] electric bicycle or 895
1087+electric foot scooter. Such lamp shall, when lighted, emit a white light 896
1088+which in clear weather shall be visible at a distance of not less than five 897
1089+hundred feet in the direction in which such bicycle, [or] electric bicycle 898
1090+or electric foot scooter is proceeding. Each bicycle, [or] electric bicycle 899
1091+or electric foot scooter shall also, at all times, be equipped with a 900
1092+reflector or reflecting tail light lens, which reflector or lens shall be 901
1093+attached to the rear of such bicycle, [or] electric bicycle or electric foot 902
1094+scooter in such manner as to reflect rays of light thrown upon the 903
1095+same, and such reflector or reflecting tail shall be visible at a distance 904
1096+of not less than six hundred feet from the rear when illuminated by the 905
1097+head lamps of a motor vehicle. Such bicycle, [or] electric bicycle or 906
1098+electric foot scooter shall also be equipped with reflective material so 907
1099+placed and of sufficient size and reflectivity to be visible from both 908
1100+sides of such bicycle, [or] electric bicycle or electric foot scooter at a 909
1101+distance of not less than six hundred feet when illuminated by the 910
1102+head lamps of a motor vehicle. Each bicycle, [or] electric bicycle or 911
1103+electric foot scooter shall also, at all times, be equipped with a braking 912
1104+device sufficient to enable the operator thereof to stop within twenty-913
1105+five feet on dry, level and clean pavement when moving at a speed of 914
1106+ten miles per hour. No person shall equip a bicycle, [or] an electric 915
1107+bicycle or an electric foot scooter with a siren or device which emits a 916
1108+whistle or use a siren or device which emits a whistle while operating 917
1109+a bicycle, [or] an electric bicycle or an electric foot scooter. 918 Substitute Bill No. 7141

1116+(b) Operation of a bicycle, [or] an electric bicycle or an electric foot 919
1117+scooter in conflict with any provision of this section shall be an 920
1118+infraction. 921
1119+Sec. 15. Section 14-289 of the general statutes is repealed and the 922
1120+following is substituted in lieu thereof (Effective October 1, 2019): 923
1121+Each town, city and borough shall have authority to make any 924
1122+ordinance not inconsistent with section 14-286, as amended by this act, 925
1123+or 14-288, as amended by this act, or any regulation of the Office of the 926
1124+State Traffic Administration issued pursuant to section 14-298, as 927
1125+amended by this act, respecting governing and controlling the use of 928
1126+bicycles, [and] electric bicycles and electric foot scooters within such 929
1127+town, city or borough, with appropriate penalties for violation thereof, 930
1128+which ordinances may include provisions requiring annual licensing 931
1129+of bicycles, [or] electric bicycles or electric foot scooters and providing 932
1130+for registration of any sale of, or change of ownership in, a bicycle, [or] 933
1131+an electric bicycle or an electric foot scooter. 934
1132+Sec. 16. Subdivision (1) of section 14-297 of the general statutes is 935
1133+repealed and the following is substituted in lieu thereof (Effective 936
1134+October 1, 2019): 937
1135+(1) The following terms shall be construed as they are defined in 938
1136+section 14-1, as amended by this act: "Authorized emergency vehicle", 939
1137+"class 1 electric bicycle", "class 2 electric bicycle", "class 3 electric 940
1138+bicycle", "driver", "electric bicycle", "electric foot scooter", "head lamp", 941
1139+"highway", "intersection", "limited access highway", "motor vehicle", 942
1140+"number plate", "operator", "person", "rotary" or "roundabout", 943
1141+"shoulder", "stop", "truck" [,] and "vehicle"; 944
1142+Sec. 17. Section 14-298 of the general statutes is repealed and the 945
1143+following is substituted in lieu thereof (Effective October 1, 2019): 946
1144+There shall be within the Department of Transportation the Office of 947
1145+the State Traffic Administration, which shall constitute a successor to 948
1146+the State Traffic Commission, in accordance with the provisions of 949 Substitute Bill No. 7141

1153+sections 4-38d, 4-38e and 4-39. For the purpose of standardization and 950
1154+uniformity, said office shall adopt and cause to be printed for 951
1155+publication regulations establishing a uniform system of traffic control 952
1156+signals, devices, signs and markings consistent with the provisions of 953
1157+this chapter for use upon the public highways. The Commissioner of 954
1158+Transportation shall make known to the General Assembly the 955
1159+availability of such regulations and any requesting member shall be 956
1160+sent a written copy or electronic storage media of such regulations by 957
1161+said commissioner. Taking into consideration the public safety and 958
1162+convenience with respect to the width and character of the highways 959
1163+and roads affected, the density of traffic thereon and the character of 960
1164+such traffic, said office shall also adopt regulations, in cooperation and 961
1165+agreement with local traffic authorities, governing the use of state 962
1166+highways and roads on state-owned properties, and the operation of 963
1167+vehicles, including, but not limited to, motor vehicles, [as defined in 964
1168+section 14-1,] bicycles, as defined in section 14-286, as amended by this 965
1169+act, [and] electric bicycles and electric foot scooters thereon. A list of 966
1170+limited-access highways shall be published with such regulations and 967
1171+said list shall be revised and published once each year. The 968
1172+Commissioner of Transportation shall make known to the General 969
1173+Assembly the availability of such regulations and list and any 970
1174+requesting member shall be sent a written copy or electronic storage 971
1175+media of such regulations and list by the commissioner. A list of 972
1176+limited-access highways opened to traffic by the Commissioner of 973
1177+Transportation in the interim period between publications shall be 974
1178+maintained in the Office of the State Traffic Administration and such 975
1179+regulations shall apply to the use of such listed highways. Said office 976
1180+shall also make regulations, in cooperation and agreement with local 977
1181+traffic authorities, respecting the use by through truck traffic of streets 978
1182+and highways within the limits of, and under the jurisdiction of, any 979
1183+city, town or borough of this state for the protection and safety of the 980
1184+public. If said office determines that the prohibition of through truck 981
1185+traffic on any street or highway is necessary because of an immediate 982
1186+and imminent threat to the public health and safety and the local 983
1187+traffic authority is precluded for any reason from acting on such 984 Substitute Bill No. 7141

1194+prohibition, the office, if it is not otherwise precluded from so acting, 985
1195+may impose such prohibition. Said office may place and maintain 986
1196+traffic control signals, signs, markings and other safety devices, which 987
1197+it deems to be in the interests of public safety, upon such highways as 988
1198+come within the jurisdiction of said office as set forth in section 14-297, 989
1199+as amended by this act. The traffic authority of any city, town or 990
1200+borough may place and maintain traffic control signals, signs, 991
1201+markings and other safety devices upon the highways under its 992
1202+jurisdiction, and all such signals, devices, signs and markings shall 993
1203+conform to the regulations established by said office in accordance 994
1204+with this chapter, and such traffic authority shall, with respect to traffic 995
1205+control signals, conform to the provisions of section 14-299. 996
1206+Sec. 18. Section 14-300i of the general statutes is repealed and the 997
1207+following is substituted in lieu thereof (Effective October 1, 2019): 998
1208+(a) As used in subsection (b) of this section, (1) "vulnerable user" 999
1209+means: (A) A pedestrian; (B) a highway worker; (C) a person riding or 1000
1210+driving an animal; (D) a person riding a bicycle, [or] an electric bicycle 1001
1211+or an electric foot scooter; (E) a person using a skateboard, roller skates 1002
1212+or in-line skates; (F) a person operating or riding on an agricultural 1003
1213+tractor; (G) a person using a wheelchair or motorized chair; and (H) a 1004
1214+person who is blind and such person's service animal, [and] (2) "public 1005
1215+way" includes any state or other public highway, road, street, avenue, 1006
1216+alley, driveway, parkway or place, under the control of the state or any 1007
1217+political subdivision of the state, dedicated, appropriated or opened to 1008
1218+public travel or other use, (3) "substantial bodily harm" means bodily 1009
1219+injury that involves a temporary but substantial disfigurement, causes 1010
1220+a temporary but substantial loss or impairment of the function of any 1011
1221+bodily part or organ, or causes a fracture of any bodily part, and (4) 1012
1222+"serious physical injury" has the same meaning as provided in section 1013
1223+53a-3. 1014
1224+(b) Any person operating a motor vehicle on a public way who fails 1015
1225+to exercise reasonable care and causes substantial bodily harm to, or 1016

1236+Sec. 19. Section 14-289k of the general statutes is repealed and the 1021
1237+following is substituted in lieu thereof (Effective October 1, 2019): 1022
1238+[(a) For the purposes of this section, "electric bicycle", "class 1 1023
1239+electric bicycle", "class 2 electric bicycle" and "class 3 electric bicycle" 1024
1240+have the same meanings as provided in section 14-1.] 1025
1241+[(b)] (a) Except as provided in this section, the rider of an electric 1026
1242+bicycle shall be afforded the same rights and privileges and subject to 1027
1243+the same duties as the rider of a bicycle. 1028
1244+[(c)] (b) Except as provided in this section or where prohibited by 1029
1245+local ordinance, an electric bicycle may be ridden where bicycles are 1030
1246+permitted to travel. 1031
1247+[(d)] (c) A class 3 electric bicycle shall not be ridden on a bicycle trail 1032
1248+or path or multiuse trail or path. 1033
1249+[(e)] (d) Except where permitted by local ordinance, a class 1 or class 1034
1250+2 electric bicycle shall not be ridden on a bicycle trail or path or 1035
1251+multiuse trail or path designated for nonmotorized traffic if such trail 1036
1252+or path has a natural surface tread made by clearing and grading the 1037
1253+soil and no surfacing materials have been added. 1038
1254+[(f)] (e) No person under the age of sixteen shall ride a class 3 1039
1255+electric bicycle. Any person under the age of sixteen may sit as a 1040
1256+passenger on a class 3 electric bicycle provided such bicycle is 1041
1257+equipped or designed to carry a passenger. 1042
1258+[(g)] (f) No person shall ride or sit as a passenger on an electric 1043
1259+bicycle unless such person is wearing protective headgear that 1044
1260+conforms to the minimum specifications established for bicycle 1045
1261+helmets by the United States Consumer Product Safety Commission or 1046 Substitute Bill No. 7141
