1414 AN ACT CONCERNING TH E PROVISION OF RESOU RCES TO
1515 GUARDIANS OF ADULT C HILDREN WITH INTELLECTUAL
1616 DISABILITY.
1717 Be it enacted by the Senate and House of Representatives in General
1818 Assembly convened:

2020 Section 1. (NEW) (Effective July 1, 2019) (a) As used in this section, 1
2121 "guardian or family member" means (1) one or more biological or 2
2222 adoptive parents of an adult with intellectual disability, (2) one or 3
2323 more persons to whom legal custody of an adult with intellectual 4
2424 disability was given when the adult with intellectual disability was a 5
2525 minor and in whose home the adult with intellectual disability resides, 6
2626 or (3) any other adult family member of an adult with intellectual 7
2727 disability who resides with and has a primary responsibility for 8
2828 providing continuous care to the adult with intellectual disability. 9
2929 (b) The Commissioner of Social Services, in collaboration with the 10
3030 Commissioner of Developmental Services, shall submit an application 11
3131 for any applicable Medicaid state plan amendment, waiver or waiver 12
3232 amendment, in accordance with the provisions of section 17b-8 of the 13
3333 general statutes, to the Centers for Medicare and Medicaid Services to 14
3434 allow a guardian or family member of an adult with intellectual 15
3535 disability to receive a stipend for providing personal care services to 16
3636 such adult with intellectual disability. Not later than July 1, 2020, or 17
3737 fifteen days after the Commissioner of Social Services receives federal 18 Substitute Bill No. 372

4444 approval of such application, whichever is earlier, the Commissioner 19
4545 of Developmental Services shall provide a stipend to the guardian or 20
4646 family member of such adult with intellectual disability for the 21
4747 provision of personal care services to such adult with intellectual 22
4848 disability, provided such adult with intellectual disability (1) has 23
4949 complex medical or behavioral needs, as determined pursuant to the 24
5050 Department of Developmental Services' level of need assessment, (2) is 25
5151 at least twenty-one years of age, (3) has an income at or below one 26
5252 hundred per cent of the federal poverty level, and (4) is at risk of 27
5353 institutionalization. The Commissioner of Developmental Services 28
5454 shall provide such stipend in accordance with the fee schedule, as 29
5555 established and amended from time to time by the Commissioner of 30
5656 Social Services pursuant to section 17b-343 of the general statutes, for 31
5757 home health services provided under the Connecticut home-care 32
5858 program for the elderly established pursuant to section 17b-342 of the 33
5959 general statutes. 34
