20 | 20 | | AN ACT CONCERNING SPECU LATIVE SALES OF EVENT TICKETS. |

21 | 21 | | Be it enacted by the Senate and House of Representatives in General |

22 | 22 | | Assembly convened: |

24 | 24 | | Section 1. Section 53-289b of the general statutes is repealed and the 1 |
---|
25 | 25 | | following is substituted in lieu thereof (Effective October 1, 2019): 2 |
---|
26 | 26 | | (a) Any person who resells a ticket to an entertainment event, 3 |
---|
27 | 27 | | including, but not limited to, a sporting event, a concert or a theatrical 4 |
---|
28 | 28 | | or operatic performance, shall refund to the purchaser of such ticket 5 |
---|
29 | 29 | | the full amount, including all service fees and delivery charges, paid 6 |
---|
30 | 30 | | by the purchaser for such ticket if any of the following occurs: (1) The 7 |
---|
31 | 31 | | event for which the ticket is resold is cancelled; (2) the ticket received 8 |
---|
32 | 32 | | by the purchaser does not grant the purchaser admission to the event 9 |
---|
33 | 33 | | described on the ticket; [or] (3) the ticket fails to conform to its 10 |
---|
34 | 34 | | description as advertised by the ticket reseller; or (4) the reseller is 11 |
---|
35 | 35 | | unable to provide the purchaser with such ticket pursuant to 12 |
---|
36 | 36 | | subsection (c) of this section. 13 |

37 | 37 | | (b) A person who resells a ticket pursuant to subsection (a) of this 14 |
---|
38 | 38 | | section shall provide the purchaser of such ticket with such ticket 15 |
---|

47 | 47 | | obtain a refund of the ticket price, if necessary. 18 |

48 | 48 | | (c) A person who resells a ticket pursuant to subsection (a) of this 19 |
---|
49 | 49 | | section shall not employ a tentative ticket sale policy whereby the 20 |
---|
50 | 50 | | reseller sells a ticket that is not in the reseller's possession at the time of 21 |
---|
51 | 51 | | sale, unless the policy is disclosed to the purchaser at the beginning of 22 |
---|
52 | 52 | | the transaction. The disclosure shall include an approximate ticket 23 |
---|
53 | 53 | | delivery date and the number of tickets guaranteed to be sold to the 24 |
---|
54 | 54 | | purchaser, as well as the zone, section or seat number assigned by the 25 |
---|
55 | 55 | | venue for each ticket. 26 |

56 | 56 | | [(c)] (d) A violation of subdivision (1) or (2) of subsection (a) of this 27 |
---|
57 | 57 | | section or of subsection (b) or (c) of this section is a class B 28 |
---|
58 | 58 | | misdemeanor. 29 |

59 | 59 | | This act shall take effect as follows and shall amend the following |
