2019 AN ACT CONCERNING RE TROACTIVE MEDICAID ELIGIBILITY FOR

2221 Be it enacted by the Senate and House of Representatives in General

2524 Section 1. Subsection (h) of section 17b-342 of the general statutes is 1
2625 repealed and the following is substituted in lieu thereof (Effective July 2
2726 1, 2019): 3
2827 (h) An individual who is otherwise eligible for services pursuant to 4
2928 this section shall, as a condition of participation in the program, apply 5
3029 for medical assistance benefits pursuant to section 17b-260 when 6
3130 requested to do so by the department and shall accept such benefits if 7
3231 determined eligible. The Commissioner of Social Services shall provide 8
3332 payments for Medicaid eligible home care services retroactive to not more 9
3433 than three months from the date an eligible individual applied for 10
3534 Medicaid, in accordance with the provisions of 42 CFR 435.915 as applied 11
3635 to institutional care, provided such applicant has not made a transfer of 12
3736 assets for less than fair market value for purposes of obtaining or 13
3837 maintaining Medicaid eligibility in the sixty months before applying. If 14
39-the applicant has made such a transfer, the commissioner shall impose a 15
