25 | 24 | Section 1. Subsection (h) of section 17b-342 of the general statutes is 1 | |
26 | 25 | repealed and the following is substituted in lieu thereof (Effective July 2 | |

28 | 27 | (h) An individual who is otherwise eligible for services pursuant to 4 | |
29 | 28 | this section shall, as a condition of participation in the program, apply 5 | |
30 | 29 | for medical assistance benefits pursuant to section 17b-260 when 6 | |
31 | 30 | requested to do so by the department and shall accept such benefits if 7 | |
32 | 31 | determined eligible. The Commissioner of Social Services shall provide 8 | |
33 | 32 | payments for Medicaid eligible home care services retroactive to not more 9 | |
34 | 33 | than three months from the date an eligible individual applied for 10 | |
35 | 34 | Medicaid, in accordance with the provisions of 42 CFR 435.915 as applied 11 | |
36 | 35 | to institutional care, provided such applicant has not made a transfer of 12 | |
37 | 36 | assets for less than fair market value for purposes of obtaining or 13 | |
