1419 AN ACT CONCERNING MA RKINGS MADE PURSUANT TO CAL L

1621 Be it enacted by the Senate and House of Representatives in General

1924 Section 1. Section 16-351 of the general statutes is repealed and the 1
2025 following is substituted in lieu thereof (Effective October 1, 2019): 2
2126 A public utility receiving notice pursuant to section 16-349 shall 3
2227 inform the person, public agency or public utility proposing to 4
2328 excavate, discharge explosives or demolish of the approximate location 5
2429 of its underground facilities in the area in such manner as will enable 6
2530 such person, public agency or public utility to establish the actual 7
2631 location of the underground facilities, and shall provide such other 8
2732 assistance in establishing the actual location of the underground 9
2833 facilities as the authority may require by regulations adopted pursuant 10
29-to section 16-357. Such person, public agency or public utility shall 11
30-designate the area of the proposed excavation, demolition or discharge 12
31-of explosives as the authority may prescribe by regulations adopted 13
32-pursuant to section 16-357. The public utility receiving notice shall 14
33-mark the approximate location of its underground facilities in such 15
34-manner and using such methods, including color coding, as the 16
35-authority may prescribe by regulations adopted pursuant to section 16-17
36-357. The authority shall prescribe by regulations adopted pursuant to 18
37-section 16-357, that any designation or mark made pursuant to this 19 Substitute Bill No. 678
34+to section 16-357, as amended by this act. Such person, public agency 11
35+or public utility shall designate the area of the proposed excavation, 12
36+demolition or discharge of explosives as the authority may prescribe 13

45-shall be made with a material that begins to fade not more than three 21
46-months after such markings are made. If the actual location of the 22
47-underground facilities cannot be established, the person, public agency 23
48-or public utility shall so notify the public utility whose facilities may be 24
49-affected, which shall provide such further assistance as may be needed 25
50-to determine the actual location of the underground facilities in 26
51-advance of the proposed excavation, discharge of explosives or 27
52-demolition. 28
