AN ACT CONCERNING MA RKINGS MADE PURSUANT TO CALL 
BEFORE YOU DIG REQUI REMENTS.  
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. Section 16-351 of the general statutes is repealed and the 1 
following is substituted in lieu thereof (Effective October 1, 2019): 2 
A public utility receiving notice pursuant to section 16-349 shall 3 
inform the person, public agency or public utility proposing to 4 
excavate, discharge explosives or demolish of the approximate location 5 
of its underground facilities in the area in such manner as will enable 6 
such person, public agency or public utility to establish the actual 7 
location of the underground facilities, and shall provide such other 8 
assistance in establishing the actual location of the underground 9 
facilities as the authority may require by regulations adopted pursuant 10 
to section 16-357. Such person, public agency or public utility shall 11 
designate the area of the proposed excavation, demolition or discharge 12 
of explosives as the authority may prescribe by regulations adopted 13 
pursuant to section 16-357. The public utility receiving notice shall 14 
mark the approximate location of its underground facilities in such 15 
manner and using such methods, including color coding, as the 16 
authority may prescribe by regulations adopted pursuant to section 16-17 
357. The authority shall prescribe by regulations adopted pursuant to 18 
section 16-357, that any designation or mark made pursuant to this 19  Substitute Bill No. 678

section that includes markings on streets, sidewalks or other surfaces 20 
shall be made with a material that begins to fade not more than three 21 
months after such markings are made. If the actual location of the 22 
underground facilities cannot be established, the person, public agency 23 
or public utility shall so notify the public utility whose facilities may be 24 
affected, which shall provide such further assistance as may be needed 25 
to determine the actual location of the underground facilities in 26 
advance of the proposed excavation, discharge of explosives or 27 
demolition.  28 
This act shall take effect as follows and shall amend the following 
sections: 
 
Section 1 October 1, 2019 16-351

In Section 1, ", as amended by this act" was deleted four times for 
accuracy.
