19	19	AN ACT CONCERNING CO NVEYANCES OF PROPERTY OWNED BY
20	20	A RECIPIENT OF PUBLIC ASSISTANCE.
21	21	Be it enacted by the Senate and House of Representatives in General
22	22	Assembly convened:

24	24	Section 1. Section 17b-85 of the general statutes is repealed and the 1
25	25	following is substituted in lieu thereof (Effective July 1, 2019): 2
26	26	If any person receiving an award for the care of any dependent 3
27	27	child or children, or any person legally liable for the support of such 4
28	28	child or children, or any other person being supported wholly or in 5
29	29	part under the provisions of the state supplement program, medical 6
30	30	assistance program, temporary family assistance program or state-7
31	31	administered general assistance program or any beneficiary under 8
32	32	such provisions or any legally liable relative of such beneficiary, 9
33	33	receives property, wages, income or resources of any kind, such person 10
34	34	or beneficiary, [within] not later than ten days after obtaining 11
35	35	knowledge of or receiving such property, wages, income or resources 12
36	36	of any kind, shall notify the commissioner thereof, orally or in writing, 13
37	37	unless good cause is established for failure to provide such notice, as 14
38	38	determined by the commissioner. No such person or beneficiary shall 15 Raised Bill No. 822

44	44	sell, assign, transfer, encumber or otherwise dispose of any property 16
45	45	without the consent of the commissioner, provided the commissioner 17
46	46	shall not (1) delay a decision on consent for more than ten business 18
47	47	days after receiving a request for consent, or (2) treat as inferior to the 19
48	48	state's interest in the property any sale, assignment, transfer or 20
49	49	encumbrance for which the commissioner's consent was granted and 21
50	50	that was recorded prior to any lien placed by the commissioner on the 22
51	51	property. The provisions of section 17b-137 shall be applicable with 23
52	52	respect to any person applying for or receiving an award under such 24
53	53	provisions. Except for the supplemental nutrition assistance program, 25
54	54	any change in the information which has been furnished on an 26
55	55	application form or a redetermination of eligibility form shall also be 27
56	56	reported to the commissioner, orally or in writing, within ten days of 28
57	57	the occurrence of such change, unless good cause is established for 29
58	58	failure to provide such notice, as determined by the commissioner. For 30
59	59	participants in the supplemental nutrition assistance program, the 31
60	60	commissioner shall establish reporting requirements regarding such 32
61	61	changes in information in accordance with applicable federal law, as 33
62	62	may be amended from time to time. 34
63	63	This act shall take effect as follows and shall amend the following
