LCO No. 3413 1 of 2 General Assembly Raised Bill No. 822 January Session, 2019 LCO No. 3413 Referred to Committee on HUMAN SERVICES Introduced by: (HS) AN ACT CONCERNING CO NVEYANCES OF PROPERTY OWNED BY A RECIPIENT OF PUBLIC ASSISTANCE. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 17b-85 of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective July 1, 2019): 2 If any person receiving an award for the care of any dependent 3 child or children, or any person legally liable for the support of such 4 child or children, or any other person being supported wholly or in 5 part under the provisions of the state supplement program, medical 6 assistance program, temporary family assistance program or state-7 administered general assistance program or any beneficiary under 8 such provisions or any legally liable relative of such beneficiary, 9 receives property, wages, income or resources of any kind, such person 10 or beneficiary, [within] not later than ten days after obtaining 11 knowledge of or receiving such property, wages, income or resources 12 of any kind, shall notify the commissioner thereof, orally or in writing, 13 unless good cause is established for failure to provide such notice, as 14 determined by the commissioner. No such person or beneficiary shall 15 Raised Bill No. 822 LCO No. 3413 2 of 2 sell, assign, transfer, encumber or otherwise dispose of any property 16 without the consent of the commissioner, provided the commissioner 17 shall not (1) delay a decision on consent for more than ten business 18 days after receiving a request for consent, or (2) treat as inferior to the 19 state's interest in the property any sale, assignment, transfer or 20 encumbrance for which the commissioner's consent was granted and 21 that was recorded prior to any lien placed by the commissioner on the 22 property. The provisions of section 17b-137 shall be applicable with 23 respect to any person applying for or receiving an award under such 24 provisions. Except for the supplemental nutrition assistance program, 25 any change in the information which has been furnished on an 26 application form or a redetermination of eligibility form shall also be 27 reported to the commissioner, orally or in writing, within ten days of 28 the occurrence of such change, unless good cause is established for 29 failure to provide such notice, as determined by the commissioner. For 30 participants in the supplemental nutrition assistance program, the 31 commissioner shall establish reporting requirements regarding such 32 changes in information in accordance with applicable federal law, as 33 may be amended from time to time. 34 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 17b-85 Statement of Purpose: To allow for more timely transfers of property owned by a recipient of public assistance.
