LCO No. 4195 1 of 3 General Assembly Raised Bill No. 871 January Session, 2019 LCO No. 4195 Referred to Committee on PUBLIC SAFETY AND SECURITY Introduced by: (PS) AN ACT CONCERNING TH E COLLECTION OF DELINQUENT TAXES AND CHILD SUPPORT FR OM LOTTERY WINNINGS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (a) of section 12-829 of the general statutes is 1 repealed and the following is substituted in lieu thereof (Effective July 2 1, 2019): 3 (a) (1) On [or] and after January 1, 2012, but prior to July 1, 2018, 4 when any person redeems a winning lottery ticket worth five thousand 5 dollars or more at the central office of the Connecticut Lottery 6 Corporation, the Connecticut Lottery Corporation shall check the 7 name and other identifying information of such person against a list of 8 taxpayers who are delinquent, supplied by the Commissioner of 9 Revenue Services. 10 (2) On [or] and after July 1, 2018, but prior to July 1, 2019, when any 11 person redeems a winning lottery ticket worth two thousand dollars or 12 more at the central office of the Connecticut Lottery Corporation, the 13 Connecticut Lottery Corporation shall check the name and other 14 Raised Bill No. 871 LCO No. 4195 2 of 3 identifying information of such person against a list of taxpayers who 15 are delinquent, supplied by the Commissioner of Revenue Services. 16 (3) On and after July 1, 2019, when any person redeems a winning 17 lottery ticket worth six hundred dollars or more at the central office of 18 the Connecticut Lottery Corporation, the Connecticut Lottery 19 Corporation shall check the name and other identifying information of 20 such person against a list of taxpayers who are delinquent, supplied by 21 the Commissioner of Revenue Services. 22 Sec. 2. Subsection (c) of section 52-362d of the general statutes is 23 repealed and the following is substituted in lieu thereof (Effective July 24 1, 2019): 25 (c) When any person redeems a winning lottery ticket worth [five 26 thousand] six hundred dollars or more at the central office of the 27 Connecticut Lottery Corporation, the Connecticut Lottery Corporation 28 shall check the name and other identifying information of such person 29 against a list of obligors supplied by the Commissioner of Social 30 Services. If such person is included on the list of obligors, the 31 Connecticut Lottery Corporation shall request confirmation from the 32 Commissioner of Social Services that such person is in fact an obligor, 33 and upon notification by the Commissioner of Social Services that 34 money is due from any such person as a result of a claim for support 35 which has been assigned to the state pursuant to section 17b-77, or is to 36 be paid to the state acting by and through the IV-D agency, the 37 Connecticut Lottery Corporation shall withhold from any lottery 38 winnings payable to such person under the provisions of chapter 226 39 or chapter 229a the amount of such claim for support owed to an 40 individual for any portion of support which has not been assigned to 41 the state, and then the amount of such claim for support owed to the 42 state, provided the Connecticut Lottery Corporation shall notify such 43 person that (1) lottery winnings have been withheld as a result of the 44 amount due for such support, and (2) such person has the right to a 45 hearing before a hearing officer designated by the Commissioner of 46 Social Services if such person contests the amount of the alleged claim 47 Raised Bill No. 871 LCO No. 4195 3 of 3 for support. The Connecticut Lottery Corporation shall pay any such 48 person in accordance with any decisions of the hearing officer or the 49 court upon appeal of the hearing officer's decision. 50 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 12-829(a) Sec. 2 July 1, 2019 52-362d(c) Statement of Purpose: To reduce the threshold amount to collect lottery winnings for delinquent taxes and child support.
