LCO No. 1292 1 of 10 General Assembly Raised Bill No. 5163 February Session, 2020 LCO No. 1292 Referred to Committee on COMMERCE Introduced by: (CE) AN ACT ELIMINATING CERTAIN INACTIVE ADVISORY GROUPS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 3-110f of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective October 1, 2020): 2 The Commissioner of Economic and Community Development [, 3 with recommendations of the Culture and Tourism Advisory 4 Committee,] shall designate, every three years, a state poet laureate. The 5 commissioner may fill any vacancy by appointment for the unexpired 6 portion of the term vacated. 7 Sec. 2. Subsection (c) of section 4-9a of the general statutes is repealed 8 and the following is substituted in lieu thereof (Effective October 1, 2020): 9 (c) Notwithstanding any provision of law, the term of each member 10 of each board and commission within the executive branch, except the 11 State Board of Education, the Board of Regents for Higher Education, 12 the Commission on Human Rights and Opportunities, the St ate 13 Elections Enforcement Commission, the State Properties Review Board, 14 the Citizen's Ethics Advisory Board, the Commission on Medicolegal 15 Raised Bill No. 5163 LCO No. 1292 2 of 10 Investigations, the Psychiatric Security Review Board, the Commission 16 on Fire Prevention and Control, the E 9-1-1 Commission [, the Culture 17 and Tourism Advisory Committee,] and the board of trustees of each 18 constituent unit of the state system of higher education, commencing on 19 or after July 1, 1979, shall be coterminous with the term of the Governor 20 or until a successor is chosen, whichever is later. 21 Sec. 3. Subsection (a) of section 4b-60 of the general statutes is 22 repealed and the following is substituted in lieu thereof (Effective October 23 1, 2020): 24 (a) There shall be a State Commission on Capitol Preservation and 25 Restoration to consist of twelve members to be appointed as follows: 26 Two members shall be appointed by the Governor, two by the speaker 27 of the House of Representatives, two by the president pro tempore of 28 the Senate, one by the House minority leader, one by the Senate 29 minority leader, two members of the Joint Committee on Legislative 30 Management, one appointed by each of the chairmen of said committee, 31 and one member of the [Culture and Tourism Advisory Committee] 32 Historic Preservation Council appointed by its chairperson. The 33 Commissioner of Administrative Services, or the commissioner's 34 designee, shall be an ex-officio member of the commission and shall 35 attend its meetings. Vacancies on the commission shall be filled by the 36 original appointing authority for the unexpired portion of the term. The 37 members shall serve without compensation for their services but shall 38 be reimbursed for their actual and necessary expenses incurred in the 39 performance of their duties. The commission shall meet at least 40 quarterly, and more often on the call of the chairman or on the written 41 request of a majority of the members. The commission may designate 42 subcommittees to carry out its functions. Any member who fails to 43 attend three consecutive meetings or fails to attend fifty per cent of all 44 meetings held during any calendar year shall be deemed to have 45 resigned. 46 Sec. 4. Subsection (a) of section 4b-66a of the general statutes is 47 repealed and the following is substituted in lieu thereof (Effective October 48 Raised Bill No. 5163 LCO No. 1292 3 of 10 1, 2020): 49 (a) There is established a Connecticut Capitol Center Commission. 50 The commission shall consist of (1) the Secretary of the Office of Policy 51 and Management, or the secretary's designee; (2) the Commissioner of 52 Administrative Services, or the commissioner's designee; (3) the 53 Commissioner of Economic and Community Development, or the 54 commissioner's designee; (4) the chairperson of the [Culture and 55 Tourism Advisory Committee] Historic Preservation Council, or the 56 chairperson's designee; (5) one member appointed by the speaker of the 57 House of Representatives; (6) one member appointed by the president 58 pro tempore of the Senate; (7) one member appointed by the majority 59 leader of the House of Representatives; (8) one member appointed by 60 the majority leader of the Senate; (9) one member appointed by the 61 minority leader of the House of Representatives; (10) one member 62 appointed by the minority leader of the Senate; (11) the chairperson of 63 the Hartford Commission on the City Plan; (12) one member appointed 64 by the mayor of the city of Hartford; and (13) one member from the 65 South Downtown Neighborhood Revitalization Committee. 66 Sec. 5. Subsection (b) of section 10-425 of the general statutes is 67 repealed and the following is substituted in lieu thereof (Effective October 68 1, 2020): 69 (b) Said advisory board shall consist of one member from each of the 70 following entities: (1) The University of Connecticut's Athletic 71 Department; (2) the Connecticut State University System's Athletic 72 Department; (3) the XL Center; (4) Northland AEG; (5) the Traveler's 73 Championship Golf Tournament; (6) the Pilot Pen Tennis Tournament; 74 (7) the Special Olympics; (8) the Mohegan Sun Arena; (9) Foxwoods 75 Resort Casino; (10) Lime Rock Park Race Track; (11) the Arena at Harbor 76 Yard; (12) New Britain Stadium; (13) the Connecticut Marine Trades 77 Association; (14) the Office of Policy and Management; (15) the [Culture 78 and Tourism Advisory Committee] Connecticut Tourism Council; (16) 79 the Capital Region Development Authority; (17) the Nutmeg State 80 Games; (18) the Connecticut Interscholastic Athletic Conference; (19) 81 Raised Bill No. 5163 LCO No. 1292 4 of 10 Fairfield University; (20) Quinnipiac University; (21) Sacred Heart 82 University; (22) any other entity involved in sports or sporting events 83 that the commissioner deems appropriate; (23) the Connecticut State 84 Golf Association; and (24) Dodd Stadium. 85 Sec. 6. Subsection (b) of section 10a-111a of the general statutes is 86 repealed and the following is substituted in lieu thereof (Effective October 87 1, 2020): 88 (b) The State Historian shall: (1) [Be a member of the Culture and 89 Tourism Advisory Committee, established pursuant to section 10-393, 90 (2) edit] Edit or supervise the editing and publication of the public 91 records of the state, [(3)] (2) provide information and advice to members 92 of the government at all levels, [(4)] (3) assist the State Board of 93 Education in efforts to promote the teaching of history in schools and 94 teacher preparation programs, [(5)] (4) respond to requests for advice 95 from historical societies, [(6)] (5) respond to requests for information on 96 the state's history, [(7)] (6) make public appearances and addresses on 97 the state's history, [(8)] (7) prepare bibliographies and other research 98 aids relating to the history of the state, and [(9)] (8) promote by 99 appropriate informative and educational programs the celebration or 100 commemoration of significant historical events. 101 Sec. 7. Subsection (b) of section 11-6a of the general statutes is 102 repealed and the following is substituted in lieu thereof (Effective October 103 1, 2020): 104 (b) There is established an advisory committee to advise the State 105 Library Board with respect to the policies, collections, programs, 106 activities and operations of the Raymond E. Baldwin Museum of 107 Connecticut History and Heritage. The advisory committee shall consist 108 of eight members as follows: The [executive director of the Culture and 109 Tourism Advisory Committee] chairperson of the Historic Preservation 110 Council, or the chairperson's designee; the executive director of the 111 Connecticut Historical Society; the State Historian; and five persons 112 appointed by the Governor, three of whom shall be experienced 113 Raised Bill No. 5163 LCO No. 1292 5 of 10 museum professionals. 114 Sec. 8. Subsection (b) of section 12-376d of the general statutes is 115 repealed and the following is substituted in lieu thereof (Effective October 116 1, 2020): 117 (b) There shall be appointed, as part of the Department of Economic 118 and Community Development, an advisory panel to consider the 119 proposed acceptance of any such work of art. The advisory panel shall 120 prepare a written statement as to acceptance or rejection of any such 121 work of art for the purposes of this section. In each instance, said panel 122 shall consist of eleven members, including the chairperson of the 123 [Culture and Tourism Advisory Committee] Connecticut Arts Council 124 and two generally acknowledged experts as to the particular type of 125 visual art work under consideration, as determined by said chairperson, 126 with such appointments to be made by said chairperson and approved 127 by the [Culture and Tourism Advisory Committee] Connecticut Arts 128 Council. In addition, said advisory panel shall include eight members 129 of the General Assembly, with two of such members appointed by the 130 president pro tempore of the Senate, one of such members appointed by 131 the majority leader of the Senate, one of such members appointed by the 132 minority leader of the Senate, two of such members appointed by the 133 speaker of the House of Representatives, one of such members 134 appointed by the majority leader of the House of Representatives and 135 one of such members appointed by the minority leader of the House of 136 Representatives. 137 Sec. 9. Subsection (a) of section 22a-27s of the general statutes is 138 repealed and the following is substituted in lieu thereof (Effective October 139 1, 2020): 140 (a) There is established the Face of Connecticut Steering Committee, 141 which shall be within the Department of Energy and Environmental 142 Protection for administrative purposes only. Such committee shall 143 direct the expenditure of any funds deposited in the Face of Connecticut 144 account created under section 22a-27t. The committee shall consist of the 145 Raised Bill No. 5163 LCO No. 1292 6 of 10 Commissioner of Energy and Environmental Protection, the 146 Commissioner of Economic and Community Development, or the 147 commissioner's designee, the Commissioner of Agriculture, [the 148 chairperson of the Culture and Tourism Advisory Committee] a 149 member of the Connecticut Tourism Council, appointed by its 150 chairperson, the Secretary of the Office of Policy and Management and 151 ten members as follows: (1) A representative of a local organization 152 involved in historic preservation, appointed by the speaker of the House 153 of Representatives; (2) a representative of a nonprofit organization 154 involved in farmland preservation, appointed by the president pro 155 tempore of the Senate; (3) a representative of a local or regional 156 nonprofit organization involved in the preservation of open space, 157 appointed by the majority leader of the House of Representatives; (4) a 158 representative of a water company actively involved in land 159 preservation, appointed by the majority leader of the Senate; (5) a 160 representative of the agricultural industry, appointed by the minority 161 leader of the House of Representatives; (6) a representative of a state-162 wide nonprofit involved in the preservation of open space, appointed 163 by the minority leader of the Senate; (7) a representative of a state-wide 164 nonprofit organization involved in historic preservation, appointed by 165 the Governor; (8) a representative of an organization involved with 166 community redevelopment, appointed by the Governor; (9) a 167 representative of the legislative Brownfields Task Force, appointed by 168 the speaker of the House of Representatives; and (10) a representative 169 of the environmental law section of the Connecticut Bar Association 170 who is involved with brownfields remediation, appointed by the 171 president pro tempore of the Senate. 172 Sec. 10. Subsection (a) of section 32-1o of the general statutes is 173 repealed and the following is substituted in lieu thereof (Effective October 174 1, 2020): 175 (a) On or before July 1, 2015, and every four years thereafter, the 176 Commissioner of Economic and Community Development, within 177 available appropriations, shall prepare an economic development 178 strategic plan for the state in consultation with the Secretary of the Office 179 Raised Bill No. 5163 LCO No. 1292 7 of 10 of Policy and Management, the Commissioners of Energy and 180 Environmental Protection and Transportation, the Labor 181 Commissioner, [the chairperson of the Culture and Tourism Advisory 182 Committee,] the executive directors of the Connecticut Housing Finance 183 Authority and the Connecticut Health and Educational Facilities 184 Authority, and the chief executive officer of Connecticut Innovations, 185 Incorporated, or their respective designees, and any other agencies the 186 Commissioner of Economic and Community Development deems 187 appropriate. 188 Sec. 11. Section 32-6t of the general statutes is repealed and the 189 following is substituted in lieu thereof (Effective October 1, 2020): 190 On or before October 1, 2012, the Commissioner of Economic and 191 Community Development, in consultation with the [Culture and 192 Tourism Advisory Committee] State Historian, shall develop a program 193 to designate locations in the state with cultural, educational or historical 194 significance as "Connecticut Treasures". Such program shall promote 195 locations designated as Connecticut Treasures or state-owned and 196 operated museums, and shall integrate existing programs of the 197 Department of Economic and Community Development and [Culture 198 and Tourism Advisory Committee] the State Historian in the promotion 199 of such locations to adults and children. Such program shall include a 200 "Connecticut Treasures Passport", which shall provide free or reduced 201 admission to locations designated as Connecticut Treasures and all 202 state-owned and operated museums for children younger than eighteen 203 years of age who are accompanied by an adult. 204 Sec. 12. Section 23-100 of the general statutes is repealed and the 205 following is substituted in lieu thereof (Effective October 1, 2020): 206 As used in sections 23-101, 23-102, as amended by this act, [32-6a,] 32-207 9qq, 32-327 and 32-228, "greenway" means a corridor of open space that 208 (1) may protect natural resources, preserve scenic landscapes and 209 historical resources or offer opportunities for recreation or 210 nonmotorized transportation, (2) may connect existing protected areas 211 Raised Bill No. 5163 LCO No. 1292 8 of 10 and provide access to the outdoors, (3) may be located along a defining 212 natural feature, such as a waterway, along a man-made corridor, 213 including an unused right-of-way, traditional trail routes or historic 214 barge canals or (4) may be a greenspace along a highway or around a 215 village. 216 Sec. 13. Subsection (b) of section 23-102 of the general statutes is 217 repealed and the following is substituted in lieu thereof (Effective October 218 1, 2020): 219 (b) The duties of the council shall be: (1) To advise and assist in the 220 coordination of state agencies, municipalities, regional planning 221 organizations, as defined in section 4-124i, and private citizens in 222 voluntarily planning and implementing a system of greenways; (2) to 223 operate a greenways help center to advise state agencies, municipalities, 224 regional planning organizations, as defined in section 4-124i, and 225 private citizens in the technical aspects of planning, designing and 226 implementing greenways, including advice on securing state, federal 227 and nongovernmental grants; (3) to establish criteria for designation of 228 greenways; (4) to maintain an inventory of greenways in the state which 229 shall include the location of greenways transportation projects which 230 have received grants under sections 23-101, [32-6a,] 32-9qq and 32-328; 231 (5) to advise the Commissioner of Economic and Community 232 Development on the distribution of grants for greenways transportation 233 projects pursuant to sections [32-6a,] 32-9qq and 32-328; and (6) to 234 advise the Commissioner of Energy and Environmental Protection on 235 the distribution of grants pursuant to section 23-101. 236 Sec. 14. Subsection (b) of section 32-1s of the general statutes is 237 repealed and the following is substituted in lieu thereof (Effective October 238 1, 2020): 239 (b) Any order or regulation of the Connecticut Commission on 240 Culture and Tourism, which is in force on July 1, 2011, shall continue in 241 force and effect as an order or regulation of the Department of Economic 242 and Community Development until amended, repealed or superseded 243 Raised Bill No. 5163 LCO No. 1292 9 of 10 pursuant to law. Where any order or regulation of said commission or 244 said department conflicts, the Commissioner of Economic and 245 Community Development may implement policies and procedures 246 consistent with the provisions of this section and sections 3-110f, as 247 amended by this act, 3-110h, 3-110i, 4-9a, as amended by this act, 4-66aa, 248 4-89, 4b-53, 4b-60, as amended by this act, 4b-64, 4b-66a, as amended by 249 this act, 5-198, 7-147a, 7-147b, 7-147c, 7-147j, 7-147p, 7-147q, 7-147y, 8-250 37lll, 10-382, 10-384, 10-385, 10-386, 10-387, 10-388, 10-389, 10-391, 10-251 392, [10-393,] 10-394, 10-395, 10-396, 10-397, 10-397a, 10-399, 10-400, 10-252 401, 10-402, 10-403, 10-404, 10-405, 10-406, 10-408, 10-409, 10-410, 10-411, 253 10-412, 10-413, 10-414, 10-415, 10-416, 10-416a, 10-416b, 10-425, as 254 amended by this act, 10a-111a, as amended by this act, 10a-112, 10a-255 112b, 10a-112g, 11-6a, as amended by this act, 12-376d, as amended by 256 this act, 13a-252, 19a-315b, 19a-315c, 22a-1d, 22a-19b, 22a-27s, as 257 amended by this act, 29-259, [32-6a,] 32-11a and 32-35 while in the 258 process of adopting the policy or procedure in regulation form, 259 provided notice of intention to adopt regulations is printed in the 260 Connecticut Law Journal not later than twenty days after 261 implementation. The policy or procedure shall be valid until the time 262 final regulations are effective. 263 Sec. 15. Sections 10-393, 32-6a, 32-9xx, 32-245 and 32-246 of the 264 general statutes are repealed.
