Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 20-330 of the 2020 supplement to the general 1 statutes is repealed and the following is substituted in lieu thereof 2 (Effective from passage): 3 As used in this chapter: 4 (1) "Contractor" means any person regularly offering to the general 5 public services of such person or such person's employees in the field of 6 electrical work, plumbing and piping work, solar work, heating, piping, 7 cooling and sheet metal work, fire protection sprinkler systems work, 8 elevator installation, repair and maintenance work, irrigation work, 9 automotive glass work or flat glass work, as defined in this section; 10 (2) "Electrical work" means the installation, erection, maintenance, 11 inspection, testing, alteration or repair of any wire, cable, conduit, 12 busway, raceway, support, insulator, conductor, appliance, apparatus, 13 fixture or equipment that generates, transforms, transmits or uses 14 Raised Bill No. 5294 LCO No. 2082 2 of 8 electrical energy for light, heat, power or other purposes, but does not 15 include low voltage wiring, not exceeding twenty-four volts, used 16 within a lawn sprinkler system; 17 (3) "Plumbing and piping work" means the installation, repair, 18 replacement, alteration, maintenance, inspection or testing of gas, water 19 and associated fixtures, tubing and piping mains and branch lines up to 20 and including the closest valve to a machine or equipment used in the 21 manufacturing process, laboratory equipment, sanitary equipment, 22 other than subsurface sewage disposal systems, fire prevention 23 apparatus, all water systems for human usage, sewage treatment 24 facilities and all associated fittings within a building and includes lateral 25 storm and sanitary lines from buildings to the mains, process piping, 26 swimming pools and pumping equipment, and includes making 27 connections to back flow prevention devices, and includes low voltage 28 wiring, not exceeding twenty-four volts, used within a lawn sprinkler 29 system, but does not include (A) solar thermal work performed 30 pursuant to a certificate held as provided in section 20-334g, except for 31 the repair of those portions of a solar hot water heating system that 32 include the basic domestic hot water tank and the tie-in to the potable 33 water system, (B) the installation, repair, replacement, alteration, 34 maintenance, inspection or testing of fire prevention apparatus within a 35 structure, except for standpipes that are not connected to sprinkler 36 systems, (C) medical gas and vacuum systems work, and (D) millwright 37 work. For the purposes of this subdivision, "process piping" means 38 piping or tubing that conveys liquid or gas that is used directly in the 39 production of a chemical or a product for human consumption; 40 (4) "Solar thermal work" means the installation, erection, repair, 41 replacement, alteration, maintenance, inspection or testing of active, 42 passive and hybrid solar systems that directly convert ambient energy 43 into heat or convey, store or distribute such ambient energy; 44 (5) "Heating, piping and cooling work" means (A) the installation, 45 repair, replacement, maintenance, inspection, testing or alteration of 46 any apparatus for piping, appliances, devices or accessories for heating 47 Raised Bill No. 5294 LCO No. 2082 3 of 8 systems, including sheet metal work, (B) the installation, repair, 48 replacement, maintenance, inspection, testing or alteration of air 49 conditioning and refrigeration systems, boilers, including apparatus 50 and piping for the generation or conveyance of steam and associated 51 pumping equipment and process piping and the installation of tubing 52 and piping mains and branch lines up to and including the closest valve 53 to a machine or equipment used in the manufacturing process and 54 onsite testing and balancing of hydronic, steam and combustion air, but 55 excluding millwright work, and (C) on-site operation, by manipulating, 56 adjusting or controlling, with sufficient technical knowledge, as 57 determined by the commissioner, (i) heating systems with a steam or 58 water boiler maximum operating pressure of fifteen pounds per square 59 inch gauge or greater, or (ii) air conditioning or refrigeration systems 60 with an aggregate of more than fifty horsepower or kilowatt 61 equivalency of fifty horsepower or of two hundred pounds of 62 refrigerant. Heating, piping and cooling work does not include solar 63 thermal work performed pursuant to a certificate held as provided in 64 section 20-334g, or medical gas and vacuum systems work or the passive 65 monitoring of heating, air conditioning or refrigeration systems. For the 66 purposes of this subdivision, "process piping" means piping or tubing 67 that conveys liquid or gas that is used directly in the production of a 68 chemical or a product for human consumption; 69 (6) "Apprentice" means any person registered with the Labor 70 Department for the purpose of learning a skilled trade; 71 (7) "Elevator installation, repair and maintenance work" means the 72 installation, erection, maintenance, inspection, testing and repair of all 73 types of elevators, dumb waiters, escalators, and moving walks and all 74 mechanical equipment, fittings, associated piping and wiring from a 75 source of supply brought to the equipment room by an unlimited 76 electrical contractor for all types of machines used to hoist or convey 77 persons or materials, but does not include temporary hoisting machines 78 used for hoisting materials in connection with any construction job or 79 project, provided "elevator inspection" includes the visual examination 80 of an elevator system or portion of a system, with or without the 81 Raised Bill No. 5294 LCO No. 2082 4 of 8 disassembly or removal of component parts; 82 (8) "Elevator maintenance" means the lubrication, inspection, testing 83 and replacement of controls, hoistway and car parts; 84 (9) "Fire protection sprinkler systems work" means the layout, on-site 85 fabrication, installation, alteration, maintenance, inspection, testing or 86 repair of any automatic or manual sprinkler system designed for the 87 protection of the interior or exterior of a building or structure from fire, 88 or any piping or tubing and appurtenances and equipment pertaining 89 to such system including overhead and underground water mains, fire 90 hydrants and hydrant mains, standpipes and hose connections to 91 sprinkler systems, sprinkler tank heaters excluding electrical wiring, air 92 lines and thermal systems used in connection with sprinkler and alarm 93 systems connected thereto, foam extinguishing systems or special 94 hazard systems including water spray, foam, carbon dioxide or dry 95 chemical systems, halon and other liquid or gas fire suppression 96 systems, but does not include (A) any engineering design work 97 connected with the layout of fire protection sprinkler systems, or (B) any 98 work performed by employees of or contractors hired by a public water 99 system, as defined in subsection (a) of section 25-33d; 100 (10) "State Fire Marshal" means the State Fire Marshal appointed by 101 the Commissioner of Administrative Services; 102 (11) "Journeyman sprinkler fitter" means a specialized pipe fitter 103 craftsman, experienced and skilled in the installation, alteration, 104 maintenance and repair of fire protection sprinkler systems; 105 (12) "Irrigation work" means making the connections to and the 106 inspection and testing of back flow prevention devices, and low voltage 107 wiring, not exceeding twenty-four volts, used within a lawn sprinkler 108 system; 109 (13) "Sheet metal work" means the onsite layout, installation, erection, 110 replacement, repair or alteration, including, but not limited to, onsite 111 testing and balancing of related life safety components, environmental 112 Raised Bill No. 5294 LCO No. 2082 5 of 8 air, heating, ventilating and air conditioning systems by manipulating, 113 adjusting or controlling such systems for optimum balance performance 114 of any duct work system, ferrous, nonferrous or other material for 115 ductwork systems, components, devices, air louvers or accessories, in 116 accordance with the State Building Code; 117 (14) "Journeyman sheet metal worker" means an experienced 118 craftsman skilled in the installation, erection, replacement, repair or 119 alteration of duct work systems, both ferrous and nonferrous; 120 (15) "Automotive glass work" means installing, maintaining or 121 repairing fixed glass in motor vehicles; 122 (16) "Flat glass work" means installing, maintaining or repairing glass 123 in residential or commercial structures; 124 (17) "Medical gas and vacuum systems work" means the work and 125 practice, materials, instrumentation and fixtures used in the 126 construction, installation, alteration, extension, removal, repair, 127 maintenance, inspection, testing or renovation of gas and vacuum 128 systems and equipment used solely to transport gases for medical 129 purposes and to remove liquids, air-gases or solids from such systems; 130 (18) "Solar electricity work" means the installation, erection, repair, 131 replacement, alteration, maintenance, inspection and testing of 132 photovoltaic or wind generation equipment used to distribute or store 133 ambient energy for heat, light, power or other purposes to a point 134 immediately inside any structure or adjacent to an end use; 135 (19) "Active solar system" means a system that uses an external source 136 of energy to power a motor-driven fan or pump to force the circulation 137 of a fluid through solar heat collectors and which removes the sun's heat 138 from the collectors and transports such heat to a location where it may 139 be used or stored; 140 (20) "Passive solar system" means a system that is capable of 141 collecting or storing the sun's energy as heat without the use of a motor-142 Raised Bill No. 5294 LCO No. 2082 6 of 8 driven fan or pump; 143 (21) "Hybrid solar system" means a system that contains components 144 of both an active solar system and a passive solar system; 145 (22) "Gas hearth product work" means the installation, service, 146 inspection, testing or repair of a propane or natural gas fired fireplace, 147 fireplace insert, stove or log set and associated venting and piping that 148 simulates a flame of a solid fuel fire. "Gas hearth product work" does 149 not include (A) fuel piping work, (B) the servicing of fuel piping, or (C) 150 work associated with pressure regulating devices, except for appliances 151 gas valves; 152 (23) "Millwright work" means the installation, repair, replacement, 153 maintenance or alteration, including the inspection and testing, of (A) 154 power generation machinery, or (B) industrial machinery, including the 155 related interconnection of piping and tubing used in the manufacturing 156 process, but does not include the performance of any action for which 157 licensure is required under this chapter; 158 (24) "Inspection" means the examination of a system or portion of a 159 system, involving the disassembly or removal of component parts of the 160 system; [and] 161 (25) "Testing" means to determine the status of a system as intended 162 for its use, with or without the disassembly of component parts of the 163 system, by the use of testing and measurement instruments; [.] 164 (26) "Auto glass temporary license" means a temporary license 165 granted by the commissioner to an auto glass company doing business 166 in this state that employs individuals who perform automotive glass 167 work; 168 (27) "Auto glass company" means a company that provides auto glass 169 repair or replacement services; and 170 (28) "State disaster or emergency" means a disaster or an emergency 171 event for which: (A) The Governor has issued a proclamation of a 172 Raised Bill No. 5294 LCO No. 2082 7 of 8 disaster or an emergency pursuant to chapter 517, (B) the President of 173 the United States has issued a declaration of the existence in the state of 174 a major disaster or an emergency, or (C) in the opinion of the 175 Commissioner of Consumer Protection, warrants the need for auto glass 176 temporary licenses. 177 Sec. 2. Section 20-333a of the general statutes is repealed and the 178 following is substituted in lieu thereof (Effective from passage): 179 (a) The Commissioner of Consumer Protection may, upon the 180 payment of the appropriate fee, as provided in section 20-335, grant a 181 license or a card of registration provided for in this chapter, without an 182 examination, to any currently practicing, competent person who holds 183 a similar license or card of registration granted by any other state, 184 licensure jurisdiction within another state, the District of Columbia or 185 any territory or commonwealth of the United States having licensure or 186 registration requirements substantially similar to, or higher than, those 187 of this state, if the licensing authority in such other state, licensure 188 jurisdiction within another state, the District of Columbia or any 189 territory or commonwealth of the United States may grant such similar 190 license or card of registration, without an examination, to any currently 191 practicing, competent licensee or registrant from this state. The 192 commissioner, in consultation with the appropriate examining board, 193 may adopt regulations in accordance with the provisions of chapter 54 194 in order to carry out the provisions of this section. 195 (b) (1) The Commissioner of Consumer Protection may, in the event 196 of a state disaster or emergency, and upon payment of an eighteen 197 hundred dollar licensing fee, grant an annual auto glass temporary 198 license to an auto glass company that employs individuals who perform 199 automotive glass work and does business in the state. Such temporary 200 license shall be utilized by an auto glass company that employs out-of- 201 state employees who (A) perform automotive glass work, and (B) whose 202 qualifications are substantially similar to, or higher than, those of this 203 state. Holders of an auto glass temporary license shall, upon initial 204 application and renewal, provide a list to the department, on a form 205 Raised Bill No. 5294 LCO No. 2082 8 of 8 prescribed by the commissioner, listing the out-of-state employees that 206 such company may utilize to perform work in this state in the event of 207 a state disaster or emergency. 208 (2) In the case of a state disaster or emergency, an auto glass company 209 with a valid auto glass temporary license shall notify the department 210 within thirty days of each declared state disaster or emergency of its 211 intent to use not more than fifteen out-of-state employees, as listed on 212 their license application. Such temporary license shall be used for no 213 longer than fourteen calendar days for each declared state disaster or 214 emergency. 215 This act shall take effect as follows and shall amend the following sections: Section 1 from passage 20-330 Sec. 2 from passage 20-333a Statement of Purpose: To establish an auto glass temporary license to allow auto glass companies doing business in the state to perform auto glass work in the event of a state disaster or emergency.
