2020 AN ACT CONCERNING DE PARTMENT OF SOCIAL S ERVICES'

2222 Be it enacted by the Senate and House of Representatives in General

2525 Section 1. Subsection (c) of section 17b-99 of the general statutes is 1
2626 repealed and the following is substituted in lieu thereof (Effective July 1, 2
2727 2020): 3
2828 (c) The Department of Social Services shall distribute to all vendors 4
2929 who are providers in the medical assistance program a copy of the rules, 5
3030 regulations, standards and laws governing the program. The 6
3131 Commissioner of Social Services shall adopt by regulation in [the 7
3232 manner provided for in] accordance with sections 4-166 to 4-176, 8
3333 inclusive, administrative sanctions against public assistance providers, 9
3434 [in the Medicare program or Medicaid program or aid to families with 10
3535 dependent children program or state-funded child care program or 11
3636 state-administered general assistance program or temporary family 12
3737 assistance program or state supplement to the federal Supplemental 13
3838 Security Income Program] including, but not limited to, suspension 14

4545 or law. The commissioner may adopt regulations in accordance with the 16
4646 provisions of chapter 54 to provide for the withholding of payments 17
4747 currently due in order to offset money previously obtained as the result 18
4848 of error or fraud provided payments shall not be withheld unless the 19
4949 provider is given the opportunity for a hearing pursuant to regulations 20
5050 adopted by the commissioner under this section for administrative 21
5151 sanctions. No suspension from the program, including a payment 22
5252 suspension pursuant to federal law, that imposes or increases the 23
5353 amount withheld by the commissioner from payments to a provider 24
5454 shall be imposed until after a decision by a hearing officer. The 25
5555 department shall notify the proper professional society and licensing 26
5656 agency of any violations of this section. For purposes of this subsection, 27
5757 "public assistance" means the following programs: Medicare, Medicaid, 28
5858 state-funded child care, state-administered general assistance, 29
5959 temporary family assistance or the state supplement to the federal 30
6060 Supplemental Security Income program. 31
