LCO No. 2059 1 of 2 General Assembly Raised Bill No. 5307 February Session, 2020 LCO No. 2059 Referred to Committee on HUMAN SERVICES Introduced by: (HS) AN ACT CONCERNING DE PARTMENT OF SOCIAL S ERVICES' PAYMENT SUSPENSIONS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (c) of section 17b-99 of the general statutes is 1 repealed and the following is substituted in lieu thereof (Effective July 1, 2 2020): 3 (c) The Department of Social Services shall distribute to all vendors 4 who are providers in the medical assistance program a copy of the rules, 5 regulations, standards and laws governing the program. The 6 Commissioner of Social Services shall adopt by regulation in [the 7 manner provided for in] accordance with sections 4-166 to 4-176, 8 inclusive, administrative sanctions against public assistance providers, 9 [in the Medicare program or Medicaid program or aid to families with 10 dependent children program or state-funded child care program or 11 state-administered general assistance program or temporary family 12 assistance program or state supplement to the federal Supplemental 13 Security Income Program] including, but not limited to, suspension 14 from the program, for any violations of the rules, regulations, standards 15 Raised Bill No. 5307 LCO No. 2059 2 of 2 or law. The commissioner may adopt regulations in accordance with the 16 provisions of chapter 54 to provide for the withholding of payments 17 currently due in order to offset money previously obtained as the result 18 of error or fraud provided payments shall not be withheld unless the 19 provider is given the opportunity for a hearing pursuant to regulations 20 adopted by the commissioner under this section for administrative 21 sanctions. No suspension from the program, including a payment 22 suspension pursuant to federal law, that imposes or increases the 23 amount withheld by the commissioner from payments to a provider 24 shall be imposed until after a decision by a hearing officer. The 25 department shall notify the proper professional society and licensing 26 agency of any violations of this section. For purposes of this subsection, 27 "public assistance" means the following programs: Medicare, Medicaid, 28 state-funded child care, state-administered general assistance, 29 temporary family assistance or the state supplement to the federal 30 Supplemental Security Income program. 31 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2020 17b-99(c) Statement of Purpose: To give providers of social services due process protections before payment is suspended by the Department of Social Services.
