2121 AN ACT CONCERNING TH E ORGANIZATIONAL STR UCTURE AND
2222 BYLAWS OF THE MILITIA UNITS AND THE MAXIMUM RETIREMENT
2323 AGE FOR MEMBERS SERV ING AS MUSICIANS IN BANDS OF THE
2424 GOVERNOR'S FOOT GUAR DS.
2525 Be it enacted by the Senate and House of Representatives in General

2828 Section 1. Section 27-79 of the general statutes is repealed and the 1
2929 following is substituted in lieu thereof (Effective October 1, 2020): 2
3030 [Each organization of the armed forces of the state shall make bylaws 3
3131 for its government, which shall be binding on its members when 4
3232 approved by the regimental or corresponding commander and the 5
3333 Adjutant General; and all fines and dues imposed by such bylaws may 6
3434 be collected in accordance with such procedure as the Adjutant General 7
3535 may, by regulation, prescribe, provided notice shall be given to any 8
3636 delinquent of the incurrence of any fine or dues within thirty days of the 9
3737 date when the same has been incurred and notice may be given 10
3838 collectively of such fines or dues or both. The commanding officer of the 11
3939 organization shall be the president of the association created in the 12
4040 bylaws, except that, if two or more organizations combine in one 13

4747 treasurer shall be elected from the enlisted personnel of the organization 15
4848 or, if two or more organizations combine, from among the enlisted 16
4949 personnel of one of the organizations. The treasurer of each such 17
5050 organization shall give a bond to such organization in an amount 18
5151 satisfactory to the Adjutant General. The premium on such bond shall 19
5252 be paid by such organization.] The Governor shall determine the 20
5353 organizational structure of the militia units pursuant to section 27-14. 21
5454 Each militia unit shall be composed in a manner consistent with 22
5555 National Guard or federal military units of similar composition, size and 23
5656 purpose. The Adjutant General may adopt bylaws for the 24
5757 administration of the militia units. 25
5858 Sec. 2. Subsection (a) of section 27-53 of the general statutes is 26
5959 repealed and the following is substituted in lieu thereof (Effective October 27
6060 1, 2020): 28
6161 (a) When a member of the armed forces of the state or the Governor's 29
6262 military staff, whose service has been honorable, has served ten years, 30
6363 he or she may, if he or she makes a timely application to the Adjutant 31
6464 General through the chain of command prior to such member's 32
6565 retirement date, be retired from active service and placed upon the 33
6666 retired list. Such retirement shall be in the highest grade in which he or 34
6767 she has served. When such service equals or exceeds twenty years, he or 35
6868 she may, upon his or her application to the Adjutant General, through 36
6969 the chain of command prior to such member's retirement date, be 37
7070 commissioned at or promoted to the next higher grade than the highest 38
7171 grade at which he or she may have held at any time, either in the armed 39
7272 forces of the state or the Governor's military staff or the armed forces of 40
7373 the United States, which higher grade shall not be above the grade of a 41
7474 brigadier general or sergeant major, and shall thereafter be placed upon 42
7575 the retired list with such grade. Members may only receive the 43
7676 retirement promotion provided under this section one time. In 44
7777 determining such term of service of twenty years, there may be added 45
7878 to any term of not less than ten years' service in the armed forces of the 46
7979 state or the Governor's military staff the term of service with the armed 47

8686 shall be obligatory for all members reaching the age of sixty-four years 49
8787 or as required for members of the National Guard and naval militia by 50
8888 laws and regulations pertaining thereto, except that members serving as 51
8989 musicians in bands of the first and second companies of the Governor's 52
9090 Foot Guards may serve until reaching the age of seventy years. 53
