LCO No. 1898 1 of 3 General Assembly Raised Bill No. 5397 February Session, 2020 LCO No. 1898 Referred to Committee on VETERANS' AFFAIRS Introduced by: (VA) AN ACT CONCERNING TH E ORGANIZATIONAL STR UCTURE AND BYLAWS OF THE MILITIA UNITS AND THE MAXIMUM RETIREMENT AGE FOR MEMBERS SERV ING AS MUSICIANS IN BANDS OF THE GOVERNOR'S FOOT GUAR DS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 27-79 of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective October 1, 2020): 2 [Each organization of the armed forces of the state shall make bylaws 3 for its government, which shall be binding on its members when 4 approved by the regimental or corresponding commander and the 5 Adjutant General; and all fines and dues imposed by such bylaws may 6 be collected in accordance with such procedure as the Adjutant General 7 may, by regulation, prescribe, provided notice shall be given to any 8 delinquent of the incurrence of any fine or dues within thirty days of the 9 date when the same has been incurred and notice may be given 10 collectively of such fines or dues or both. The commanding officer of the 11 organization shall be the president of the association created in the 12 bylaws, except that, if two or more organizations combine in one 13 association, the senior commanding officer shall be president. The 14 Raised Bill No. 5397 LCO No. 1898 2 of 3 treasurer shall be elected from the enlisted personnel of the organization 15 or, if two or more organizations combine, from among the enlisted 16 personnel of one of the organizations. The treasurer of each such 17 organization shall give a bond to such organization in an amount 18 satisfactory to the Adjutant General. The premium on such bond shall 19 be paid by such organization.] The Governor shall determine the 20 organizational structure of the militia units pursuant to section 27-14. 21 Each militia unit shall be composed in a manner consistent with 22 National Guard or federal military units of similar composition, size and 23 purpose. The Adjutant General may adopt bylaws for the 24 administration of the militia units. 25 Sec. 2. Subsection (a) of section 27-53 of the general statutes is 26 repealed and the following is substituted in lieu thereof (Effective October 27 1, 2020): 28 (a) When a member of the armed forces of the state or the Governor's 29 military staff, whose service has been honorable, has served ten years, 30 he or she may, if he or she makes a timely application to the Adjutant 31 General through the chain of command prior to such member's 32 retirement date, be retired from active service and placed upon the 33 retired list. Such retirement shall be in the highest grade in which he or 34 she has served. When such service equals or exceeds twenty years, he or 35 she may, upon his or her application to the Adjutant General, through 36 the chain of command prior to such member's retirement date, be 37 commissioned at or promoted to the next higher grade than the highest 38 grade at which he or she may have held at any time, either in the armed 39 forces of the state or the Governor's military staff or the armed forces of 40 the United States, which higher grade shall not be above the grade of a 41 brigadier general or sergeant major, and shall thereafter be placed upon 42 the retired list with such grade. Members may only receive the 43 retirement promotion provided under this section one time. In 44 determining such term of service of twenty years, there may be added 45 to any term of not less than ten years' service in the armed forces of the 46 state or the Governor's military staff the term of service with the armed 47 forces of the United States, either active, inactive or reserve. Retirement 48 Raised Bill No. 5397 LCO No. 1898 3 of 3 shall be obligatory for all members reaching the age of sixty-four years 49 or as required for members of the National Guard and naval militia by 50 laws and regulations pertaining thereto, except that members serving as 51 musicians in bands of the first and second companies of the Governor's 52 Foot Guards may serve until reaching the age of seventy years. 53 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2020 27-79 Sec. 2 October 1, 2020 27-53(a) Statement of Purpose: To require the Governor to determine the structure of the militia units and authorize the Adjutant General to issue bylaws for the militia, and to increase the maximum retirement age for members serving as musicians in bands of the Governor's Foot Guards.
