LCO No. 2634 1 of 3 General Assembly Raised Bill No. 407 February Session, 2020 LCO No. 2634 Referred to Committee on PUBLIC SAFETY AND SECURITY Introduced by: (PS) AN ACT CONCERNING AG RICULTURAL FAIRS AND STATE POLICE OFFICERS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 29-5 of the 2020 supplement to the general statutes 1 is repealed and the following is substituted in lieu thereof (Effective July 2 1, 2020): 3 (a) The Commissioner of Emergency Services and Public Protection 4 may, within available appropriations, appoint suitable persons from the 5 regular state police force as resident state [policemen] police officers in 6 addition to the regular state police force to be employed and 7 empowered as state [policemen] police officers in any town or two or 8 more adjoining towns lacking an organized police force, and such 9 officers may be detailed by said commissioner as resident state 10 [policemen] police officers for regular assignment to such towns, 11 provided (1) each town shall (A) pay eighty-five per cent of the cost of 12 compensation, maintenance and other expenses of the first two state 13 [policemen] police officers detailed to such town, and one hundred per 14 cent of such costs of compensation, maintenance and other expenses for 15 Raised Bill No. 407 LCO No. 2634 2 of 3 any additional state [policemen] police officers detailed to such town; [, 16 provided further such town shall] and (B) pay one hundred per cent of 17 any overtime costs and such portion of fringe benefits directly 18 associated with such overtime costs, except for the fiscal year ending 19 June 30, 2020, and for each fiscal year thereafter, fifty per cent of the 20 portion of the state employees' retirement system fringe recovery rate 21 attributable to the unfunded liability of said system shall be paid by the 22 Comptroller from the resources appropriated for State Comptroller-23 State Employees' Retirement System Unfunded Liability; and (2) during 24 an agricultural fair in a town, the town or the organization that sponsors 25 the agricultural fair shall pay eighty-five per cent of the cost of 26 compensation, maintenance and other expenses of the state police 27 officers providing on-site security for the fair and traffic control on 28 public roads during such fair. Such town or towns and the 29 Commissioner of Emergency Services and Public Protection are 30 authorized to enter into agreements and contracts for such police 31 services, with the approval of the Attorney General, for periods not 32 exceeding two years. 33 (b) Notwithstanding the provisions of subsection (a) of this section, 34 the Commissioner of Emergency Services and Public Protection shall 35 appoint a resident state policeman to serve in a pilot program 36 assignment for two towns lacking an organized police force or 37 constabulary and located within the jurisdiction of the same state police 38 troop pursuant to a memorandum of agreement with towns requesting 39 participation in the pilot program. Towns participating in the pilot 40 program shall be responsible for the costs and expenses of such resident 41 state policeman as provided in subsection (a) of this section. 42 (c) The Commissioner of Emergency Services and Public Protection 43 shall exercise such supervision and direction over any resident 44 policeman so appointed as said commissioner deems necessary, and 45 each appointee shall be required to conform to the requirements of 46 chapter 67. Each resident state policeman shall have the same powers as 47 officers of the regular state police force and be entitled to the same rights 48 and subject to the same rules and regulations as the Division of State 49 Raised Bill No. 407 LCO No. 2634 3 of 3 Police within the Department of Emergency Services and Public 50 Protection. 51 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2020 29-5 Statement of Purpose: To limit the reimbursement rate for state police officers providing on- site security and traffic control related to agricultural fairs in towns with resident state troopers.
