14	19		AN ACT CONCERNING TH E ONLINE SALE AND DELIVERY OF
15	20		ELECTRONIC NICOTINE DELIVERY SYSTEMS AND VAPOR
16	21		PRODUCTS.
17	22		Be it enacted by the Senate and House of Representatives in General
18	23		Assembly convened:

20	25		Section 1. Section 21a-418 of the general statutes is repealed and the 1
21	26		following is substituted in lieu thereof (Effective July 1, 2021): 2
22	27		(a) As used in this section: 3
23	28		(1) "Person" means any individual, firm, fiduciary, partnership, 4
24	29		corporation, limited liability company, trust or association, however 5
25	30		formed; 6
26		-	(2) "Electronic cigarette liquid" has the same meaning as provided in 7
27		-	section 21a-415; 8
28		-	[(2)] (3) "Electronic nicotine delivery system" has the same meaning 9
29		-	as provided in section 21a-415; and 10
30		-	[(3)] (4) "Vapor product" has the same meaning as provided in section 11
31		-	21a-415. 12
32		-	(b) A person with an electronic nicotine delivery system certificate of 13
33		-	dealer registration, when selling and shipping an electronic nicotine 14 Substitute Bill No. 6110
	31	+	(2) "Electronic nicotine delivery system" has the same meaning as 7
	32	+	provided in section 21a-415; and 8
	33	+	(3) "Vapor product" has the same meaning as provided in section 21a-9

	35	+	(b) A person with an electronic nicotine delivery system certificate of 11

40		-	delivery system or a vapor product directly to a consumer in the state, 15
41		-	shall: (1) [Ensure] At the time of sale (A) require such consumer to 16
42		-	provide a copy of such consumer's valid motor vehicle operator's license 17
43		-	or valid identity card, as described in section 1-1h, or (B) verify such 18
44		-	consumer's identity on a commercially available third-party database 19
45		-	used for the purpose of age verification by business entities; (2) ensure 20
46		-	that the name on such consumer's valid motor vehicle operator's license 21
47		-	or valid identity card or verified on such database is identical to the 22
48		-	name on the credit card, charge card, debit card or other method of 23
49		-	payment used to purchase such system or product at the time of sale; (3) 24
50		-	ensure that the shipping labels on all containers of an electronic nicotine 25
51		-	delivery system or vapor product [shipped directly to a consumer in the 26
52		-	state conspicuously states] conspicuously state the following: 27
53		-	"CONTAINS AN ELECTRONIC NICOTINE DELIV ERY SYSTEM OR 28
54		-	VAPOR PRODUCT —SIGNATURE OF A PERSON AGE 21 OR OLDER 29
55		-	REQUIRED FOR DELIVERY"; and [(2)] (4) obtain the signature of a 30
56		-	person [age] twenty-one years of age or older at the shipping address 31
57		-	prior to delivery, after requiring the signer to demonstrate that he or she 32
58		-	is age twenty-one or older by providing a valid motor vehicle operator's 33
59		-	license or a valid identity card. [described in section 1-1h] No person 34
60		-	with an electronic nicotine delivery system certificate of dealer 35
61		-	registration shall sell or ship to a consumer in the state more than two 36
62		-	vapor products and thirty cartridges of electronic cigarette liquid in a 37
63		-	thirty-day period. 38

	42	+	delivery system or a vapor product directly to a consumer in the state, 13
	43	+	shall: (1) [Ensure] Require such consumer to provide a copy of such 14

	45	+	as described in section 1-1h, at the time of sale; (2) ensure that the name 16
	46	+	on such consumer's valid motor vehicle operator's license or valid 17
	47	+	identity card is identical to the name on the credit card, charge card, 18
	48	+	debit card or other method of payment used to purchase such system or 19
	49	+	product at the time of sale; (3) ensure that the shipping labels on all 20
	50	+	containers of an electronic nicotine delivery system or vapor product 21
	51	+	[shipped directly to a consumer in the state conspicuously states] 22
	52	+	conspicuously state the following: "CONTAINS AN ELECTRONIC 23
	53	+	NICOTINE DELIVERY SYSTEM OR VAPOR PRODUCT —24
	54	+	SIGNATURE OF A PERSON AGE 21 OR OLDER REQUIRED FOR 25
	55	+	DELIVERY"; and [(2)] (4) obtain the signature of a person [age] twenty-26
	56	+	one years of age or older at the shipping address prior to delivery, after 27
	57	+	requiring the signer to demonstrate that he or she is age twenty-one or 28
	58	+	older by providing a valid motor vehicle operator's license or a valid 29
	59	+	identity card. [described in section 1-1h.] 30
64	60		This act shall take effect as follows and shall amend the following

	65	+	Statement of Purpose:
	66	+	To require online sellers of electronic nicotine delivery systems and
	67	+	vapor products to require purchasers of such systems and products to
	68	+	(1) provide identification at the time of purchase, and (2) ensure that the
	69	+	name on such identification matches the name on the method of
	70	+	payment used to make the purchase.
