27 | 26 | | Section 1. Section 7-438 of the general statutes is repealed and the 1 |
---|
28 | 27 | | following is substituted in lieu thereof (Effective October 1, 2021): 2 |

29 | 28 | | (a) Any member retired under this part who again accepts 3 |
---|
30 | 29 | | employment from [this] the state or from any municipality of [this] the 4 |
---|
31 | 30 | | state, other than a participating municipality, shall continue to receive 5 |
---|
32 | 31 | | his or her retirement allowance while so employed, and shall be eligible 6 |
---|
33 | 32 | | to participate, and shall be entitled to credit, in the state retirement 7 |
---|
34 | 33 | | system for the period of such state employment, but [any such member] 8 |
---|
35 | 34 | | he or she shall not be eligible to participate or be entitled to credit in any 9 |
---|
36 | 35 | | municipal retirement system for the period of such municipal 10 |
---|
37 | 36 | | employment. 11 |
---|
38 | 37 | | (b) If a member is retired under this part and again accepts 12 |
---|
47 | 45 | | to participate, and shall be entitled to credit, in the municipal employees' 15 |
---|
48 | 46 | | retirement system for the period of such municipal employment. Such 16 |
---|
49 | 47 | | member shall receive no retirement allowance while so employed 17 |
---|
50 | 48 | | except if (1) such employment is for less than twenty hours per week, or 18 |
---|
51 | 49 | | (2) his or her services are rendered for not more than ninety working 19 |
---|
52 | 50 | | days in any one calendar year, provided that any member reemployed 20 |
---|
53 | 51 | | for a period of more than ninety working days in one calendar year shall 21 |
---|
54 | 52 | | reimburse the Municipal Employees' Retirement Fund for retirement 22 |
---|
55 | 53 | | income payments received during such ninety working days. 23 |
---|
56 | 54 | | (c) Notwithstanding the provisions of subsection (b) of this section, if 24 |
---|
57 | 55 | | a uniformed member of a paid municipal fire department or a regular 25 |
---|
58 | 56 | | member of a paid municipal police department is retired under this part 26 |
---|
59 | 57 | | and subsequently accepts employment of a public safety nature from 27 |
---|
60 | 58 | | any school district or regional school district, which district is a 28 |
---|
61 | 59 | | participating municipality, he or she shall continue to receive his or her 29 |
---|
62 | 60 | | retirement allowance while so subsequently employed, but he or she 30 |
---|
63 | 61 | | shall not be eligible to further participate or be entitled to additional 31 |
---|
64 | 62 | | credit in the municipal employees' retirement system for the period of 32 |
---|
