2020 AN ACT REVISING DATA COLLECTION REQUIREM ENTS FOR
2121 HEALTH CARE PROVIDER S CONNECTING TO THE STATE-WIDE
2222 HEALTH INFORMATION E XCHANGE.
2323 Be it enacted by the Senate and House of Representatives in General
2424 Assembly convened:

2626 Section 1. Section 17b-59e of the general statutes is repealed and the 1
2727 following is substituted in lieu thereof (Effective October 1, 2021): 2
2828 (a) For purposes of this section: 3
2929 (1) "Health care provider" means any individual, corporation, facility 4
3030 or institution licensed by the state to provide health care services; and 5
3131 (2) "Electronic health record system" means a computer-based 6
3232 information system that is used to create, collect, store, manipulate, 7
3333 share, exchange or make available electronic health records for the 8
3434 purposes of the delivery of patient care. 9
3535 (b) Not later than one year after commencement of the operation of 10
3636 the State-wide Health Information Exchange, each hospital licensed 11
3737 under chapter 368v and clinical laboratory licensed under section 19a-12 Raised Bill No. 6424

4343 30 shall maintain an electronic health record system capable of 13
4444 connecting to and participating in the State-wide Health Information 14
4545 Exchange and shall apply to begin the process of connecting to, and 15
4646 participating in, the State-wide Health Information Exchange. 16
4747 (c) Not later than two years after commencement of the operation of 17
4848 the State-wide Health Information Exchange, (1) each health care 18
4949 provider with an electronic health record system capable of connecting 19
5050 to, and participating in, the State-wide Health Information Exchange 20
5151 shall apply to begin the process of connecting to, and participating in, 21
5252 the State-wide Health Information Exchange, and (2) each health care 22
5353 provider without an electronic health record system capable of 23
5454 connecting to, and participating in, the State-wide Health Information 24
5555 Exchange shall be capable of sending and receiving secure messages 25
5656 that comply with the Direct Project specifications published by the 26
5757 federal Office of the National Coordinator for Health Information 27
5858 Technology. 28
5959 (d) Each health care provider with an electronic health record system 29
6060 capable of connecting to, and participating in, the State-wide Health 30
6161 Information Exchange shall, not later than the date by which such 31
6262 hospital or health care provider is required to connect to the State-wide 32
6363 Health Information Exchange, collect and include in its electronic health 33
6464 record system self-reported patient demographic data including, but 34
6565 not limited to, race, ethnicity, primary language, insurance status and 35
6666 disability status. 36
6767 (e) Each health care provider required to connect to the State-wide 37
6868 Health Information Exchange pursuant to this section shall adhere to 38
6969 the data collection standards promulgated by the U.S. Department of 39
7070 Health and Human Services' Office of Minority Health, as amended 40
7171 from time to time. 41
7272 This act shall take effect as follows and shall amend the following
