LCO No. 2941 1 of 3 General Assembly Raised Bill No. 6424 January Session, 2021 LCO No. 2941 Referred to Committee on PUBLIC HEALTH Introduced by: (PH) AN ACT REVISING DATA COLLECTION REQUIREM ENTS FOR HEALTH CARE PROVIDER S CONNECTING TO THE STATE-WIDE HEALTH INFORMATION E XCHANGE. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 17b-59e of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective October 1, 2021): 2 (a) For purposes of this section: 3 (1) "Health care provider" means any individual, corporation, facility 4 or institution licensed by the state to provide health care services; and 5 (2) "Electronic health record system" means a computer-based 6 information system that is used to create, collect, store, manipulate, 7 share, exchange or make available electronic health records for the 8 purposes of the delivery of patient care. 9 (b) Not later than one year after commencement of the operation of 10 the State-wide Health Information Exchange, each hospital licensed 11 under chapter 368v and clinical laboratory licensed under section 19a-12 Raised Bill No. 6424 LCO No. 2941 2 of 3 30 shall maintain an electronic health record system capable of 13 connecting to and participating in the State-wide Health Information 14 Exchange and shall apply to begin the process of connecting to, and 15 participating in, the State-wide Health Information Exchange. 16 (c) Not later than two years after commencement of the operation of 17 the State-wide Health Information Exchange, (1) each health care 18 provider with an electronic health record system capable of connecting 19 to, and participating in, the State-wide Health Information Exchange 20 shall apply to begin the process of connecting to, and participating in, 21 the State-wide Health Information Exchange, and (2) each health care 22 provider without an electronic health record system capable of 23 connecting to, and participating in, the State-wide Health Information 24 Exchange shall be capable of sending and receiving secure messages 25 that comply with the Direct Project specifications published by the 26 federal Office of the National Coordinator for Health Information 27 Technology. 28 (d) Each health care provider with an electronic health record system 29 capable of connecting to, and participating in, the State-wide Health 30 Information Exchange shall, not later than the date by which such 31 hospital or health care provider is required to connect to the State-wide 32 Health Information Exchange, collect and include in its electronic health 33 record system self-reported patient demographic data including, but 34 not limited to, race, ethnicity, primary language, insurance status and 35 disability status. 36 (e) Each health care provider required to connect to the State-wide 37 Health Information Exchange pursuant to this section shall adhere to 38 the data collection standards promulgated by the U.S. Department of 39 Health and Human Services' Office of Minority Health, as amended 40 from time to time. 41 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2021 17b-59e Raised Bill No. 6424 LCO No. 2941 3 of 3 Statement of Purpose: To clarify and standardize race, ethnicity and language data collection for health care providers required to connect to the State-wide Health Information Exchange.
