1622 Be it enacted by the Senate and House of Representatives in General

19-Section 1. (NEW) (Effective January 1, 2022) (a) Each individual health 1

2228 general statutes delivered, issued for delivery, renewed, amended or 4
23-continued in this state on or after January 1, 2022, that includes coverage 5
24-for outpatient prescription drugs shall provide coverage for epinephrine 6
25-cartridge injectors, as defined in section 19a-909 of the general statutes. 7
26-(b) No policy described in subsection (a) of this section shall impose 8
27-a coinsurance, copayment, deductible or other out-of-pocket expense for 9
28-an epinephrine cartridge injector in an amount that is greater than 10
29-twenty-five dollars. The provisions of this subsection shall apply to a 11
30-high deductible health plan, as that term is used in subsection (f) of 12
31-section 38a-493 of the general statutes, to the maximum extent permitted 13
32-by federal law, except if such plan is used to establish a medical savings 14
33-account or an Archer MSA pursuant to Section 220 of the Internal 15
34-Revenue Code of 1986, or any subsequent corresponding internal 16
35-revenue code of the United States, as amended from time to time, or a 17
36-health savings account pursuant to Section 223 of said Internal Revenue 18 Substitute Bill No. 6587

45-federal law, and (2) does not disqualify such account for the deduction 21
46-allowed under said Section 220 or 223, as applicable. 22

63-revenue code of the United States, as amended from time to time, or a 39
64-health savings account pursuant to Section 223 of said Internal Revenue 40
65-Code, as amended from time to time, the provisions of this subsection 41
66-shall apply to such plan to the maximum extent that (1) is permitted by 42
67-federal law, and (2) does not disqualify such account for the deduction 43
68-allowed under said Section 220 or 223, as applicable. 44

57+epinephrine cartridge injector shall impose a coinsurance, copayment, 28
58+deductible or other out-of-pocket expense for a covered epinephrine 29
59+cartridge injector in an amount that is greater than twenty-five dollars. 30
60+The provisions of this section shall apply to a high deductible health 31
61+plan, as that term is used in subsection (f) of section 38a-520 of the 32
62+general statutes, to the maximum extent permitted by federal law, 33
63+except if such plan is used to establish a medical savings account or an 34
64+Archer MSA pursuant to Section 220 of the Internal Revenue Code of 35

66+United States, as amended from time to time, or a health savings account 37
67+pursuant to Section 223 of said Internal Revenue Code, as amended 38

71+Section 220 or 223, as applicable. For the purposes of this section, 42
72+"epinephrine cartridge injector" has the same meaning as provided in 43
