9-AN ACT CONCERNING THE CONVEYANCE OF A PARCEL OF
10-STATE LAND IN THE TOWN OF WINDSOR TO THE TOWN OF
11-WINDSOR.
21+AN ACT CONCERNING TH E CONVEYANCE OF A PARC EL OF STATE
22+LAND IN THE TOWN OF WINDSOR TO THE TOWN OF WINDSOR.
1223 Be it enacted by the Senate and House of Representatives in General
1324 Assembly convened:

15-Section 1. (Effective from passage) (a) Notwithstanding any provision
16-of the general statutes, the Commissioner of Transportation shall convey
17-to the town of Windsor a parcel of land located in the town of Windsor,
18-at a cost equal to the administrative costs of making such conveyance.
19-Said parcel of land has an area of approximately .6 acre and is identified
20-as the irregular rectangular shaped parcel labeled "Upper Broad Street"
21-depicted on a map entitled "Land to be Conveyed to Mastriani Realty,
22-LLC, Routes 75 and 159, Scale 1"= 30', March 30, 2021, Dubiel Associates
23-East Hartford, Connecticut, Project No. 2875". The precise area of the
24-parcel to be conveyed shall be determined by the Department of
25-Transportation. The conveyance shall be subject to the approval of the
26-State Properties Review Board.
27-(b) The town of Windsor shall sell said parcel of land for economic
28-development purposes. If the town does not sell said parcel for
29-economic development purposes within five years after the conveyance
30-of the parcel to the town under this section, the parcel shall revert to the
31-state of Connecticut. Any sale of said parcel by the town shall be made House Bill No. 6680

35-at a cost equal to the fair market value of said parcel, as determined by
36-the average of the appraisals of two independent appraisers selected by
37-the commissioner. Any funds received by the town of Windsor from a
38-sale in accordance with this subsection, minus the cost of any appraisals,
39-shall be transferred to the State Treasurer for deposit in the Special
40-Transportation Fund.
41-(c) The conveyance of said parcel shall be granted (1) subject to the
42-right of the state to (A) pass and repass over and on said parcel of land
43-for the purpose of accessing lands of the state, and (B) place and
44-maintain over, under and on said parcel of land existing and future
45-utilities, including, but not limited to, electrical, water, sanitary sewer,
46-telecommunications and gas, and (2) subject to any rights and easements
47-with regard to said parcel of land that the state deems necessary to meet
48-its governmental obligations.
49-(d) The State Properties Review Board shall complete its review of the
50-conveyance of said parcel of land not later than thirty days after it
51-receives a proposed agreement from the Department of Transportation.
52-The land shall remain under the care and control of said department
53-until a conveyance is made in accordance with the provisions of this
54-section. The State Treasurer shall execute and deliver any deed or
55-instrument necessary for a conveyance under this section, which deed
56-or instrument shall include provisions to carry out the purposes of
57-subsections (b) and (c) of this section. The Commissioner of
58-Transportation shall have the sole responsibility for all other incidents
59-of such conveyance.

47+(1) Does not use said parcel for said purposes; 16
48+(2) Does not retain ownership of all of said parcel; or 17
49+(3) Leases all or any portion of said parcel, other than a lease for said 18
50+purposes; 19
51+the parcel shall revert to the state of Connecticut. 20
52+(c) The conveyance of said parcel shall be granted (1) subject to the 21
53+right of the state to (A) pass and repass over and on said parcel of land 22
