25 | 26 | | Section 1. (Effective from passage) (a) Not later than September 1, 2021, 1 |

26 | 27 | | the Commissioner of Energy and Environmental Protection shall 2 |

27 | 28 | | consult with the Governor, the Commissioner of Economic and 3 |
---|
28 | 29 | | Community Development, the Commissioner of Administrative 4 |
---|
29 | 30 | | Services, the Secretary of the Office of Policy and Management, the chief 5 |
---|
30 | 31 | | elected official of the town of Waterford and adjacent landowners to 6 |
---|
31 | 32 | | develop and issue a request for information for low-impact, residential 7 |
---|
32 | 33 | | uses for the former Seaside Sanatorium facility in the town of Waterford. 8 |
---|
33 | 34 | | (b) Any request for information issued pursuant to subsection (a) of 9 |
---|
34 | 35 | | this section shall, at a minimum, require that responses to such request 10 |
---|
35 | 36 | | provide for the repair and preservation of any seawall on said property 11 |
---|
36 | 37 | | in order to allow for public access to not less than one hundred feet 12 |
---|
37 | 38 | | landward from the shoreline for the full length of the coastal frontage of 13 |
---|
38 | 39 | | said property, the improvement and maintenance of the current 14 |
---|
47 | 47 | | the deed and covenants associated with said property, including, but 17 |
---|
48 | 48 | | not limited to, an easement for the town of Waterford to maintain and 18 |
---|
49 | 49 | | repair the municipal utility equipment located on the property and the 19 |
---|
50 | 50 | | requirement that any proceeds from the sale of the property be used to 20 |
---|
51 | 51 | | support the persons with intellectual and developmental disabilities. 21 |
---|
52 | 52 | | (c) Following the receipt of responses to the request for information 22 |
---|
53 | 53 | | issued pursuant to subsection (a) of this section, the Commissioner of 23 |
---|
54 | 54 | | Energy and Environmental Protection, the Governor, the Commissioner 24 |
---|
55 | 55 | | of Economic and Community Development , the Commissioner of 25 |
---|
56 | 56 | | Administrative Services, the Secretary of the Office of Policy and 26 |
---|
57 | 57 | | Management and the chief elected official of the town of Waterford shall 27 |
---|
58 | 58 | | review such responses and determine whether to receive presentations 28 |
---|
59 | 59 | | from any such respondents. Not later than ninety days following the last 29 |
---|
60 | 60 | | of such presentations or the determination to not receive presentations, 30 |
---|
61 | 61 | | whichever is later, the Commissioner of Energy and Environmental 31 |
---|
62 | 62 | | Protection, the Governor, the Commissioner of Economic and 32 |

63 | 63 | | Community Development, the Commissioner of Administrative 33 |

64 | 64 | | Services, the Secretary of the Office of Policy and Management and the 34 |

65 | 65 | | chief elected official of the town of Waterford shall determine the 35 |

66 | 66 | | highest and best low-impact, residential use for such property. 36 |
