LCO No. 1702 1 of 2 General Assembly Raised Bill No. 818 January Session, 2021 LCO No. 1702 Referred to Committee on AGING Introduced by: (AGE) AN ACT PERMITTING THE COMMUNITY SPOUSE O F AN INSTITUTIONALIZED MEDICAID RECIPIENT TO RETAIN THE MAXIMUM AMOUNT OF AL LOWABLE ASSETS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective from passage) (a) For purposes of this 1 section: 2 (1) "Institutionalized spouse" has the same meaning as provided in 42 3 USC 1396r-5(h)(1). 4 (2) "Community spouse" has the same meaning as provided in 42 5 USC 1396r-5(h)(2). 6 (b) The Commissioner of Social Services shall amend the Medicaid 7 state plan to permit a community spouse of an institutionalized spouse 8 to retain the maximum resource amount allowable for such community 9 spouse pursuant to 42 USC 1396r-5(f)(2). 10 (c) The commissioner shall adopt regulations, in accordance with the 11 provisions of chapter 54 of the general statutes, to implement the 12 Raised Bill No. 818 LCO No. 1702 2 of 2 provisions of this section. 13 This act shall take effect as follows and shall amend the following sections: Section 1 from passage New section Statement of Purpose: To prevent impoverishment of spouses of institutionalized residents.
