AN ACT CONCERNING A STUDY OF PERMITTING THE COMMUNITY 
SPOUSE OF AN INSTITUTIONALIZED MEDICAID RECIPIENT TO 
RETAIN THE MAXIMUM A MOUNT OF ALLOWABLE ASSETS.  
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (Effective from passage) Not later than January 1, 2022, the 1 
Commissioner of Social Services shall submit a report, in accordance 2 
with the provisions of section 11-4a of the general statutes, to the joint 3 
standing committees of the General Assembly having cognizance of 4 
matters relating to aging and appropriations and the budgets of state 5 
agencies. Such report shall examine the cost and feasibility of permitting 6 
a community spouse of an institutionalized spouse to retain the 7 
maximum resource amount allowable for such community spouse 8 
pursuant to 42 USC 1396r-5(f)(2). For purposes of this section, 9 
"institutionalized spouse" and "community spouse" each have the same 10 
meaning as provided in 42 USC 1396r-5(h).11 
This act shall take effect as follows and shall amend the following 
sections:
