9-AN ACT CONCERNING SERVICE VEHICLES AND AGRICULTURAL

1115 Be it enacted by the Senate and House of Representatives in General
1216 Assembly convened:

14-Section 1. Section 14-300i of the general statutes is repealed and the
15-following is substituted in lieu thereof (Effective October 1, 2021):
16-(a) As used in subsection (b) of this section, (1) "vulnerable user"
17-means: (A) A pedestrian; (B) a highway worker; (C) a person riding or
18-driving an animal; (D) a person riding a bicycle, an electric bicycle or an
19-electric foot scooter; (E) a person using a skateboard, roller skates or in-
20-line skates; (F) a person operating or riding on an agricultural tractor;
21-(G) a person using a wheelchair or motorized chair; [and] (H) a person
22-who is blind and such person's service animal; and (I) a person
23-operating (i) a commercial motor vehicle equipped with a garbage
24-compactor, a detachable container or a curbside recycling body, (ii) a
25-tank vehicle, (iii) a vehicle authorized by the United States government
26-to carry mail, or (iv) a vehicle operated by an express delivery carrier,
27-(2) "public way" includes any state or other public highway, road, street,
28-avenue, alley, driveway, parkway or place, under the control of the state
29-or any political subdivision of the state, dedicated, appropriated or
30-opened to public travel or other use, (3) "substantial bodily harm" means
31-bodily injury that involves a temporary but substantial disfigurement, Substitute Senate Bill No. 983
18+Section 1. (NEW) (Effective October 1, 2021) (a) For the purposes of this 1
19+section, "service vehicle" means (1) a commercial motor vehicle 2
20+equipped with a garbage compactor, a detachable container or a 3
21+curbside recycling body, (2) a tank vehicle, (3) a vehicle authorized by 4
22+the United States government to carry mail, or (4) a vehicle operated by 5
23+an express delivery carrier. 6
24+(b) Except as provided in sections 14-233 and 14-234 of the general 7
25+statutes, the driver of a vehicle overtaking and proceeding in the same 8
26+direction of a service vehicle that is stationary or traveling significantly 9
27+below the posted speed limit shall immediately reduce speed to a 10
28+reasonable level below the posted speed limit and pass to the left of such 11
29+service vehicle at a safe distance. The driver shall not again drive to the 12
30+right side of the highway until safely clear of such service vehicle. 13
31+(c) (1) On and after October 1, 2021, and until June 30, 2022, any 14
32+person who violates any provision of this section shall receive a 15
33+warning. (2) On and after July 1, 2022, any person who violates any 16
34+provision of this section shall have committed an infraction. 17
35+Sec. 2. Subdivision (1) of section 14-212 of the general statutes is 18 Substitute Bill No. 983

35-causes a temporary but substantial loss or impairment of the function of
36-any bodily part or organ, or causes a fracture of any bodily part, and (4)
37-"serious physical injury" has the same meaning as provided in section
38-53a-3.
39-(b) Any person operating a motor vehicle on a public way who fails
40-to exercise reasonable care and causes substantial bodily harm to, or the
41-serious physical injury or death, of a vulnerable user of a public way,
42-provided such vulnerable user has shown reasonable care in such user's
43-use of the public way, shall be fined not more than one thousand dollars.
44-Sec. 2. Subdivision (1) of section 14-297 of the general statutes is
45-repealed and the following is substituted in lieu thereof (Effective October
46-1, 2021):
47-(1) The following terms shall be construed as they are defined in
48-section 14-1: "Authorized emergency vehicle", "class 1 electric bicycle",
49-"class 2 electric bicycle", "class 3 electric bicycle", "driver", "electric
50-bicycle", "electric foot scooter", "head lamp", "highway", "intersection",
51-"limited access highway", "motor vehicle", "number plate", "operator",
52-"person", "rotary" or "roundabout", "shoulder", "stop", "tank vehicle",
53-"truck" and "vehicle";
54-Sec. 3. Section 14-232 of the general statutes is repealed and the
55-following is substituted in lieu thereof (Effective October 1, 2021):
56-(a) Except as provided in sections 14-233 and 14-234, (1) the driver of
57-a vehicle overtaking another vehicle proceeding in the same direction
58-shall pass to the left thereof at a safe distance and shall not again drive
59-to the right side of the highway until safely clear of the overtaken
60-vehicle; and (2) the driver of an overtaken vehicle shall give way to the
61-right in favor of the overtaking vehicle and shall not increase the speed
62-of his or her vehicle until completely passed by the overtaking vehicle.
63-For the purposes of this subsection, "safe distance" means not less than Substitute Senate Bill No. 983

57+This act shall take effect as follows and shall amend the following
58+sections:

67-three feet when the driver of a vehicle overtakes and passes (A) a person
68-riding a bicycle, an electric bicycle or an electric foot scooter, (B) a
69-commercial motor vehicle equipped with a garbage compactor, a
70-detachable container or a curbside recycling body, (C) a tank vehicle,
71-(D) a vehicle authorized by the United States government to carry mail,
72-(E) a vehicle operated by an express delivery carrier, or (F) an
73-agricultural tractor.
74-(b) No vehicle shall be driven to the left side of the center of the
75-highway in overtaking and passing another vehicle proceeding in the
76-same direction unless the left side is clearly visible and is free of
77-oncoming traffic for a sufficient distance ahead to permit such
78-overtaking and passing to be completely made without interfering with
79-the safe operation of any vehicle approaching from the opposite
80-direction or any vehicle overtaken.
81-(c) Violation of any provision of this section shall be an infraction.
82-Sec. 4. Subdivision (1) of section 14-212 of the general statutes is
83-repealed and the following is substituted in lieu thereof (Effective October
84-1, 2021):
