914 AN ACT CONCERNING VARIOUS REVISIONS TO THE HIGHER
1015 EDUCATION STATUTES.
1116 Be it enacted by the Senate and House of Representatives in General
1217 Assembly convened:

14-Section 1. (NEW) (Effective July 1, 2022) (a) Not later than January 1,
15-2023, the Board of Regents for Higher Education and the Board of
16-Trustees of The University of Connecticut shall each adopt a policy
17-requiring that any new appointed member of either of said boards
18-receive instruction and training in (1) a board member's duties to the
19-state and the public institution of higher education governed by the
20-board, (2) each committee of the board, including, but not limited to, the
21-executive committee, and its functions, (3) professional accounting and
22-reporting standards, (4) methods for meeting the statutory, regulatory
23-and fiduciary obligations of the board, (5) the provisions of the Freedom
24-of Information Act, as defined in section 1-200 of the general statutes, (6)
25-a board member's institutional and statutory ethical responsibilities, (7)
26-the development and implementation of institutional policies, (8)
27-business operations, administration, budgeting, financing, financial
28-reporting, financial reserves and endowment managing relevant to
29-institutions of higher education, (9) student tuition, mandatory fees and
30-student debt trends, (10) oversight of planning, construction,
31-maintenance, expansion and renovation projects that impact the
32-infrastructure, physical facilities and natural environment of the public Substitute Senate Bill No. 18
19+Section 1. (NEW) (Effective July 1, 2022) (a) Not later than January 1, 1
20+2023, the Board of Regents for Higher Education and the Board of 2
21+Trustees of The University of Connecticut shall each adopt a policy 3

28+fiduciary obligations of the board, (5) the provisions of the Freedom of 10
29+Information Act, as defined in section 1-200 of the general statutes, (6) a 11
30+board member's institutional and statutory ethical responsibilities, (7) 12
31+the development and implementation of institutional policies, (8) 13
32+business operations, administration, budgeting, financing, financial 14
33+reporting, financial reserves and endowment managing relevant to 15
34+institutions of higher education, (9) student tuition, mandatory fees and 16
35+student debt trends, (10) oversight of planning, construction, 17
36+maintenance, expansion and renovation projects that impact the 18
37+infrastructure, physical facilities and natural environment of the public 19 Substitute Bill No. 18

36-institution of higher education governed by the board, (11) workforce
37-planning, strategy and investment, (12) institutional advancement,
38-including, but not limited to, philanthropic giving, fundraising
39-initiatives, alumni programming, communications and media,
40-government and public relations and community affairs, (13) student
41-welfare issues, including, but not limited to, academic studies,
42-curriculum, residence life, student governance and activities and the
43-general physical and mental well-being of students, (14) current and
44-anticipated issues in higher education, and (15) any other topics each
45-governing board deems necessary. A member shall complete such
46-instruction and training not later than one year after being appointed or
47-elected to either of said boards.
48-(b) Not later than January 1, 2023, each public institution of higher
49-education shall post on its Internet web site (1) the policy established by
50-its governing board pursuant to subsection (a) of this section, and (2) a
51-summary of the instruction and training received by the members of its
52-governing board in accordance with such policy.
53-Sec. 2. Section 10a-8 of the general statutes is repealed and the
54-following is substituted in lieu thereof (Effective July 1, 2022):
55-(a) The provisions of sections 4-77 and 4-78 shall not apply to the
56-constituent units of the state system of higher education, and for the
57-purposes of said sections only, the Board of Regents for Higher
58-Education shall be deemed the budgeted agency for the Connecticut
59-State University System, the regional community-technical college
60-system, [and] Charter Oak State College and the central office of the
61-Connecticut State Colleges and Universities. The Board of Regents for
62-Higher Education shall develop a formula or program-based budgeting
63-system to be used by each institution in preparing operating budgets.
64-The Board of Regents for Higher Education shall prepare a single
65-budget request itemized by the Connecticut State University System, the
66-regional community-technical college system, [and] Charter Oak State Substitute Senate Bill No. 18

45+planning, strategy and investment, (12) institutional advancement, 21
46+including, but not limited to, philanthropic giving, fundraising 22

48+government and public relations and community affairs, (13) student 24
49+welfare issues, including, but not limited to, academic studies, 25
50+curriculum, residence life, student governance and activities and the 26

76+Universities using the formula or program-based budgeting system and 52 Substitute Bill No. 18

70-College and the central office of the Connecticut State Colleges and
71-Universities using the formula or program-based budgeting system and
72-shall submit such budget request displaying all operating funds to the
73-Secretary of the Office of Policy and Management in accordance with
74-sections 4-77 and 4-78, subject to procedures developed by the Board of
75-Regents for Higher Education and approved by said secretary. The
76-budget request shall set forth, in the form prescribed by the Board of
77-Regents for Higher Education, a proposed expenditure plan which shall
78-include: (1) The total amount requested for such appropriation account;
79-(2) the amount to be appropriated from the General Fund; and (3) the
80-amount to be paid from the tuition revenues of the regional community-
81-technical college system, [and] the Connecticut State University System
82-and Charter Oak State College. After review and comment by the Board
83-of Regents for Higher Education, the proposed expenditure plans shall
84-be incorporated into the single public higher education budget request
85-including recommendations, if any, by said board. Any tuition increase
86-proposed by the regional community-technical college system, [and] the
87-Connecticut State University System and Charter Oak State College for
88-the fiscal year to which the budget request relates shall be included in
89-the single public higher education budget request submitted by the
90-Board of Regents for Higher Education for such fiscal year, provided if
91-the General Assembly does not appropriate the amount requested by
92-any such system or college, such system or college may increase tuition
93-and fees by an amount greater than that included in the budget request
94-in response to which the appropriation was made. The General
95-Assembly shall make appropriations directly to the constituent units.
96-Allotment reductions made pursuant to the provisions of subsections
97-(b) and (c) of section 4-85 shall be applied by the Board of Regents for
98-Higher Education among the appropriations to the constituent units and
99-the central office of the Connecticut State Colleges and Universities
100-without regard to the limitations on reductions provided in said section,
101-except that said limitations shall apply to the total of the amounts
102-appropriated. The Board of Regents for Higher Education shall apply Substitute Senate Bill No. 18

106-such reductions after consultation with the Secretary of the Office of
107-Policy and Management. Any reductions of more than five per cent of
108-the appropriations of any constituent units shall be submitted to the
109-appropriations committee which shall, within thirty days, approve or
110-reject such reduction.
111-(b) The [boards of trustees of each of the constituent units] Board of
112-Regents for Higher Education may transfer to or from any specific
113-appropriation of [such] a constituent unit a sum or sums totaling up to
114-fifty thousand dollars or ten per cent of any such specific appropriation,
115-whichever is less, in any fiscal year without the consent of the Finance
116-Advisory Committee. Any such transfer shall be reported to the Finance
117-Advisory Committee within thirty days of such transfer and such report
118-shall be a record of said committee.
119-Sec. 3. Subsection (b) of section 10a-77 of the 2022 supplement to the
120-general statutes is repealed and the following is substituted in lieu
121-thereof (Effective July 1, 2022):
122-(b) The Board of [Trustees of the Community-Technical Colleges]
123-Regents for Higher Education shall establish and administer a fund to
124-be known as the Regional Community-Technical Colleges Operating
125-Fund. Appropriations from general revenues of the state and, upon
126-request by the board and with an annual review and approval by the
127-Secretary of the Office of Policy and Management, the amount of the
128-appropriations for fringe benefits and workers' compensation
129-applicable to the regional community-technical colleges pursuant to
130-subsection (a) of section 4-73, shall be transferred from the Comptroller,
131-and all tuition revenue received by the regional community-technical
132-colleges in accordance with the provisions of subsection (a) of this
133-section shall be deposited in said fund. Income from student fees or
134-related charges; the proceeds of auxiliary activities and business
135-enterprises, gifts and donations; federal funds and grants for purposes
136-other than research, and all receipts derived from the conduct by the Substitute Senate Bill No. 18
83+shall submit such budget request displaying all operating funds to the 53
84+Secretary of the Office of Policy and Management in accordance with 54
85+sections 4-77 and 4-78, subject to procedures developed by the Board of 55
86+Regents for Higher Education and approved by said secretary. The 56
87+budget request shall set forth, in the form prescribed by the Board of 57
88+Regents for Higher Education, a proposed expenditure plan which shall 58
89+include: (1) The total amount requested for such appropriation account; 59
90+(2) the amount to be appropriated from the General Fund; and (3) the 60
91+amount to be paid from the tuition revenues of the regional community-61
92+technical college system, [and] the Connecticut State University System 62
93+and Charter Oak State College. After review and comment by the Board 63
94+of Regents for Higher Education, the proposed expenditure plans shall 64
95+be incorporated into the single public higher education budget request 65
96+including recommendations, if any, by said board. Any tuition increase 66
97+proposed by the regional community-technical college system, [and] the 67
98+Connecticut State University System and Charter Oak State College for 68
99+the fiscal year to which the budget request relates shall be included in 69
100+the single public higher education budget request submitted by the 70
101+Board of Regents for Higher Education for such fiscal year, provided if 71
102+the General Assembly does not appropriate the amount requested by 72
103+any such system or college, such system or college may increase tuition 73
104+and fees by an amount greater than that included in the budget request 74
105+in response to which the appropriation was made. The General 75
106+Assembly shall make appropriations directly to the constituent units. 76
107+Allotment reductions made pursuant to the provisions of subsections 77
108+(b) and (c) of section 4-85 shall be applied by the Board of Regents for 78
109+Higher Education among the appropriations to the constituent units and 79
110+the central office of the Connecticut State Colleges and Universities 80

112+except that said limitations shall apply to the total of the amounts 82
113+appropriated. The Board of Regents for Higher Education shall apply 83
114+such reductions after consultation with the Secretary of the Office of 84
115+Policy and Management. Any reductions of more than five per cent of 85
116+the appropriations of any constituent units shall be submitted to the 86

141-sessions shall be credited to said fund but shall be allocated to the central
142-office and institutional operating accounts which shall be established
143-and maintained for the central office and each community-technical
144-college. If the Secretary of the Office of Policy and Management
145-disapproves such transfer, the secretary may require the amount of the
146-appropriation for operating expenses to be used for personal services
147-and fringe benefits to be excluded from said fund. The State Treasurer
148-shall review and approve the transfer prior to such request by the board.
149-[of trustees.] The board shall establish an equitable policy, in accordance
150-with section 10a-8, as amended by this act, for allocation of
151-appropriations from general revenues of the state, fringe benefits
152-transferred from the Comptroller and tuition revenue deposited in the
153-Regional Community-Technical Colleges Operating Fund. At the
154-beginning of each quarter of the fiscal year, the board shall allocate and
155-transfer, in accordance with said policy, moneys for expenditure in such
156-institutional operating accounts, exclusive of amounts retained for
157-central office operations and reasonable reserves for future distribution.
158-All costs of waiving or remitting tuition pursuant to subsection (f) of this
159-section shall be charged to the Regional Community-Technical Colleges
160-Operating Fund. Repairs, alterations or additions to facilities supported
161-by operating funds and costing one million dollars or more shall require
162-the approval of the General Assembly, or when the General Assembly
163-is not in session, of the Finance Advisory Committee. Any balance of
164-receipts above expenditures shall remain in said fund, except such sums
165-as may be required for deposit into a debt service fund or the General
166-Fund for further payment by the Treasurer of debt service on general
167-obligation bonds of the state issued for purposes of the regional
168-community-technical colleges.
169-Sec. 4. Subsection (b) of section 10a-99 of the 2022 supplement to the
170-general statutes is repealed and the following is substituted in lieu

154+and maintained for the central office and each community-technical 118
155+college. If the Secretary of the Office of Policy and Management 119
156+disapproves such transfer, the secretary may require the amount of the 120 Substitute Bill No. 18

175-(b) The Board of [Trustees of the Connecticut State University
176-System] Regents for Higher Education shall establish and administer a
177-fund to be known as the Connecticut State University System Operating
178-Fund. Appropriations from general revenues of the state and upon
179-request by the Connecticut State University System and with the annual
180-review and approval by the Secretary of the Office of Policy and
181-Management, the amount of the appropriations for fringe benefits
182-pursuant to subsection (a) of section 4-73, shall be transferred from the
183-State Comptroller and all tuition revenue received by the Connecticut
184-State University System in accordance with the provisions of subsection
185-(a) of this section shall be deposited in said fund. Income from student
186-fees or related charges, the proceeds of auxiliary activities and business
187-enterprises, gifts and donations, federal funds and grants, subject to the
188-provisions of sections 10a-98 to 10a-98g, inclusive, and all receipts
189-derived from the conduct by a state university of its education extension
190-program and its summer school session shall be credited to said fund
191-but shall be allocated to the central office and institutional operating
192-accounts which shall be established and maintained for the central office
193-and each state university. Any such gifts and donations, federal funds
194-and grants for purposes of research shall be allocated to separate
195-accounts within such central office and institutional operating accounts.
196-If the Secretary of the Office of Policy and Management disapproves
197-such transfer, [he] the secretary may require the amount of the
198-appropriation for operating expenses to be used for personal services
199-and fringe benefits to be excluded from said fund. The State Treasurer
200-shall review and approve the transfer prior to such request by the
201-university. The board [of trustees] shall establish an equitable policy, in
202-accordance with section 10a-8, as amended by this act, for allocation of
203-appropriations from general revenues of the state, fringe benefits
204-transferred from the State Comptroller and tuition revenue deposited in
205-the Connecticut State University System Operating Fund. At the
206-beginning of each quarter of the fiscal year, the board shall allocate and
207-transfer, in accordance with said policy, moneys for expenditure in such Substitute Senate Bill No. 18

211-institutional operating accounts, exclusive of amounts retained for
212-central office operations and reasonable reserves for future distribution.
213-All costs of waiving or remitting tuition pursuant to subsection (f) of this
214-section shall be charged to the Connecticut State University System
215-Operating Fund. Repairs, alterations or additions to facilities supported
216-by the Connecticut State University System Operating Fund and costing
217-one million dollars or more shall require the approval of the General
218-Assembly, or when the General Assembly is not in session, of the
219-Finance Advisory Committee. Any balance of receipts above
220-expenditures shall remain in said fund, except such sums as may be
221-required for deposit into a debt service fund or the General Fund for
222-further payment by the Treasurer of debt service on general obligation
223-bonds of the state issued for purposes of the Connecticut State
224-University System.
225-Sec. 5. Subsection (a) of section 10a-6 of the 2022 supplement to the
226-general statutes is repealed and the following is substituted in lieu
227-thereof (Effective July 1, 2022):
228-(a) The Board of Regents for Higher Education shall: (1) Establish
229-policies and guidelines for the Connecticut State University System, the
230-regional community-technical college system and Charter Oak State
231-College; (2) develop a master plan for higher education and
232-postsecondary education at the Connecticut State University System,
233-the regional community-technical college system and Charter Oak State
234-College consistent with the goals identified in section 10a-11c; (3)
235-establish tuition and student fee policies for the Connecticut State
236-University System, the regional community-technical college system
237-and Charter Oak State College; (4) monitor and evaluate the
238-effectiveness and viability of the state universities, the regional
239-community-technical colleges and Charter Oak State College in
240-accordance with criteria established by the board; (5) merge or close
241-institutions within the Connecticut State University System, the regional Substitute Senate Bill No. 18
163+appropriation for operating expenses to be used for personal services 121
164+and fringe benefits to be excluded from said fund. The State Treasurer 122
165+shall review and approve the transfer prior to such request by the board. 123

186+Sec. 4. Subsection (b) of section 10a-99 of the 2022 supplement to the 144
187+general statutes is repealed and the following is substituted in lieu 145
188+thereof (Effective July 1, 2022): 146
189+(b) The Board of [Trustees of the Connecticut State University 147
190+System] Regents for Higher Education shall establish and administer a 148
191+fund to be known as the Connecticut State University System Operating 149
192+Fund. Appropriations from general revenues of the state and upon 150
193+request by the Connecticut State University System and with the annual 151
194+review and approval by the Secretary of the Office of Policy and 152

245-community-technical college system and Charter Oak State College in
246-accordance with criteria established by the board, provided (A) such
247-recommended merger or closing shall require a two-thirds vote of the
248-board, and (B) notice of such recommended merger or closing shall be
249-sent to the committee having cognizance over matters relating to
250-education and to the General Assembly; (6) review and approve mission
251-statements for the Connecticut State University System, the regional
252-community-technical college system and Charter Oak State College and
253-role and scope statements for the individual institutions and campuses
254-of such constituent units; (7) review and approve any recommendations
255-for the establishment of new academic programs submitted to the board
256-by the state universities within the Connecticut State University System,
257-the regional community-technical colleges and Charter Oak State
258-College, and, in consultation with the affected constituent units, provide
259-for the initiation, consolidation or termination of academic programs;
260-(8) develop criteria to ensure acceptable quality in (A) programs at the
261-Connecticut State University System, the regional community-technical
262-college system and Charter Oak State College, and (B) institutions
263-within the Connecticut State University System and the regional
264-community-technical college system and enforce standards through
265-licensing and accreditation; (9) prepare and present to the Governor and
266-General Assembly, in accordance with section 10a-8, as amended by this
267-act, consolidated operating and capital expenditure budgets for the
268-Connecticut State University System, the regional community-technical
269-college system, [and] Charter Oak State College and the central office of
270-the Connecticut State Colleges and Universities developed in
271-accordance with the provisions of said section 10a-8, as amended by this
272-act; (10) review and make recommendations on plans received from the
273-Connecticut State University System, the regional community-technical
274-college system and Charter Oak State College to implement the goals
275-identified in section 10a-11c; (11) appoint advisory committees with
276-representatives from public and independent institutions of higher
277-education to study methods and proposals for coordinating efforts of Substitute Senate Bill No. 18

202+pursuant to subsection (a) of section 4-73, shall be transferred from the 154

204+State University System in accordance with the provisions of subsection 156
205+(a) of this section shall be deposited in said fund. Income from student 157
206+fees or related charges, the proceeds of auxiliary activities and business 158
207+enterprises, gifts and donations, federal funds and grants, subject to the 159
208+provisions of sections 10a-98 to 10a-98g, inclusive, and all receipts 160
209+derived from the conduct by a state university of its education extension 161
210+program and its summer school session shall be credited to said fund 162
211+but shall be allocated to the central office and institutional operating 163
212+accounts which shall be established and maintained for the central office 164
213+and each state university. Any such gifts and donations, federal funds 165
214+and grants for purposes of research shall be allocated to separate 166
215+accounts within such central office and institutional operating accounts. 167
216+If the Secretary of the Office of Policy and Management disapproves 168
217+such transfer, [he] the secretary may require the amount of the 169
218+appropriation for operating expenses to be used for personal services 170
219+and fringe benefits to be excluded from said fund. The State Treasurer 171
220+shall review and approve the transfer prior to such request by the 172
221+university. The board [of trustees] shall establish an equitable policy, in 173
222+accordance with section 10a-8, as amended by this act, for allocation of 174
223+appropriations from general revenues of the state, fringe benefits 175
224+transferred from the State Comptroller and tuition revenue deposited in 176
225+the Connecticut State University System Operating Fund. At the 177
226+beginning of each quarter of the fiscal year, the board shall allocate and 178
227+transfer, in accordance with said policy, moneys for expenditure in such 179
228+institutional operating accounts, exclusive of amounts retained for 180
229+central office operations and reasonable reserves for future distribution. 181
230+All costs of waiving or remitting tuition pursuant to subsection (f) of this 182
231+section shall be charged to the Connecticut State University System 183
232+Operating Fund. Repairs, alterations or additions to facilities supported 184
233+by the Connecticut State University System Operating Fund and costing 185
234+one million dollars or more shall require the approval of the General 186
235+Assembly, or when the General Assembly is not in session, of the 187
236+Finance Advisory Committee. Any balance of receipts above 188 Substitute Bill No. 18

281-the public institutions of higher education under its jurisdiction with
282-The University of Connecticut and the independent institutions of
283-higher education to implement the goals identified in section 10a-11c;
284-(12) evaluate (A) means of implementing the goals identified in section
285-10a-11c, and (B) any recommendations made by the Planning
286-Commission for Higher Education in implementing the strategic master
287-plan pursuant to section 10a-11b through alternative and nontraditional
288-approaches such as external degrees and credit by examination; (13)
289-coordinate programs and services among the Connecticut State
290-University System, the regional community-technical college system
291-and Charter Oak State College; (14) assess opportunities for
292-collaboration with The University of Connecticut and the independent
293-institutions of higher education to implement the goals identified in
294-section 10a-11c; (15) make or enter into contracts, leases or other
295-agreements in connection with its responsibilities under this part,
296-provided all acquisitions of real estate by lease or otherwise shall be
297-subject to the provisions of section 4b-23; (16) be responsible for the care
298-and maintenance of permanent records of institutions of higher
299-education dissolved after September 1, 1969; (17) prepare and present to
300-the Governor and General Assembly legislative proposals affecting the
301-Connecticut State University System, the regional community-technical
302-college system and Charter Oak State College; (18) develop and
303-maintain a central higher education information system and establish
304-definitions and data requirements for the Connecticut State University
305-System, the regional community-technical college system and Charter
306-Oak State College; (19) until June 30, 2024, report all new programs and
307-program changes at the Connecticut State University System, the
308-regional community-technical college system and Charter Oak State
309-College to the Office of Higher Education; and (20) undertake such
310-studies and other activities as will best serve the higher educational
311-interests of the Connecticut State University System, the regional
