1219 AN ACT CONCERNING THE ILLEGAL USE OF CERTAIN VEHICLES
1320 AND STREET TAKEOVERS.
1421 Be it enacted by the Senate and House of Representatives in General
1522 Assembly convened:

1724 Section 1. Section 14-390 of the general statutes is repealed and the 1
1825 following is substituted in lieu thereof (Effective October 1, 2024): 2
1926 (a) Any municipality may, by ordinance, regulate the operation and 3
2027 use, including hours and zones of use, of snowmobiles and all-terrain 4
2128 vehicles in a manner not inconsistent with the provisions of this section 5
2229 and sections 14-379 to 14-389, inclusive, or any regulations adopted 6
2330 pursuant thereto, and may (1) prescribe a penalty for violation of such 7
2431 ordinance in an amount not to exceed one thousand dollars for a first 8
2532 violation, in an amount not to exceed one thousand five hundred dollars 9
2633 for a second violation, and in an amount not to exceed two thousand 10
2734 dollars for a third or subsequent violation, and (2) provide for the 11
2835 seizure and forfeiture to the municipality of such all-terrain vehicle for 12
2936 a violation of such ordinance, subject to any bona fide lien, lease or 13
3037 security interest in the all-terrain vehicle, including, but not limited to, 14
31-a lien under section 14-66c. 15

3244 (b) No all-terrain vehicle shall be forfeited under an ordinance 16
3345 adopted pursuant to this section to the extent of the interest of an owner 17

46+or lienholder by reason of any act or omission committed by another 18
3947 person if such owner or lienholder did not know and could not have 19
4048 reasonably known that such all-terrain vehicle was being used or was 20
4149 intended to be used in violation of a municipal ordinance, and such 21
4250 owner or lienholder collects such all-terrain vehicle not later than thirty 22
43-days after the date the municipality mails such owner or lienholder a 23
44-written notice indicating that such all-terrain vehicle shall be forfeited if 24
45-not collected within such thirty-day period. 25

4654 (c) Any all-terrain vehicle ordered forfeited pursuant to such an 26
4755 ordinance shall be sold at public auction conducted by the municipality 27
4856 or destroyed by the municipality. The proceeds of any such sale shall be 28
4957 paid to the treasurer of the municipality, who shall deposit such 29
5058 proceeds into the general fund of the municipality. 30
5159 Sec. 2. Section 14-390m of the general statutes is repealed and the 31
5260 following is substituted in lieu thereof (Effective from passage): 32
5361 (a) Any municipality that adopts an ordinance pursuant to section 7-33
5462 148 to regulate the operation and use on public property, including 34
5563 hours of use, of dirt bikes or mini-motorcycles may prescribe a penalty 35
5664 for violation of such ordinance (1) in an amount not to exceed one 36
5765 thousand dollars for a first violation, in an amount not to exceed one 37
5866 thousand five hundred dollars for a second violation and in an amount 38
5967 not to exceed two thousand dollars for a third or subsequent violation, 39
6068 and (2) in the case of a municipality with a population of twenty 40
6169 thousand or more, to provide for the seizure and forfeiture to the 41
6270 municipality of such dirt bike or mini-motorcycle for violation of such 42
6371 ordinance, subject to any bona fide lien, lease or security interest in the 43
6472 dirt bike or mini-motorcycle, including, but not limited to, a lien under 44
6573 section 14-66c. 45
6674 (b) No dirt bike or mini-motorcycle shall be forfeited under an 46
67-ordinance adopted pursuant to this section to the extent of the interest 47

7584 being used or was intended to be used in violation of a municipal 51
7685 ordinance, and such owner or lienholder collects such dirt bike or mini-52
7786 motorcycle not later than thirty days after the date the municipality 53
78-mails such owner or lienholder a written notice indicating that such dirt 54
79-bike or mini-motorcycle shall be forfeited if not collected within such 55
80-thirty-day period. 56

8190 (c) Any dirt bike or mini-motorcycle ordered forfeited pursuant to 57

8695 (d) For the purposes of this section and section 7-148, (1) "dirt bike" 62
8796 means a two-wheeled motorized recreational vehicle designed to travel 63
8897 over unimproved terrain and not designed for travel on a highway, as 64
8998 defined in section 14-1. "Dirt bike" does not include an all-terrain 65
9099 vehicle, as defined in section 14-379, or a motor-driven cycle, as defined 66
91100 in section 14-1, and (2) "mini-motorcycle" has the same meaning as 67
92101 provided in section 14-289j. 68
93102 Sec. 3. (NEW) (Effective October 1, 2024) (a) For purposes of this 69
94103 section, "street takeover" has the same meaning as provided in section 70
95104 14-224 of the general statutes. 71
96105 (b) Any municipality may, by ordinance, prohibit a person from 72
97106 organizing, participating in or gathering with intent to observe and 73
98-actually observing a street takeover. Such ordinance may (1) prescribe a 74
99-penalty for violation of such ordinance in an amount not to exceed one 75
100-thousand dollars for a first violation, in an amount not to exceed one 76
101-thousand five hundred dollars for a second violation and in an amount 77
102-not to exceed two thousand dollars for a third or subsequent violation, 78
103-and (2) provide for the impoundment of any vehicle used in violation of 79
104-this section until any fine imposed pursuant to subdivision (1) of this 80
105-subsection is paid, any related charges, including, but not limited to, 81
106-towing fees, are paid and any overdue property taxes on such vehicle 82 Substitute Bill No. 5413

111-imposed pursuant to chapter 203 of the general statutes are paid. Any 83
112-ordinance adopted pursuant to this section shall be consistent with the 84
113-provisions of sections 14-379 to 14-390m, inclusive, of the general 85
114-statutes, as amended by this act, or any regulations adopted pursuant to 86
115-said sections. 87
116-Sec. 4. Subsection (b) of section 14-111 of the 2024 supplement to the 88
117-general statutes is repealed and the following is substituted in lieu 89
118-thereof (Effective October 1, 2024): 90
119-(b) (1) Except as provided in subdivision (2) or (3) of this subsection, 91
120-whenever the holder of any motor vehicle operator's license has been 92
121-convicted or has forfeited any bond taken or has received a suspended 93
122-judgment or sentence for any of the following violations, the 94
123-commissioner shall, without hearing, suspend such person's operator's 95
124-license or privilege to operate a motor vehicle in this state as follows: 96
125-For a first violation of subsection (a) or subdivision (1) of subsection (b) 97
126-of section 14-224 or section 14-110, 14-215 or 53a-119b, for a period of 98
127-not less than one year and, for a subsequent violation thereof, for a 99
128-period of not less than two years; for a violation of subsection (a) of 100
129-section 14-222, [or subsection (c) of section 14-224,] for a period of not 101
130-less than thirty days or more than ninety days and, for a subsequent 102
131-violation thereof, for a period of not less than ninety days; for a violation 103
132-of subdivision (2) or (3) of subsection (b) of section 14-224, for a period 104
133-of not less than ninety days and for a subsequent violation thereof, for a 105
134-period of not less than one year; for a violation of subsection (c) of 106
135-section 14-224, for a period of forty-five days, provided the 107
136-commissioner shall permanently revoke such person's operator's license 108
137-or privilege for a third violation thereof; for a first violation of subsection 109
138-(b), (d) or (e) of section 14-147, for a period of not less than ninety days 110
139-and, for a subsequent violation thereof, for a period of not less than five 111
140-years; for a first violation of subsection (c) of section 14-147, for a period 112
141-of not less than thirty days and, for a subsequent violation thereof, for a 113
142-period of not less than one year. 114
143-(2) Notwithstanding the provisions of section 14-111b and except as 115 Substitute Bill No. 5413

118+dollars for a second violation and in an amount not to exceed two 80
119+thousand dollars for a third or subsequent violation, and (2) provide for 81
120+the impoundment of any vehicle used in violation of this section until 82
121+any fine imposed pursuant to subdivision (1) of this section is paid, any 83
122+related charges, including, but not limited to, towing fees, are paid and 84
123+any overdue property taxes on such vehicle imposed pursuant to 85
124+chapter 203 of the general statutes are paid. 86
125+Sec. 4. Subsection (b) of section 14-111 of the 2024 supplement to the 87
126+general statutes is repealed and the following is substituted in lieu 88
127+thereof (Effective October 1, 2024): 89
128+(b) (1) Except as provided in subdivision (2) or (3) of this subsection, 90
129+whenever the holder of any motor vehicle operator's license has been 91
130+convicted or has forfeited any bond taken or has received a suspended 92
131+judgment or sentence for any of the following violations, the 93
132+commissioner shall, without hearing, suspend such person's operator's 94
133+license or privilege to operate a motor vehicle in this state as follows: 95
134+For a first violation of subsection (a) or subdivision (1) of subsection (b) 96
135+of section 14-224 or section 14-110, 14-215, as amended by this act, or 97
136+53a-119b, for a period of not less than one year and, for a subsequent 98
137+violation thereof, for a period of not less than two years; for a violation 99
138+of subsection (a) of section 14-222, [or subsection (c) of section 14-224,] 100
139+for a period of not less than thirty days or more than ninety days and, 101
140+for a subsequent violation thereof, for a period of not less than ninety 102
141+days; for a violation of subdivision (2) or (3) of subsection (b) of section 103
142+14-224, for a period of not less than ninety days and for a subsequent 104
143+violation thereof, for a period of not less than one year; for a violation of 105
144+subsection (c) of section 14-224, for a period of forty-five days, provided 106
145+the commissioner shall permanently revoke such person's operator's 107
146+license or privilege for a third violation thereof; for a first violation of 108
147+subsection (b), (d) or (e) of section 14-147, for a period of not less than 109
148+ninety days and, for a subsequent violation thereof, for a period of not 110
149+less than five years; for a first violation of subsection (c) of section 14-111
150+147, for a period of not less than thirty days and, for a subsequent 112

148-provided in subdivision (3) of this subsection, whenever the holder of 116
149-any motor vehicle operator's license or youth instruction permit who is 117
150-less than eighteen years of age or whenever a person who does not hold 118
151-an operator's license who is less than eighteen years of age has been 119
152-convicted or has forfeited any bond taken or has received a suspended 120
153-judgment or sentence for any of the following violations, the 121
154-commissioner shall suspend such person's operator's license or 122
155-privilege to obtain an operator's license as follows: For a first violation 123
156-of subdivision (4) of subsection (a) of section 14-219 or subdivision (4) 124
157-of subsection (b) of section 14-219, for a period of sixty days and, for a 125
158-second violation thereof, for a period of ninety days and, for a third or 126
159-subsequent violation thereof, for a period of six months; for a first 127
160-violation of subsection (a) of section 14-222, for a period of six months 128
161-and, for a subsequent violation thereof, for a period of one year; for a 129
162-violation of subsection (c) of section 14-224, for a period of six months 130
163-and, for a subsequent violation thereof, for a period of one year; for a 131
164-first violation of section 14-296aa, for a period of thirty days and, for a 132
165-second violation thereof, for a period of ninety days and, for a third or 133
166-subsequent violation thereof, for a period of six months. 134
167-(3) The commissioner shall suspend the motor vehicle operator's 135
168-license of any youth adjudged a youthful offender for a violation of 136
169-section 14-215 or 14-222, subsection (b) of section 14-223 or subdivision 137
170-(2) or (3) of subsection (b) or subsection (c) of section 14-224 for six 138
171-months for a first offense and one year for a second or subsequent 139
172-offense. 140
173-(4) Whenever any person who has not been issued a motor vehicle 141
174-operator's license under section 14-36 is convicted of a second or 142
175-subsequent violation of subsection (a) of section 14-36: (A) The 143
176-commissioner shall suspend such person's privilege to operate a motor 144
177-vehicle, (B) such suspension shall remain in effect for a period of ninety 145
178-days, and (C) the commissioner shall not issue an operator's license to 146
179-such person under section 14-36 until such period of suspension has 147
180-expired and all applicable requirements for such license have been 148

157+(2) Notwithstanding the provisions of section 14-111b and except as 114
158+provided in subdivision (3) of this subsection, whenever the holder of 115
159+any motor vehicle operator's license or youth instruction permit who is 116
160+less than eighteen years of age or whenever a person who does not hold 117
161+an operator's license who is less than eighteen years of age has been 118
162+convicted or has forfeited any bond taken or has received a suspended 119
163+judgment or sentence for any of the following violations, the 120
164+commissioner shall suspend such person's operator's license or 121
165+privilege to obtain an operator's license as follows: For a first violation 122
166+of subdivision (4) of subsection (a) of section 14-219 or subdivision (4) 123
167+of subsection (b) of section 14-219, for a period of sixty days and, for a 124
168+second violation thereof, for a period of ninety days and, for a third or 125
169+subsequent violation thereof, for a period of six months; for a first 126
170+violation of subsection (a) of section 14-222, for a period of six months 127
171+and, for a subsequent violation thereof, for a period of one year; for a 128
172+violation of subsection (c) of section 14-224, for a period of six months 129
173+and, for a subsequent violation thereof, for a period of one year; for a 130
174+first violation of section 14-296aa, for a period of thirty days and, for a 131
175+second violation thereof, for a period of ninety days and, for a third or 132
176+subsequent violation thereof, for a period of six months. 133
177+(3) The commissioner shall suspend the motor vehicle operator's 134
178+license of any youth adjudged a youthful offender for a violation of 135
179+section 14-215, as amended by this act, or 14-222, subsection (b) of 136
180+section 14-223 or subdivision (2) or (3) of subsection (b) or subsection (c) 137
181+of section 14-224 for six months for a first offense and one year for a 138
182+second or subsequent offense. 139
183+(4) Whenever any person who has not been issued a motor vehicle 140
184+operator's license under section 14-36 is convicted of a second or 141
185+subsequent violation of subsection (a) of section 14-36: (A) The 142

197+Sec. 5. Subsection (c) of section 14-215 of the 2024 supplement to the 149
198+general statutes is repealed and the following is substituted in lieu 150
199+thereof (Effective October 1, 2024): 151
200+(c) (1) Any person who operates any motor vehicle during the period 152
201+such person's operator's license or right to operate a motor vehicle in 153
202+this state is under suspension or revocation on account of a violation of 154
203+subsection (c) of section 14-224, section 14-227a or 14-227m, subdivision 155
204+(1) or (2) of subsection (a) of section 14-227n or section 53a-56b or 53a-156
205+60d or pursuant to section 14-227b, or in violation of a restriction or 157
206+limitation placed on such person's operator's license or right to operate 158
207+a motor vehicle in this state by the Commissioner of Motor Vehicles 159
208+pursuant to subsection (i) of section 14-227a or pursuant to an order of 160
209+the court under subsection (b) of section 14-227j, shall be fined not less 161
210+than five hundred dollars or more than one thousand dollars and 162
211+imprisoned not more than one year, and, in the absence of any 163
212+mitigating circumstances as determined by the court, thirty consecutive 164
213+days of the sentence imposed may not be suspended or reduced in any 165
214+manner. 166
215+(2) Any person who operates any motor vehicle during the period 167
216+such person's operator's license or right to operate a motor vehicle in 168
217+this state is under suspension or revocation on account of a second 169
218+violation of subsection (c) of section 14-224, section 14-227a or 14-227m, 170
219+subdivision (1) or (2) of subsection (a) of section 14-227n or section 53a-171
220+56b or 53a-60d or for the second time pursuant to section 14-227b, or in 172
221+violation of a restriction or limitation placed for the second time on such 173
222+person's operator's license or right to operate a motor vehicle in this state 174
223+by the Commissioner of Motor Vehicles pursuant to subsection (i) of 175
224+section 14-227a or pursuant to an order of the court under subsection (b) 176
225+of section 14-227j, shall be fined not less than five hundred dollars or 177
226+more than one thousand dollars and imprisoned not more than two 178
227+years, and, in the absence of any mitigating circumstances as 179

235+(3) Any person who operates any motor vehicle during the period 182
236+such person's operator's license or right to operate a motor vehicle in 183
237+this state is under suspension or revocation on account of a third or 184
238+subsequent violation of subsection (c) of section 14-224, section 14-227a 185
239+or 14-227m, subdivision (1) or (2) of subsection (a) of section 14-227n or 186
240+section 53a-56b or 53a-60d or for the third or subsequent time pursuant 187
241+to section 14-227b, or in violation of a restriction placed for the third or 188
242+subsequent time on such person's operator's license or right to operate 189
243+a motor vehicle in this state by the Commissioner of Motor Vehicles 190
244+pursuant to subsection (i) of section 14-227a or pursuant to an order of 191
245+the court under subsection (b) of section 14-227j, shall be fined not less 192
246+than five hundred dollars or more than one thousand dollars and 193
247+imprisoned not more than three years, and, in the absence of any 194
248+mitigating circumstances as determined by the court, one year of the 195
249+sentence imposed may not be suspended or reduced in any manner. 196
250+(4) The court shall specifically state in writing for the record the 197
251+mitigating circumstances, or the absence thereof. 198

323-program to provide grants to municipalities to support enforcement of 275
324-laws relating to street takeovers, as defined in section 14-224 of the 276
325-general statutes, and illegal dirt bike and all-terrain vehicle operation, 277
326-including enforcement of the provisions of subsection (c) of section 14-278
327-224 of the general statutes and ordinances adopted pursuant to section 279
328-14-390 of the general statutes, as amended by this act, section 14-390m 280
329-of the general statutes, as amended by this act, and section 3 of this act. 281
330-Such grants shall be in an amount of not less than five hundred 282
331-thousand dollars and shall be used by municipalities for law 283
332-enforcement overtime costs associated with enforcement of such laws, 284
