LCO No. 1408 1 of 2 General Assembly Proposed Bill No. 5186 January Session, 2025 LCO No. 1408 Referred to Committee on LABOR AND PUBLIC EMPLOYEES Introduced by: REP. FISHBEIN, 90th Dist. AN ACT CONCERNING PUBLIC EMPLOYEES' SELECTION OF AN EXCLUSIVE BARGAINING UNIT. Be it enacted by the Senate and House of Representatives in General Assembly convened: That chapter 68 of the general statutes be amended to: (1) Allow 1 public employees to vote, at least every four years, to (A) redesignate 2 their current employee organization as their exclusive bargaining agent, 3 (B) select a different employee organization to represent them, (C) 4 choose to have no employee organization represent them, and (D) 5 organize a new employee organization; (2) require that, if no such 6 election is conducted in such a four-year period or in the manner 7 required, the employee organization shall be undesignated by the State 8 Board of Labor Relations; (3) require that an employee organization 9 receive votes from a majority of all employees who will be represented, 10 regardless of membership, in order to be designated as an exclusive 11 representative; (4) require that voting be by secret ballot and that such 12 voting may be conducted by phone, Internet or other means; (5) require 13 that the cost of such election be the responsibility of the employee 14 organization; and (6) require that, in the event an employee organization 15 Proposed Bill No. 5186 LCO No. 1408 2 of 2 is no longer designated as the exclusive representative of a collective 16 bargaining unit, a similar or affiliated employee organization shall not 17 reorganize the bargaining unit within one year of the election. 18 Statement of Purpose: To protect public employees' right to elect a union of their choice to represent their interests.
