AN ACT CONCERNING SENTENCE MODIFICATION ELIGIBILITY. Be it enacted by the Senate and House of Representatives in General Assembly convened: That section 53a-39 of the general statutes be amended to establish a 1 "second look" process to identify cases where bias, extreme sentencing 2 and mitigating circumstances may justify early release to eligible 3 persons, including incarcerated elderly, persons with developmental 4 disabilities and rehabilitated incarcerated persons who could be safely 5 decarcerated with sentence modification. 6 Statement of Purpose: To establish a "second look" process for sentencing modification for eligible persons who are incarcerated by expanding the role of courts in sentence reduction and shifting responsibility away from the Board of Pardons and Paroles.
