1918 AN ACT AUTHORIZING RESIDENTS LIVING IN A FLOOD ZONE TO
2019 LAY UP TO TEN THOUSAND CUBIC YARDS OF LANDSCAPE FILL
2120 PER YEAR IN THEIR YARD AND ESTABLISHING A TAX DEDUCTION
2221 FOR THE COSTS OF SUCH FILL AND A GRANT PROGRAM FOR

2423 Be it enacted by the Senate and House of Representatives in General

27-Section 1. (NEW) (Effective October 1, 2025) (a) Notwithstanding any 1
28-provision of the general statutes, the Department of Energy and 2
29-Environmental Protection shall establish a permit that authorizes any 3
30-resident living in a flood zone to lay up to ten thousand cubic yards of 4
31-landscaping fill around the foundation of such resident's dwelling per 5
32-year. 6
33-(b) The Commissioner of Energy and Environmental Protection may 7
34-adopt regulations, in accordance with the provisions of chapter 54 of the 8
35-general statutes, to implement the provisions of this section. 9
36-Sec. 2. (NEW) (Effective October 1, 2025) (a) Notwithstanding any 10
37-provision of the general statutes, the Department of Revenue Services 11
38-shall establish an income tax deduction for the cost of installing 12
39-landscaping fill, as described in section 1 of this act. 13

31+deduction for the cost of such landscaping fill; and (3) the Department 6
32+of Transportation to establish a grant program for road raising to 7
33+support climate resiliency whereby grants will be made available to 8
34+municipalities for climate resiliency projects that also meet the 9
35+requirements for the Local Capital Improvement Program. 10
36+Statement of Purpose:
37+To authorize the placement of landscape fill in flood zones and create a

45-(b) The Commissioner of Revenue Services may adopt regulations, in 14
46-accordance with the provisions of chapter 54 of the general statutes, to 15
47-implement the provisions of this section. 16
48-Sec. 3. (NEW) (Effective October 1, 2025) (a) Notwithstanding any 17
49-provision of the general statutes, the Department of Transportation shall 18
50-establish a grant program for road raising to support climate resiliency, 19
51-that provides grants to municipalities for climate resiliency projects that 20
52-also meet the requirements for local capital improvement projects. 21
53-(b) The Commissioner of Transportation may adopt regulations, in 22
54-accordance with the provisions of chapter 54 of the general statutes, to 23
55-implement the provisions of this section. 24
56-This act shall take effect as follows and shall amend the following
