AN ACT AUTHORIZING RESIDENTS LIVING IN A FLOOD ZONE TO 
LAY UP TO TEN THOUSAND CUBIC YARDS OF LANDSCAPE FILL 
PER YEAR IN THEIR YARD AND ESTABLISHING A TAX DEDUCTION 
FOR THE COSTS OF SUCH FILL AND A GRANT PROGRAM FOR 
ROAD RAISING. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective October 1, 2025) (a) Notwithstanding any 1 
provision of the general statutes, the Department of Energy and 2 
Environmental Protection shall establish a permit that authorizes any 3 
resident living in a flood zone to lay up to ten thousand cubic yards of 4 
landscaping fill around the foundation of such resident's dwelling per 5 
year. 6 
(b) The Commissioner of Energy and Environmental Protection may 7 
adopt regulations, in accordance with the provisions of chapter 54 of the 8 
general statutes, to implement the provisions of this section. 9 
Sec. 2. (NEW) (Effective October 1, 2025) (a) Notwithstanding any 10 
provision of the general statutes, the Department of Revenue Services 11 
shall establish an income tax deduction for the cost of installing 12 
landscaping fill, as described in section 1 of this act. 13

(b) The Commissioner of Revenue Services may adopt regulations, in 14 
accordance with the provisions of chapter 54 of the general statutes, to 15 
implement the provisions of this section. 16 
Sec. 3. (NEW) (Effective October 1, 2025) (a) Notwithstanding any 17 
provision of the general statutes, the Department of Transportation shall 18 
establish a grant program for road raising to support climate resiliency, 19 
that provides grants to municipalities for climate resiliency projects that 20 
also meet the requirements for local capital improvement projects. 21 
(b) The Commissioner of Transportation may adopt regulations, in 22 
accordance with the provisions of chapter 54 of the general statutes, to 23 
implement the provisions of this section. 24 
This act shall take effect as follows and shall amend the following 
sections:

Statement of Purpose:   
To authorize the placement of landscape fill in flood zones and create a 
tax deduction for such flood prevention measures as well as a grant 
program for road raising municipalities climate resiliency efforts by 
municipalities.
