1322 Be it enacted by the Senate and House of Representatives in General

1625 Section 1. (NEW) (Effective October 1, 2025) (a) As used in this section: 1
17-(1) "Assisted living services agency" means an entity licensed by the 2
18-Department of Public Health pursuant to chapter 368v of the general 3
19-statutes that provides, among other things, nursing services and 4
20-assistance with activities of daily living in a managed residential 5
21-community to a population that is chronic and stable; 6
22-(2) "Automated external defibrillator" means a device that: (A) Is used 7
23-to administer an electric shock through the chest wall to the heart; (B) 8
24-contains internal decision-making electronics, microcomputers or 9
25-special software that allows it to interpret physiologic signals, make 10
26-medical diagnoses and, if necessary, apply therapy; (C) guides the user 11
27-through the process of using the device by audible or visual prompts; 12
28-and (D) does not require the user to employ any discretion or judgment 13
29-in its use; 14
30-(3) "Managed residential community" means a for-profit or not-for-15
31-profit facility consisting of private residential units that provides a 16
32-managed group living environment consisting of housing and services 17
33-for persons who are primarily fifty-five years of age or older. "Managed 18 Substitute Bill No. 1190
26+(1) "Assisted living facility" means a facility operated by an assisted 2
27+living services agency, as defined in section 19a-490 of the general 3
28+statutes, that provides chronic and stable individuals with services that 4
29+include, but need not be limited to, nursing services and assistance with 5
30+activities of daily living and may have a dementia special care unit or 6
31+program, as defined in section 19a-562 of the general statutes; 7
32+(2) "Automated external defibrillator" means a device that: (A) Is used 8
33+to administer an electric shock through the chest wall to the heart; (B) 9
34+contains internal decision-making electronics, microcomputers or 10
35+special software that allows it to interpret physiologic signals, make 11
36+medical diagnosis and, if necessary, apply therapy; (C) guides the user 12
37+through the process of using the device by audible or visual prompts; 13

38-residential community" does not include any state-funded congregate 19
39-housing facilities; and 20
40-(4) "Nursing home" means (A) any chronic and convalescent nursing 21
41-home or any rest home with nursing supervision that provides nursing 22
42-supervision under a medical director twenty-four hours per day; or (B) 23
43-any chronic and convalescent nursing home that provides skilled 24
44-nursing care under medical supervision and direction to carry out 25
45-nonsurgical treatment and dietary procedures for chronic diseases, 26
46-convalescent stages, acute diseases or injuries. 27
47-(b) Not later than January 1, 2026, the administrator of each nursing 28
48-home and each managed residential community shall (1) provide and 29
49-maintain an automated external defibrillator in a central location on the 30
50-premises of the nursing home or managed residential community, (2) 31
51-make such central location known and accessible to staff members and 32
52-residents of the home or community and family members of such 33
53-residents who visit the home or community, and (3) maintain and test 34
54-the automatic external defibrillator in accordance with the 35
55-manufacturer's guidelines. 36
56-(c) Not later than January 1, 2026, the administrator of each nursing 37
57-home and each assisted living services agency shall ensure that at least 38
58-one staff member of the nursing home or managed residential 39
59-community, who is trained in cardiopulmonary resuscitation and the 40
60-use of an automatic external defibrillator in accordance with the 41
61-standards set forth by the American Red Cross or American Heart 42
62-Association, is on the premises of the home or community during all 43
63-hours of operation. 44

59+at least one staff member of the home or facility, who is trained in 29
60+cardiopulmonary resuscitation and the use of an automatic external 30
61+defibrillator in accordance with the standards set forth by the American 31
62+Red Cross or American Heart Association, is on the premises of the 32
63+home or facility during all hours of operation, and (4) maintain and test 33
64+the automatic external defibrillator in accordance with the 34
65+manufacturer's guidelines. 35
