25 | 25 | | Section 1. Section 7-148d of the general statutes is repealed and the 1 |
---|
26 | 26 | | following is substituted in lieu thereof (Effective July 1, 2025): 2 |
---|
27 | 27 | | (a) If a commission determines, after a hearing, that the rental charge 3 |
---|
28 | 28 | | or proposed increase in the rental charge for any housing 4 |
---|
29 | 29 | | accommodation is so excessive, based on the standards and criteria set 5 |
---|
30 | 30 | | forth in section 7-148c, as to be harsh and unconscionable, it may order 6 |
---|
31 | 31 | | that the rent be limited to such an amount as it determines to be fair and 7 |
---|
32 | 32 | | equitable. If a commission determines, after a hearing, that the housing 8 |
---|
33 | 33 | | accommodation in question fails to comply with any municipal 9 |
---|
34 | 34 | | ordinance or state statute or regulation relating to health and safety, it 10 |
---|
35 | 35 | | may order the suspension of further payment of rent by the tenant until 11 |
---|
36 | 36 | | such time as the landlord makes the necessary changes, repairs or 12 |
---|
37 | 37 | | installations so as to bring such housing accommodation into 13 |
---|
38 | 38 | | compliance with such ordinance, statute or regulation. The rent during 14 |

46 | 46 | | to ordinances or provisions adopted by the town, city or borough. 16 |

47 | 47 | | (b) If the commission determines, after a hearing, that a landlord has 17 |

48 | 48 | | retaliated in any manner against a tenant because the tenant has (1) 18 |
---|
49 | 49 | | complained to the commission, or (2) prevailed in a proceeding before 19 |
---|
50 | 50 | | the commission and such retaliation occurs not later than six months 20 |
---|
51 | 51 | | after the tenant prevails in such proceeding, the commission may order 21 |
---|
52 | 52 | | the landlord to cease and desist from such conduct. 22 |
