1919 AN ACT PROHIBITING A LANDLORD FROM RETALIATING AGAINST
2020 A TENANT WHO PREVAILS IN A FAIR RENT COMMISSION

2222 Be it enacted by the Senate and House of Representatives in General

2525 Section 1. Section 7-148d of the general statutes is repealed and the 1
2626 following is substituted in lieu thereof (Effective July 1, 2025): 2
2727 (a) If a commission determines, after a hearing, that the rental charge 3
2828 or proposed increase in the rental charge for any housing 4
2929 accommodation is so excessive, based on the standards and criteria set 5
3030 forth in section 7-148c, as to be harsh and unconscionable, it may order 6
3131 that the rent be limited to such an amount as it determines to be fair and 7
3232 equitable. If a commission determines, after a hearing, that the housing 8
3333 accommodation in question fails to comply with any municipal 9
3434 ordinance or state statute or regulation relating to health and safety, it 10
3535 may order the suspension of further payment of rent by the tenant until 11
3636 such time as the landlord makes the necessary changes, repairs or 12
3737 installations so as to bring such housing accommodation into 13
3838 compliance with such ordinance, statute or regulation. The rent during 14

4545 said period shall be paid to the commission to be held in escrow subject 15
4646 to ordinances or provisions adopted by the town, city or borough. 16
4747 (b) If the commission determines, after a hearing, that a landlord has 17
4848 retaliated in any manner against a tenant because the tenant has (1) 18
4949 complained to the commission, or (2) prevailed in a proceeding before 19
5050 the commission and such retaliation occurs not later than six months 20
5151 after the tenant prevails in such proceeding, the commission may order 21
5252 the landlord to cease and desist from such conduct. 22
