LCO No. 4996 1 of 4 General Assembly Raised Bill No. 1344 January Session, 2025 LCO No. 4996 Referred to Committee on AGING Introduced by: (AGE) AN ACT CONCERNING HOMEMAKER -COMPANION AGENCIES. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective from passage) (a) Not later than December 1 31, 2025, the Commissioner of Consumer Protection, in consultation 2 with the Commissioners of Public Health, Social Services, 3 Developmental Services and Mental Health and Addiction Services, 4 shall develop a list of approved homemaker-companion agency 5 employee training programs appropriate for use by homemaker-6 companion agencies when providing mandatory employee training 7 pursuant to the provisions of subsections (b) and (c) of this section. The 8 list of approved homemaker-companion agency employee training 9 programs shall be limited to programs concerning (1) cardiopulmonary 10 resuscitation and first aid, (2) communication, (3) maintenance of a clean 11 and safe environment, including, but not limited to, best practices 12 relating to dressing, bathing and toileting assistance, (4) identification 13 and reporting of abuse and neglect, (5) identification and reporting of 14 changes in a homemaker-companion agency client's condition and 15 service needs, (6) differentiation between medical and nonmedical care, 16 and (7) providing nonmedical services to a person with Alzheimer's 17 Raised Bill No. 1344 LCO No. 4996 2 of 4 disease or dementia. 18 (b) (1) Each homemaker-companion agency, as defined in section 20-19 670 of the general statutes, shall provide not less than ten paid hours of 20 initial training to each new employee not later than ninety days after a 21 new employee's start of employment. Such initial training shall include, 22 but need not be limited to, programs relating to the topics described in 23 subdivisions (1), (3), (4) and (5) of subsection (a) of this section and, if 24 the new employee will provide services to persons with Alzheimer's 25 disease or dementia, subdivision (7) of subsection (a) of this section. 26 (2) Notwithstanding the provisions of subdivision (1) of this 27 subsection, a homemaker-companion agency shall not require a new 28 employee who (A) is currently certified in cardiopulmonary 29 resuscitation, (B) has completed a course in first aid, and (C) submits 30 proof of such certification and completion to complete initial training 31 relating to cardiopulmonary resuscitation and first aid. 32 (c) On and after January 1, 2026, each homemaker-companion agency 33 shall provide annually not less than ten paid hours of continuing 34 education to each employee. Such continuing education shall be 35 comprised of programs on the list of approved homemaker-companion 36 agency employee training programs developed pursuant to subsection 37 (a) of this section. Each homemaker-companion agency shall ensure that 38 each employee completes every program on such list at least once every 39 two calendar years. 40 (d) Upon completion of any employee training conducted pursuant 41 to subsections (b) and (c) of this section, each homemaker-companion 42 agency and employee shall complete a form, in a form and manner 43 prescribed by the Commissioner of Consumer Protection, attesting that 44 the employee completed such training. Such form shall include the 45 names of the homemaker-companion agency and employee, the 46 training programs completed by the employee and the signatures of a 47 representative of the homemaker-companion agency and the employee. 48 Raised Bill No. 1344 LCO No. 4996 3 of 4 (e) Not later than January 1, 2026, and annually thereafter, each 49 homemaker-companion agency shall (1) submit to the Department of 50 Consumer Protection, in a form and manner prescribed by the 51 commissioner, an attestation in which such homemaker-companion 52 agency agrees to adhere to the training requirements described in this 53 section, (2) maintain a list of training programs used by such 54 homemaker-companion agency, including content summaries of such 55 programs, and (3) maintain a paper or electronic copy of all forms 56 relating to current employees submitted pursuant to subsection (d) of 57 this section. 58 Sec. 2. Subsection (b) of section 20-672 of the general statutes is 59 repealed and the following is substituted in lieu thereof (Effective July 1, 60 2025): 61 (b) Each application for a certificate of registration as a homemaker-62 companion agency shall be accompanied by a fee of [three hundred 63 seventy-five] four hundred fifty dollars. 64 This act shall take effect as follows and shall amend the following sections: Section 1 from passage New section Sec. 2 July 1, 2025 20-672(b) Statement of Purpose: To (1) require the Commissioner of Consumer Protection to develop a list of approved training programs for homemaker-companion agency employees, (2) require homemaker-companion agencies to provide not less than ten hours of (A) initial training to new employees, and (B) continuing education to current employees, and (3) increase the registration fee for homemaker-companion agencies from three hundred seventy-five dollars to four hundred fifty dollars.
