LCO 5389 1 of 2 General Assembly Raised Bill No. 1389 January Session, 2025 LCO No. 5389 Referred to Committee on PUBLIC SAFETY AND SECURITY Introduced by: (PS) AN ACT AUTHORIZING CERTAIN ORDINANCES CONCERNING STREET TAKEOVERS. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective October 1, 2025) (a) For purposes of this 1 section, "street takeover" has the same meaning as provided in section 2 14-224 of the general statutes, and "motor vehicle" has the same meaning 3 as provided in section 14-1 of the general statutes. 4 (b) Any municipality may, by ordinance, prohibit a person from 5 organizing, participating in or gathering with intent to observe and 6 actually observing a street takeover. Such ordinance may provide for 7 the seizure and forfeiture to the municipality of any motor vehicle 8 involved in a street takeover for a violation of such ordinance, subject to 9 any bona fide lien, lease or security interest in the motor vehicle. 10 (c) No motor vehicle shall be forfeited under an ordinance adopted 11 pursuant to this section to the extent of the interest of an owner or 12 lienholder by reason of any act or omission committed by another 13 person if such owner or lienholder did not know and could not have 14 reasonably known that such motor vehicle was being used or was 15 Raised Bill No. 1389 LCO 5389 2 of 2 intended to be used in violation of a municipal ordinance. 16 (d) Any motor vehicle ordered forfeited pursuant to such an 17 ordinance shall be sold at public auction conducted by the municipality. 18 The proceeds of such sale shall be paid to the treasurer of the 19 municipality, who shall deposit such proceeds into the general fund of 20 the municipality or in any special fund designated by the municipality 21 and use such proceeds to support the municipality's police department 22 or the resident state trooper serving such municipality. 23 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2025 New section PS Joint Favorable
